To Jenny Lynch, Glen McDonald, Maryana Garcia, Micheal Neilson, Claire Trevett and any other wannabe Journalists in the Media who continue to push and create a witchhunt over Sam Uffindell not being fit to be a MP and also smearing the National Party Opposition Leader for the full report not being made public you sure have short
memories.
To through your toys out the window because the whole report made by Maria Dew was not released shows what absolute Hypocrites Labour and the Media are, what happened over the Young Labour Summer Camp debacle and the cover up of the sexual assault that happened their. Then tell us where the report from the sexual deviate out of the Prime Minister’s Office went that interns believe was rape.
But no Grant Robertson our Deputy Prime Minister creates a smear on Chris Luxon releasing the Dew repot on the day of Queens Burial and Labour the Media go full moon because they are not allowed to see the full report.

  Robertson is a hypocrite to smear Luxon over releasing the report on the day of the Queen’s funeral, when Ardern released the news all covid restrictions where being lifted the day the Queen died. And don’t forget releasing that Mallard is resigning and taking up a overseas post 5:45 pm so it wouldn’t make the 6pm news – The fact mallard resigned and the appointment of new speaker held over parliament for a day, at a time Dr Sharma was to speak over his expulsion form the Labour caucus – Absolute arseholes.

      Ok, so reading what I could about what happened I’ve found the following:
      
      No additional complaints came forward (this is a huge one as it destroys the habitual bully narrative).
      There was a breakdown of the flat with bad blood on both sides.
      14 people were interviewed.
      What happened according to the statements from the “victim” were significantly different from any of the witnesses.
      
      So what else do you actually need? The names of the witnesses? We have all pertinent information.
      
      As I have stated Maria Dew, KC is a Labour appointed employment law KC that Labour like to use for their reviews. She took longer than expected to complete her report and honestly, I think it’s wishful thinking to think she didn’t look at this from every possible angle. If she didn’t find anything, it’s unlikely there was anything to find.

        Im finding it very difficult to know if this is fair or not given we don’t even know what the terms of reference were; who was interviewed; who wasn’t; and what the report found happened (as opposed to what didn’t happen)
        
        The lack of transparency is ironic (at best) given National have gone on and on and on about Labour and transparency for the last five years
        
        And another question: what’s the evidential standard? Like are we talking court-level here? Are we talking “on balance”? There’s no way to even measure what “proved” means in this context

    She will have sent certain extracts of the Report to specific people for comment. It would be possible for Labour to have these extracts, but these will be nowhere near the full Report.

        You clearly do not know how something like this is managed.
        
        Quite clearly the KC will be keeping everything she has done confidential on the basis of client privilege.
        
        The only other people who would have seen the Report are the members of the National Party Board (9 people, including the Leader and the Senior Whip) and Sam Uffindell.
        
        None of these people would have shown the report to anyone else. They would all take their responsibilities on this very seriously.
        
        In any event leaks take place when a political party is on a downward trend and people turn against each other. This is not the current situation with National.

  And did not Labour people or those close to them chose to announce the claims against Sam deliberately to take the gloss off the National Party Conference and Chris Luxon’s keynote speech.
  There is more water to flow yet. Although he has been reinstated Chris may have read him his ‘horoscope’ (a Royal Navy expression where a sailor is called in for a dressing down and told he has no future in the Navy – like the Army’s ‘meeting without coffee’). Sam will fairly soon have to convince the National Party members in Tauranga that he should be able to stand again in 2023 and can win the seat again despite his Kings handicap. Also the Party’s list ranking group will need to determine whether he gets a ‘normal’ ranking (which would at least see him returned as a list member) or push him way down the list.

        That is a secondary issue. It is democracy which is at stake. Labour is moving towards a regime where some people are more equal than others with its separatism policies.     Unfortunately, that’s apples and oranges.
    
    Both Labour cases were recent with verifiable complaint processes and evidence.
    
    Uffindel’s case literally came down to “we interviewed 14 people and there was no evidence this actually happened”. Short of naming the people, what else could they release?
    
    TLDR: The Labour cases had substance so there was stuff to report, Uffindel’s case didn’t.

