PM ‘all over the place’ on Three Waters entrenchment controversy – Lynch
Oh crap, it’s only Jenna Lynch

Anyway yesterday on Kiwiblog under “The irony is that Labour and Greens are the ones actually privatising water” there was –

So what you have is a real confidence trick. A Government that is de facto privatising Three Waters assets, while passing a law saying privatisation is wrong.

So kiwiblog host David Farrar wrote – “… what you have is a real confidence trick” – but I, respectfully, submit that the confidence trick is much deeper – but from a higher level…

Nanaia Mahuta’s younger sister Pipa Mahuta has been appointed Chair of the Maori Advisory Council to preside over the Water Regulator, Taumata Arowai – https://www.taumataarowai.govt.nz – (no English name for obvious reasons) which will, with the right to write Mana o te Wai statements – preside over the “3 Waters” Four Regional Entities, where the 50 / 50 argument lies – with people outraged by this “co-governance” at this lower level, missing the “total governance” Pipa Mahuta and Co have from on high, at the top of the stack.
That is not some sort of 50 / 50 privatisation, but complete privatisation, once it all gets going …

So, some one tell me I am wrong
Please do, because I have raved on about this several times, and I am getting too old to waste life left on this type of shit if it is not worth it. So –
[1] Have I misunderstood the timing of this – care not to interfere with the enemy from completing a mess so you can take advantage at the right moment – Napoleon Bonaparte
[2] Yvette has got it all wrong
[3] She is to blame – for anything you feel like
(See how I have moved from “I” to “Yvette” to “she” to thrust the blame as far from the cot as I can)

So is it “co-governance” or “total governance”?

  You are completely correct Yvette. The Te Mana O Te Wai directives can only be issued by Maori and are unbounded. This is 100 percent iwi control of all water in New Zealand including every farm pond and all coastal waters. Mahuta has inserted her sister into a key role to police the takeover. This is truly sub-Saharan stuff. New Zealand public life under Labour has become utterly corrupt.

  Here’s a scenario that I haven’t heard being discussed: Nats and ACT win in 2023 and instead of dismantling 3 Waters and returning assets to local councils, they keep the bureaucracy in place, change the language of the legislation, show the indigenous “elites” the door and staff the governing bodies with their cronies. Taxpayers and ratepayers are still royally screwed and extorted, but the money flows into different pockets.

I thought that a reoccurring trope on this blog (and others) was that National campaign on repealing labour legislation and when they get voted into power, they comprehensively fail to repeal the labour policies they campaigned on.       We witnessed a store theft couple of years back while we were driving by. Owner came rushing out chasing the crim, we picked up the owner, called 111 while following the crim… they weren’t interested, said to file an insurance claim.

    I witnessed a brazen thief steal a full cart load of groceries from the supermarket the other night, nobody could do anything to stop her ramming the cart outside in case they would be charged with assault. The thief wrangled the shopping trolley out the door, and up to the main road, where her friend immediately drove up and helped her load them all into the boot, and when they started tumbling out of the boot she started loading them into the back seat. 15 minutes I filmed and watched her get away with her crime. The supermarket called the police but even they knew they wouldn’t turn up. They apparently have 3-4 incidents like this per day. The police obviously have better things to to under Labour.

    There have been 5 ram raids in the last 4 months within 100 metres of where my son lives (far from the crappiest part of town). 4 hits on the same dairy and one on a restaurant.

Does anyone else out there get the feeling we’re being manipulated with a smokescreen over 3W?

If you believe the hoo-haa in the media then the big controversy is over the entrenchment clause. Who proposed it? Who made the “mistake”? Who is to “blame”? What did Cindy know?

But is that really the big issue?

Surely the bigger issues are:
* It’s no longer 3W, but now 5W and once they get their foot in the door 7 or 8W.
* Why the hell is there even 3W in the first place?

I think this business over the entrenchment is a very clever way of creating a strawman issue. Make it appear that all the controversy is over the entrenchment, then once the entrenchment clause is taken out everyone is happy that 5W is now acceptable and goes through.

