The decision is all about Winston being required to answer questions about his superannuation forms and his involvement as a Minister with the ‘no surprises’ policy over the years. While Winston has provided some of the answers there are areas of vagueness that he has been asked to clarify.

The application was brought by the Attorney General (who is being sued with respect to SSC and MSD) and the two departmental heads in person. Paula Bennett and Anne Tolley were not involved with this aspect and their lawyers did not put in an appearance. Perhaps they are becoming mere appendages to the trial.

It would seem the Crown’s and Departments’ arguments are roughly:
1. The circumstances surrounding the over claimed superannuation amount were such as to warrant informing the relevant Ministers under the ‘no surprises’ policy.
2. Since Winston had apparently received and was informed by ‘no surprises’ reports in the past, it is a bit rich for him to turn round now and try and claim that the policy is wrong. Interestingly he is being asked about ‘no surprises’ reports that he declined to read (unlike most other Ministerial papers a Minister would not necessarily need to read ‘no surprises’ reports).

  As mentioned yesterday, the matter has been a factor in an Election campaign, legal action against Government officials and Members (claiming $1.8 million in taxpayer funds, should it be paid), in the question of “good faith” coalition Government negotiations, Parliamentary conduct and the appreciation or not of hospital flowers, over a period now exceeding 25 months and 22 days.

Poor old Zim…
They refloated their currency and are back into hyper inflation.

Electricity is only available 4 hours a day in Harare. Food and fuel in short supply. 90% are unemployed.

Their population is down about 40% (people have fled to Botswana, South Africa, bloody anywhere else) but still they expect massive starvation. Zim produced 60 kT of wheat out of the 450kT they need. This is partially due to drought conditions, but is mainly due to poor farming practices and the shortage of electricity for irrigation. The government blames colonialism and climte change.

Medical facilities are short of staff and supplies. Doctors are on strike. They get paid about NZ$ 50 per month – not enough to pay bus fairs to work.

But don’t worry – Comrade Emmerson Mnangagwa has just flow to Uganda to be presented with The Pearl Of Africa award by the Ugandan President.

Things are looking up. The government promises to build new generators and synthetic fule plants. They will be exporting electricity in 5 years and fuel in 8 years…..

      We are a maritime nation dependent on sea routes. We need to be able to deter countries like China from building the capacity to threaten and interrupt those trade routes.

  Winston is the one doing the suing so he has to answer relevant questions. This is a civil trial so the parties have to answer relevant questions and (unlike with a criminal accused) the judge may make adverse inferences if questions are not properly answered.
  I am a bit surprised that the Court has ruled that questions about the super payments are fair game (popcorn time!). Winston’s lawyer no doubt tried to argue they were not relevant to the trial.

They caught the chch shooter because of experienced and active police who weren’t waiting around for a black s.u.v full of special police to show up. So if it’s too dangerous normal police have to wait around now for these guys to show up , and just because they’re slightly more ‘ready’ and ‘mobile’ they still have to wait for warrants and can’t just do drug raids on a hunch -they could be wrong , really don’t think this is the answer.

  Actually the Christchurch incident is just where they would have been useful. The two front line police officers could only restrain the alleged offender for a relatively short period and remained at some risk and needed help fairly quickly. There was a distinct possibility that the alleged offender could have broken free and took off with a firearm.
  It is like CPR – you cannot do it indefinitely – you are wanting the Ambos to turn up as quickly as possible.

  I moved from South Africa where armed police was the norm. Everyone had a pistol on the hip and an Uzi or similar in the van. At least when arseholes pulled a weapon there was a good chance the arsehole was taken away in a body bag. There are very few countries in the world that do not routinely arm the police. The biggest challenge is to actually get the guys to actually pull the trigger, as killing perps is not routine in New Zealand, and most people don’t like killing others. I did military training and know how to shoot. But I have never shot a person, and I thank God for that. Many veterans from WW2 still had psychological trauma from the killing they experienced for the rest of their lives. The biggest positive of having armed police is that it will act as a deterrent except to the most hardened criminals (who deserve to be shot).

    While slightly tangential to the topic, you make a good point. I’m unsure if it was Peterson or some other psychologist, but I recall them saying that the PTSD the soldiers experienced was not so much due to what they saw in battle, but what they had to do in battle. When you find out what you are capable of doing in extreme situations, it’s got to be very disturbing. Those poor bastards had to do some horrific stuff to their fellow men, albeit ‘the enemy’ at the time, in order to get back alive.