  Why should the bought-and-paid-for media, or anyone else, get their hands on a report commissioned by a private organisation (the National Party) looking at events that happened more than a decade ago?
  
  Uffindell and National are not the ruling government – contrast that with the Meika Whaitiri physical assault and the Labour youth camp sexual assaults and under-age drinking. You wood have thought that Labour wood have released that report unredacted, although that wood have certainly caused them more embarrassment, woodn’t it?

  I think it is very sensible for the report to be with held. For one reason, the media would quote bits of it for the next year or two, putting its own interpretation of the report, which would not be in the subject’s favour. If it should be leaked, the the wrath of the National Party should see the exposure of the leaker.
  I think that Chris Luxon has shown leadership and common sense. in this matter.
  And the general public isn’t interested. Everyone knows that 16yo boys can be nasty little bullies – fortunately, most of them grow out of it.

Well, well – we now have the first week of Covid case numbers since the mask mandates were dropped, and interestingly enough they show new cases continuing on their downward trajectory.

One would have thought that if masks were effective in suppressing the spread of Covid that we would see an uptick in case numbers when everyone stopped wearing them. I mean, that’s what the science would say, and isn’t this government about following the science?

Unsurprisingly though I don’t see any journalists asking this question, and sadly I don’t think the penny has dropped for the vast majority of compliant New Zealanders.

A woman made a ACC claim for regular payments in place of lost wages. Such payments are taxable as part of the taxpayer’s income for that year and would subject to the bottom tiers of income tax rates. ACC resisted this but after some years the payments were successfully upheld on appeal. ACC then paid the arrears as a lump sum but was obliged to deduct PAYE on the lump sum which meant that it was subject to the higher tax brackets. In other words she had to pay significantly more tax on the lump sum than the total tax she would have paid if she had received the regular payments from the word go. She took IRD to court and the recent judgment said that the law allowed no flexibility in this particular case so could not clear the way for more favourable tax treatment. Unfortunately I cannot locate a relevant news item to cite and the judgment has yet to appear on the Justice web site. To do her justice a law change would be needed.
One cannot blame this on either political party although IRD got away with too much in the way of tax law during the Bolger/Birch Government in the 1990’s.
If Jacinda was really kind she could ask her Ministers to do a SOP (Supplementary Order Paper) on the current tax bill to ensure this claimant is not burdened with extra tax.

    Although the article is paywalled, what is visible gives some idea of what happened.
    It would seem that given the wording of the legislation in question no one has previously taken on IRD over this. No doubt the woman’s lawyer argued about the ‘purpose’ of the legislation but in this instance the judge considered it could not overcome a ‘black letter’ interpretation. This is ironical since in the past taxpayers accused of tax avoidance have successfully used a ‘black letter’ interpretation to argue there was no avoidance. The 1999 Interpretation Act (now replaced with a more up to date version) stated ‘The meaning of an enactment must be ascertained from its text and in the light of its purpose’. That clause has been a gift from heaven for IRD dealing with complex ‘black letter’ avoidance schemes since IRD have argued successfully that the ‘purpose’ of any scheme be considered (eg for the Trinity Forestry scheme which ended causing much grief and suffering for its promoters and investors). So IRD will argue ‘black letter’ or ‘purpose’ whichever better suits its case.

        ‘It is our job to be fair’ was finally put to rest when a judge ruled that IRD’s job was to apply tax law (mostly drafted by IRD itself) and it was not IRD’s job to be fair.

    As a bean counter I had a client affected by this through erroneous advice from the IRD. Long story short although they could do nothing about the law they did eventually write it off under hardship provisions. (15-20 years ago). Was a long and hard fight & my client was ready to give up and remortgage and pay them.

      I got it. I also made ACC pay interest – because I am a saver. In the end it was pay up or Court. They knew I had won.

  Should be easy to resolve for our lawmakers. If ACC are found to have got it wrong, the tax paid by the recipient should be based on the tax payable had they received the payments as they should have.
  
  The difference between that and the tax payable on the lump sum should fall on ACC.