National can claim a win but the real damage has been done. National will have got rid of the entrenchment hurdle, but will not remove 3W.

No people. It does not matter what colour the paint is on the tanks they are driving through our democracy. It doesn’t matter if the tanks are diesel or EV. What matters are the tanks themselves.

Don’t settle for a cleaned-up 3/5W.

The latest stuff article is beyond ridiculous. “Make no mistake, Labour knew it was passing controversial Three Waters entrenchment clause”… and Cindy was there! But, nobody is to blame, it was a group mistake and a team lie. Happens to everybody.

Sorry Thomas Manch – that defies any rational logic.

  Labour caucus knew exactly what they were doing and under the privacy protection of caucus they will not disclose who was ultimately responsible. But my money is on the biggest voices in the Māori caucus. This is plainly deceitful. Mistake my ass – the only mistake is they got caught out.

  The real issue is the co-governance aspect, and in particular the, Te Mana o te Wai statements.
  I agree the entrenchment saga is a smoke screen to the issues mentioned above, and still no MSM seem to have the fortitude to tackle it.
  The irony is, through the introduction of the co-governance model, coupled with the Te Mana o te Wai statements, effective control (ownership) is ceded to Maori, so effectively privatized.
  Come on National, start questioning this publicly and stop giving Peters the room.

  I would be surprised if it stops there. Modern cars – particularly EVs – are knee deep in software and they are increasing looking at subscription services where you license various options and get to pay a monthly/annual license for various features.
  
  This marketing model is beneficial in that it creates a continuous revenue stream. It is also potentially beneficial to consumers because it allows the purchase price to be reduced.
  
  As governments get more pressured for assets to sell off, it is quite possible that lanes could be sold too.
  
  Want to drive faster than 120kph? That’s going to cost you $100 a month.
  Want that extra traction feature that helps in the snow? $50 per month.
  Want to use the special Tesla lane? $200/month or $1/10km pay as you go.
  
  It is really easy to see them linking these back to social credits etc. Not enough social credit? You’re limited to 2 charges a month and a maximum of 80kph.
  
  All these things are possible for cars, but they are already possible for all purchases etc.

  On 30 July 1979 this sort of thing ( combating a localised shortage of the source energy propellant) was called Carless days in NZ. Don’t think anythings changed much in 40 odd years. Didn’t work then, won’t work now!

WW2 was fought to reduce government over reach and WW3 will be no different. In a globalized and connected world these despots will have nowhere to run.   There have been some excellent list-only MPs. Steven Joyce for one.
  
  If anything, I would maybe flip that around. Only List MPs can become Ministers. That way, the electoral MPs get to focus on representing their electorates (as they should) and the List MPs get to take other roles.
  
  But the best is no restrictions. I’d rather not put up impediments to getting the best person into the job.

  I don’t think it is practical or even desirable. In some governments there would not be enough competent electoral seat MPs to make up a cabinet.
  
  In the last national government Bill English was a list MP. In the current government, David Clark is an electorate MP. So is Poto Williams. See the problem?
  
  The problem lies with MMP itself. I would like to see some form of ‘primary election’ where voters get to decide the make up of the Party lists.

    MMP is a Party List proportional representation electoral system. The parties decide who will be on their lists, and in what order.
    
    If you want “some form of ‘primary election’ where voters get to decide the make up of the Party lists”, then you want STV in multimember electorates.
    
    Under STV, the parties would put up a couple more candidates than they hope to elect, and the voters would decide, collectively, which candidates will be elected. A primary election and a general election, all in one!

      I think there is a lot to be said for letting voters choose all the people who get into Parliament and requiring all those people to put themselves personally before an electorate.
      
      Some form of preference voting would put all the power in the hands of voters, and the responsibility for making the compromises they want (if I can’t have my first choice candidate, who is my second?). Many people will have a centre-left or right first preference, it would be interesting to know if their second choice would be someone further left or right, or the other side of the centre.

        That would write off pretty much all the Green MPs and pretty much all the ACT ones. Go back to the good ole FPP days when – at their peak – Social Credit gave 20% a fright as their vote share and got – at their peak – 2 MPs. Then there was 1984 where Bob Jones’s NZ Party got north of 10% and zero MPs.
        