      I remember watching a US veteran being interviewed and how he recounted shooting a young german soldier. And then when he got to her he discovered she was a young girl of about 15. And he started crying once again. Words to the affect of never being able to deal with that for the rest of his life. Ther are many really good videos on youtube that deal with this.   As a side note, I wonder how Sir John Key would have reacted to be asked about his autobiography before he had actually achieved anything…….

    They didn’t win more votes than Labour win Muldoon was leader.

Vision NZ leader Hannah Tamaki has posted a fake image on her Twitter account showing NZ First MP Shane Jones proudly showing off a picture of a Muslim woman riddled with bullet holes.
The original image, uploaded to Facebook by his wife Dot, showed the Regional Economic Development Minister holding up a generic target, showing off his impressive aim.
The version Tamaki tweeted however has been amended to include a woman in a black niqab, making it appear Jones was taking delight in gunning her down.

Most have an established opinion of what this says about Shane Jones.
But what of Hanah Tamaki?

And when Andrew Little gets his reported current considering of hate speech together into some form that he can share with everyone else, it will be interesting to see where – if any place – use of such a photo falls.

      Define an anti – science site. I read many of the alarmist stuff and the sceptical stuff so that I can weight the evidence and form a conclusion. Right now there seems to be a massive debate on the actual physical processes that allow heat to be trapped by gasses in the atmosphere. The Greenhouse analogy is seriously flawed (for one thing there is no big fucking piece of glass covering the atmosphere) and there is quite a bit of debate around saturation. Some even argue that increased CO2 results in cooling.

    NASA claimed for years that the Antarctic ice was rapidly diminishing, and it was on their website.
    
    About 3 or 4 years ago, and also published on their website, NASA admitted that Antarctic ice was increasing. The reason ? They were only monitoring the Eastern icesheet, not the western icesheet, which was increasing at a far faster rate than the East was decreasing.
    
    Dumb and dumber.
    
    You can download the stats from any NZ tidal gauge data (I have) and it shows less than 1.6mm per year increase in sea level rise. NASA tell us its about 3.2mm? UM, the f-tards doing this work forgot to divide by 2 because the satellites took the total diameter of sea level rise. No-one has put their hand up to admit this cock-up.
    
    There are other numerous goof-ups by NASA but those two are a start.
    
    PS. The Arctic ice is NOT decreasing year on year.

Tauranga’s criminal justice facilities are so inadequate that it can take over 2 1/2 years to go to trial….do they keep these people in jail while they wait? (as frequently happens in the US). . .

Justice Brewer made the comments at a pre-trial hearing in Tauranga High Court earlier this week for Andrew Alan William, 53, and his 30-year-old partner Laken Maree Rose.

The pair have denied a raft of alleged sexual crimes against children aged between 3 and 15 years, which includes joint charges of indecent assaults and rape of children under 12.

They have also pleaded not guilty to charges of making objectionable publications and possession of objectionable publications which relate to allegedly recording the acts.

“Unfortunately the most I can do is set down a four-week standby trial fixture in Hamilton High Court to begin on November 16, 2020, and if that cannot go ahead, a confirmed trial date on February 8, 2021,” Justice Brewer told Rose and Williams.

  By observation most self proclaimed climate change scientists don’t know the Scientific Method.

Mike Hosking referred to the matter raised here, on his show yesterday morning.

For the purposes of my response, below, to the issues raised in the RNZ link, let’s set aside the question of whether or not some DHB members should be elected. (In this regard, see DPF’s Post ‘I agree with Goff’.)

As we all know, the seven elected members of each of our 20 DHBs (except for the Southern DHB) are elected at-large, i.e., from across the entire DHB area, by STV. That means each successful candidate will have attained 12.5% of the votes cast (100 / 8 = 12.5%), to be elected.

In 2016, voters in the Eastern Bay elected two candidates to the Bay of Plenty DHB, and a third person from that part of the BoP was appointed. Unfortunately, this time, Eastern Bay voters only elected one candidate, and that guy, Ian Finch, now plans “to petition Health Minister David Clark and local MPs Kiri Allan, Tamati Coffey and Anne Tolley to ensure appointed DHB members hailed from the Eastern Bay.”

Six candidates from the Eastern Bay stood for election, but only Mr Finch was successful. One of the five unsuccessful candidates, Mawera Karetai, is “‘extremely concerned about the lack of representation for the Eastern Bay.’