    ACC had not got it wrong with its tax treatment. It had no option to deduct PAYE in accordance with IRD rules. Anyway ACC would not have had client tax information to do a retrospective spread at the PAYE level. Only IRD (apart from perhaps the taxpayer or accountant) would have information on previous returns needed to do a retrospective spread.
    As I indicated the Government can always do a SOP on the current tax bill to resolve this issue but presumably the bureaucrats would strenuously this because of the potential fallout, so even if Jacinda wants to be kind here, Robbo would probably talk her out of it.

      I agree, additional information would be needed to make the retrospective calculation I suggested. It would be up to the claimant whether they wanted to provide that. For some it might not be worth it, for others it would.
      
      I suppose I was hoping the idea that it would cost ACC more to get it wrong might inspire greater interest in getting it right.

So the inaugural Air NZ flight to New York was very successful but the return flight was apparently anything but, managing to depart two hours late and leave the baggage of about 50 passengers behind.
Initial reports were that the check-in desk was totally undermanned and the time to check in was ludicrous, to the point where baggage was piled up, left behind, and the plane missed its take-off slot. That makes sense.
Then the sanitised version, after it had been through the Air NZ PR department, was on the news, telling us that the baggage problem was because they had to unload a whole lot of the bags because the plane needed to be lighter to contend with the headwinds.
What absolute tosh. The plane left two hours late because of the inability of the Air NZ ground staff to deal with the local baggage handlers, then it made up an hour during the flight, arriving only one hour late, making a lie of the crap that Air NZ fed us about head winds.

    The concept of ‘flying to’ is a little vague these days. At one time it meant an aircraft boasting an airline’s livery had landing slots at some airport. Not so today as airlines ramp up code-sharing. For example, in March Emirates announced a code-sharing arrangement with Garuda Indonesia, and then 4 days ago Garuda announced it was dropping most international routes. From a customer perspective Garuda still ‘flys’ to Europe, it is simply that Emirates provides the aircraft.

It regularly code shares with other Star Alliance airlines eg if you book to go to Europe with Air NZ, they may put you on a Air NZ flight to LAX, SFO or Vancouver and then a United or Lufthansa code share NZ flight number to Heathrow, Frankfurt, etc. (or similar via Asia).

    I expect AirNZ have done their figuring. As it is I think there’s only 4/wk.
    If it doesn’t work out it’ll quietly disappear.
    
    The first time we flew AirNZ to NY in 1972 we put down at Fiji, Hawaii, LA where a day in a hotel was chucked in including dinner; a combo played a song for us and then on to New York.
    Tickets were a horrendous price compared to pre pandemic. Maybe 2-3mths salary one way.

  At low speeds for small objects air resistance, or fiction, has a linear relationship. At high speeds on large objects air resistance goes up by the square of the speed.
  
  To arrive an hour faster the plane had to use more fuel so fuel was not likely the problem.

    Actually the rise in drag with velocity² is not the problem – as planes just fly higher in lower density air to keep the ‘felt’ pressure of motion the same (‘dynamic pressure’ in engineering terminology). The real problem is transonic drag increase as airflow around aircraft components starts to approach the speed of sound, leading to sharp increases in drag above about 80-85% of speed of sound.

  The route is at the limits of the airplane type. It is 14,215 km. The boiler plate specifications for the plane is a maximum range of 14,010 km.

    Internationally there is about 10% higher trip time travelling west than east owing to dominant westerly winds in stratosphere (a result of Coriolis effects in earth’s atmosphere). You need more fuel (and less baggage) travelling west. The Rocket equation (ie having to carry more fuel to provide extra power to overcome the extra drag caused by carrying additional fuel) is not in your favour either.

  “to contend with the headwinds”. So, before the plane took off, they knew how strong these were likely to be and the effect of that on the safe weight of the aircraft.
  
  Here’s an idea: work backwards, Air NZ. Those headwinds probably fall into a known range. Take a figure that covers, say, 95% of the likely possibilities. Use that to determine your maximum weight. Deduct weight of airplane and fuel. Divide remainder by average weight for a passenger/crew member + baggage + inflight food to get the number of people you can put on the plane.
  