        40% of the popular vote delivered 60% of the parliamentary seats. Why not bring back the country quota while we are at it?
        
        If that’s what you want, it’s a free country.
        
        Personally I prefer a situation where pretty much every vote counts ….

        A Party’s List MP’s should be compiled AFTER the General Election, whereby the party’s unsucessfull electorate candidates are ranked according to the number of votes they personally received for the electorate they stood in, but failed to win.
        
        That way, even list MP’s can demonstrate some personal voter mandate to be in Parliament.

        Not necessarily so, Ian. It depends on the form of STV adopted. I advocate for parliament to be elected by STV in large, multimember electorates. Voters would give preferences for the individual candidates and, if they so which, for one or more of the parties.
        
        The Party rankings would be used to fill out the voters’ candidate-preference rankings, ignoring candidates that have already been ranked higher. In this way, voters could express their individual preferences while still giving a complete preference order when the number of desired rankings is large.
        
        Under my system, about 93% of all votes cast, nationally, would contribute to the election of at least one candidate. It would ensure that the voters decide who is elected, not the parties, and that the best candidates of each party, in the collective opinion of the voters, are elected (including ACT and Green candidates).

  One of the biggest problems in contemporary politics is that the personal qualities required to get elected in a popular vote (1, see below) – are quite different from, and often completely incompatible with, the qualities required to be a competent minister (2, see below).
  
  1) smile, wave, play with children, have a pretty young family, tell people what they want to hear, keep the media entertained with shiny new baubles every day, etc
  
  2) face up to hard cold reality, take difficult decisions, implement necessary but painful policies and keep grinding away at them, admit when something’s not working and be willing to change accordingly, etc
  
  So that’s actually a major upside of MMP – it enables parties to get into Parliament, people who are capable of actually doing the job.

The independent report to MBIE two years ago clearly stated the risk to NZ of solely relying on imports and even had a scenario about out of specification or contaminated fuel

The latest shipment of aviation fuel has turned up contaminated and we are now looking at airlines being rationed fuel leading up to Xmas eg massive flight cancellations

    Probably. However subsidies can be justified if there is a public ‘externality’ that will not be delivered by a market. What would have been the subsidy required? We will never know. Meanwhile, this government wastes billions on ‘stuff’ and subsidised goods that should not be subsidised, like EVs.
    
    IIRC the Government was simply silent when told the refinery would close. Because oil is bad.

How quickly the worm has turned. Please excuse the length of this extract, but it is necessary to cover off the involvement of a number of key players in the Three Waters entrenchment fiasco. Thomas Manch from Stuff reports:

A mistake has been made, but it’s nobody’s fault. Labour’s various non-explanations for how it voted through a constitutionally “dangerous” Three Waters clause simply don’t wash.

On Tuesday, the party finally resolved a shambles of its own making: voting through a clause into a Three Waters bill to “entrench” public ownership of water assets, by mandating any future law change could only occur with a 60% majority in Parliament, or public referendum.

For two weeks, Labour has slowly walked back the errant supermajority provision after it was spotted by constitutional law experts, acknowledging on Sunday that it made a “mistake”.

Supermajority requirements have previously only been set at 75% of Parliament and only for constitutional matters such as the voting age, sparking alarm that a new, constitutionally-changing precedent was being set.

But who made the mistake? The answer remains as murky as the dirty, discoloured water that periodically emerges from taps around the country (an actual problem Three Waters reforms are supposed to remedy).

“We’re looking to fix this issue this week. Upon further advice, it’s a mistake that we collectively own,” Local Government Minister Nanaia Mahuta said on Tuesday morning, echoing party leader Prime Minister Jacinda Ardern.

Exploiting the “confidentiality” of party caucus discussions, Ardern has set the tone by refusing to detail how the mistake occurred, leaving only questions and no-one taking the blame.

Did Labour MPs knowingly override the advice of their own attorney-general? Did Mahuta properly brief her colleagues? Did they simply screw up as they rushed to pass law under urgency?