“She believes a ward system should be looked at, like district and regional council elections, to ensure all regions receive fair representation.

“‘Representation matters,’ Ms Karetai said.”

Well, yes it does, and that is one of the reasons why DHB candidates are elected at-large, to ensure that each ‘constituency’ of a DHB has every opportunity to elect at least one candidate.

In now advocating for a ‘ward’ system, Ms Karetai is essentially saying she wants two guaranteed members – no doubt, from the voting figures, including herself – to represent the Eastern Bay; for such representation to be simply handed to that ‘constituency’ on a plate.

STV is a system of proportional representation. Unlike FPP, where you can abstain from voting and still get what you want, with STV, if you want something you must vote for it. If you don’t vote, you are likely to miss out to those who *do* vote – and that is exactly as it should be.

The fact that the people of the Eastern Bay rejected five of the six candidates on offer – four of them were always going to be unsuccessful, based on population and voter participation – suggests three things. The candidates, other than Ian Finch, did not appeal to Eastern Bay voters; or that the voter participation rate in the Eastern Bay was lower than elsewhere in the Bay; or that getting *two* elected members last time was a pleasant ‘aberration’. Or perhaps it was a combination of all three!

In this regard, it is noted that “Nearly 70,000 voting documents were sent to voters across the Bay, of these 7788 were returned blank with no votes made for DHB members.” How many of those 7,788 blank returns were from Eastern Bay voters, I wonder? And were there disproportionally more blank returns from the Eastern Bay than from elsewhere in the Bay?

The answer to Ms Karetai’s concerns is staring her in the face: next time, she, along with others, must impress upon her ‘constituents’ the importance of voting, and, in the meantime, potential DHB candidates in 2022 must get out there and make themselves known to Eastern Bay voters.

In addition, next time, Eastern Bay candidates should get this message out to voters: to ensure we get our fair share of representation, you should, if at all possible, rank-order the Eastern Bay-based candidates, 1, 2, 3, 4, …, before, if you so choose, rank-ordering Tauranga- and Rotorua-based candidates, …, 5, 6, 7, etc.

A ‘ward’ system would only ensure half or more of Eastern Bay voters would be unrepresented on the DHB by someone they voted for, and that successful candidates would often be elected unopposed, as happens regularly with the Māori constituencies of the BoP Regional Council (albeit under FPP).

    Last election they had a very slick and cynical media person who wrote and dispatched PR releases two or three times per week.
    They were cleverly persuasive and sounded sensible and credible – just what a lot of older, regionally based people wanted to hear.
    Many believed the promises and rhetoric contained in those messages and voted accordingly.
    They were sucked in by a very manipulative outfit and I imagine a lot of laughs were had at their expense as the support for Winston 1st grew.
    I don’t know any of those supporters who forwarded on to us here the regular puff pieces featuring Winston the Saviour who have any belief left in him now whatsoever. They know they were used and thrown aside.
    Will they be fooled again next time is the question.

A terror plot inspired by the 9/11 attack on the World Trade Centre in New York has been foiled by the French intelligence services.

One person is being held in custody in France on preliminary terrorism charges after apparently planning a September 11-style plane hijacking and attack.

According to French paper Le Parisien, the suspect was looking for a weapon to hijack a plane.

Interior Minister Christophe Castaner said on France-2 television on Thursday night that the person was arrested on 26 September while “in the process of planning” such an attack.*

Then came the classic anti-media rhetoric and attacking of the polls, demanding that any journalist who ran the polls must resign when New Zealand First is elected in 2020.

But then Peters took it far too far, making light of the sale of MediaWorks TV – 520 jobs are on the line.

The new Race Relations Commissioner, Meng Foon, is attacking freedom of speech.

A new Tauranga city councillor, Andrew Hollis, has been vigorously criticising the Treaty of Waitangi.

Meng Foon in response says that Hollis should stand down from the council. Here is Meng Foon’s reasoning, as reported in the Herald:

“All elected members must swear an oath to abide by the Local Government Act which includes Treaty obligations.”

Under its Corbynist new chief commissioner, the Human Rights Commission looks to be leading the campaign against free speech.

  ‘The investigation, launched more than three years ago, did find violations by 38 people, some of whom may face disciplinary action.
  
  Investigators determined that those 38 people were “culpable” in 91 cases of sending classified information that ended up in Clinton’s personal email, according to a letter sent to Republican senator Chuck Grassley this week and released on Friday. The 38 are current and former state department officials but were not identified.’