  That way, 95% of the time, you’ll be able to take your calculated number of passengers. 5% of the time you might need to offer a deferred flight, expenses covered, to reduce the weight. And probably more often, the expected winds will be less than calculation figure, so you’ll be in the happy position of being able to take an extra, weight-listed, passenger or two.

    That is likely what they do. Problem was hitting the 5% chance on the first day when there is some extra publicity. First day should have gone out an extra standard deviation and planned a smaller load so the likelihood of unwanted publicity was lower.

        I’m all for paywall, only if it falls outside important updates on govt activities. The 55mil should surely be paying for so called journos to report on what’s happening in govt – both central and local. After all you and I have paid for this being taxpayers. To use PIJF to fund journos to write pieces that are paywalled then expect you to pay for it is what would be referred to as double dipping.

The change of concern is the ‘unascertained natural causes’ of death. They don’t need reporting on, and if they have an inquiry, details are all suppressed (seems… dodgy af, is the government now trying to cover their tracks)

  I would be all in favour of that if the Maori ACC budget came specifically from Maori ACC levies. I would expect Maori ACC levies would probably need to be ten times as large as they currently are. I would also be in favour of Maori only unemployment benefits under the same rules 🙂
  
  Of course we all know that that would never happen and that the non Maori would have to subsidise the Maori system. But I guess that is ok as we have White privilege from our ancestors. That’s especially true for the Asian population, they have ‘off white’ privilege from their ancestors.

Even the sanitised version reflects poorly on Air NZ. The message I got from this passengers risk having their bags left behind if there is a weight problem depending on the particular circumstances of the flight. Therefore passengers on these flights should ensure they have essential items like medications in their hand baggage. The only surefire way round this problem would be to leave some seats empty.
As far as flight times are concerned, things are dependent on weather conditions. While NZ2 flies with the tradewinds, NZ1 flies into the tradewinds (hence the longer flight time allowed in the timetable). Because the winds are variable it could well be that a flight takes potentially less than the timetabled time. Possibly too as the flight proceeds fuel usage may have been lower than anticipated enabling the Captain to increase speed a bit (not sure what policies are on this).
Also the checkin staff are most likely to be contractors – the same people doing checkin for a variety of airlines. Air NZ could not justify having dedicated checkin staff for infrequent flights. Only very regular airport users like United could justify this. The odds are that Air NZ has a single agent donly bases at JFK.

  I would suggest as airlines aren’t allowed to discriminate against fat people (and the plane is flying to fattest nation on earth) that the baggage off loaded is to balance passenger weight
  
  If there is only two main variable metrics that impact fuel consumption (people and baggage) why do airlines only restrict one of them
  
  A 120 kg person is effectively equivalent on me and 3 bags. There is a lot of travellers bigger than that

    In the early days of commercial flights, passengers and bags were weighed in together at checkin for load balance reasons. Then bags only were weighed and it seems this was dispensed with unless staff considered a bag to be overweight, Now Air NZ weighs all bags for loading purposes. Presumably there would be a case to weigh passengers at checkin (using an electronic platform scale as veterinary surgeons or racecourse stewards use), but this would nowadays create an uproar. Airlines assume an average weight for passengers and after a survey increased this a few years ago. Whether airlines use different average weights for different flights goodness knows.
    It is an awkward matter. For example some groups lobby for wider seats with more legroom but young impoverished passengers would object because fares would be higher. Then a regular weight passenger may suffer discomfort from sitting next to an obese passenger potentially causing friction.

        They all arrived at the same time, but the Moriori split off from the rest of NZ Maori culture for a few hundred years, probably while they were still rapidly growing in number to fill the country without much conflict, and so never developed the militarized culture that North Island Maori evolved (the eat or be eaten martial skills race typical of stone age cultures in temperate climes the world over).

Anyone else received an information sheet about the vote on Maori wards in their voting papers? We did and it is just pure propaganda. It says such things as “Maori wards could provide more effective, direct representation for tangata whenua in Council decision making processes as required by law” and such ward reps could “better relate to the needs of Maori communities and provide the Council with a greater understanding of Maori issues and concerns”.

To the best of my knowledge we have more people with Maori blood on the Council than not and this will continue whoever gets in next month. Are they saying they are falling down in these areas.

And the worst thing is the poll is non binding – it will “assist elected members making a decision on Maori wards”. And if Council decides to go ahead , “after taking consideration of the outcome of the poll” there will be a long convoluted process.

I suppose this is Willie Jackson democracy at work

  There’s a lot in that. The media do seem to regard Jacinda as something akin to a Queen. I remember how some columnist commented that Jacinda was supposed to be “above politics”, and look how much coverage she gets for doing royalty-like things such as visiting schools, followed by journalists excitedly asking the children and teachers “so what did she say?”. Meanwhile, they seem to see it as somehow improper to expect her to comment on political matters, just as it is to ask members of the Royal Family.

The arrival of dignitaries at Westminster Abbey was impressive, I thought, particularly Joe Biden having to wait as the VC & GC holders took their places, including Willie Apiata. Then there was UK PMs past and present; also our PM.
I thought those aging royals did well marching quite some distance.

“a verbal conflict of interest was declared”

However, they changed the story to…
“however that statement was corrected late last week with the clarification that no “formal” conflicts, written or verbal, were declared.”

Yet, nothing seems to be done about it? The usual case of seeking forgiveness is easier than seeking permission.

Most of these types of contracts shouldn’t exist in the first instance. The man got given a contract in suicide prevention despite absolutely no qualifications. It is wrong.

So a small acknowledgment in the media re vaccine harms.

“Covid-19 vaccine ruled as cause of heart condition that killed Dunedin plumber Rory Nairn”

That was common knowledge, there are many others either dead or injured from the same cause. The coroner stated she had enough evidence to state the vaccine caused his death. She then states:

However she still needed to consider and establish as part of a “wider inquiry” whether Nairn’s death could have been prevented and if she needed to make any recommendations.

How about recommending not forcing people, particularly young people, to take an experimental procedure against their will, especially when it was widely known that there was far greater risk to young people from the vaccine than from the disease?
Seems like a pretty bloody obvious recommendation.

    Cancer is basically the epigenetic modification of the p53 tumor suppressor gene: the guardian of the genome. I love that: the guardian of the genome. I should actually be called p43.7, I think. I guess p53 is catchier.
    
    The p53 protein not only enforces the stability of the genome by the prevention of genetic alterations in cells but also plays a role in regulating the epigenetic changes that can occur in cells.13
    
    p53 suppresses tumor formation by regulating DNA repair. The impairment of this regulation can lead to cancer through loss of regulation of cell cycle. Its reintroduction into cancer cells, induces cell cycle arrest in the cancer cell. Expression levels, like everything in biology, is very important. Over expression of p53 can result in too much apoptosis (programmed cell death), and under expression can result in cancer.14 Epigenetic factors can affect p53 expression levels.15 16 17 18 19 They can also affect other DNA damage repair elements and their regulation.

  They have some advantages – they effectively allow for streaming in primary schools as kids are sorted into groups based on level of achievement/capability for different core subjects which is positive for optimising rate of improvement. But they are difficult for kids with common neuro atypicalities like ASD and ADHD due to high levels of noise/distraction.

  My daughter was in one at Intermediate and she found it very noisy and distracting. It was essentially 2 classrooms built in 1960’s with the wall between them removed and two teachers with about 70 children.

  We have one boy who is fine in them, but had to change schools for the other one. It just didn’t work for him. He’s a smart kid (I know, all parents say that!) but he couldn’t handle the noise and distractions. He went through several terms with little to no output and teachers trying different initiatives, all to no avail. At a new school now with singular, smaller classrooms and he is again thriving.

Perhaps National need to remind the media and Labour that people can be rehabilitated and go on to lead successful lives and be persuaded to leave Uffindel alone ? as an example, Gannin Ormsby has been so successfully rehabilitated that he is now able to hold down a full government time job and several government contracts at the same time after being convicted of assault on a female in 2003. Maybe his conviction has actually been an advantage in getting that role. He has truly turned his life around.

No condemnations then from the left and the dildo thrower was treated as a “hero” by the left.
  
  Now we read that Grant Robertson is wanting DPS protection – since when has a Deputy required that? Unless Robbo is prepping himself to take over from Ardern when she steps down?