Ardern has said she did not know about the vote on the clause until after it occurred, despite being in a caucus meeting where it as discussed.

Mahuta, in her first public appearance since the saga began, kept returning to the fact it was a Green Party supplementary order paper that proposed the “novel” entrenchment, as if fault lay there.

Never mind that she had discussed it with the Greens, discussed it with Labour’s caucus “broadly”, spoke in seeming support of it on the night, and Labour voted it through.

Labour’s leader of the House, Chris Hipkins, said nothing more than “sometimes mistakes happen” and he was not aware a 60% supermajority threshold was even being voted on.

Attorney-General David Parker has emerged as a dissenting Labour voice, indicating he advised against an entrenchment clause and he was not alone within Labour in doing so.

“I have been consistent throughout this … entrenchments should be not used in pursuit of policy propositions,” he said.

He said he “wasn’t aware of the detail of the supplementary order paper vote until it occurred”. But he also suggested a question about whether MPs were not properly briefed had “the wrong end of the stick”.

But most remarkable is that it has been published in Stuff, cheerleaders-in-chief for the Ardern government.

The Prime Minister was on the defensive yesterday as both Christopher Luxon and David Seymour grilled her over the entrenchment clustershambles. Her government is in chaos, cracks are appearing, and the PM’s mood will not be helped by two public polls which show that between 20 and 30 of her MP’s will be unemployed come the General Election next year.

      The government didn’t own the Marsden Point Refinery. It wasn’t their’s to close.
      The facilities up were built by the government in the 60s, expanded under Think Big and privatized by the Lange Government.
      It is now owned by the New Zealand Refining Company Limited which is a consortium of a number of fuel companies.
      They decided it was more economical to close it so they did. (Simplified version)

        In April, New Zealand Refining Company changed its name to Channel Infrastructure NZ.
        
        The main shareholders are Mobil Petroleum of Delaware, Ampol’s Z Energy, and BP NZ.
        
        Crude oil imports ended when the Marsden Point refinery closed in April.
        
        We are now dependent on refined oil products (such as petrol, diesel, aviation fuel) from Singapore, South Korea, and Malaysia.

Once expensive race-based or merely stupid unnecessary legislation is rushed through this term,what’s the chance a National led government will announce goneburger but first a review of costs of continuing or chopping. Followed by a business decision based on costs v benefits. Quite possible crazy high cost to chop short term, but leases and contracts expire as well as be cancelled.

Meantime new Ministers can adjust outcomes, performance management and some funding. Maybe a lot of each.

I see that the world media has started to report on the case of the parents wanting to use blood from donors who have not had the experimental mRNA gene therapy which has been touted as a vaccine (but to quote Dr Bones from Star Trek, “but not as we know it Jim”).

I am watching to see the decision from the Court, as an indicator as to whether the Court / Justice system is complicit in the hegemony of governments over science, media, and involvement in our everyday life.

We have a family who have made a personal choice that may, in their view, affect the life of their child. We all make such decision, which school, which doctor, which system of morals and ethics / religion to bring them up in, etc. These are the rights we have in a free, democratic society. Of course not every one will agree with everyone else, but that is the very basis of diversity. (Diversity is not just about your preferred gender)

But these days we see a very topsy turvy world, where a request, very reasonable IMHO, and facilitated for the health professionals with many donors coming forward. But it appears that for the health professionals there is a danger, as in accepting the request, they may see it as having to accept a view on vaccination that is different to their mandated policy … ie the mRNA vaccines are safe.

The published research is now starting to show otherwise, and the political gerrymandering of the likes of Gates, Fauci, EcoAlliance, and of course the Chinese Lab, is slowly coming to light. But there is a delayed effect in the “chain of command” coming down the line, and so the NZ Blood Service hierarchy are having to defend the indefensible, well certainly in the light of true science, and rational thinking.

Meanwhile the justice system in sending to prison for Christmas someone who has a beef with their local council over a paperwork matter – no danger to anyone else, yet we see a 4 x rapist sentenced to home detention, and many more such decisions.

This sadly indicates to me that the justice system is not immune from the very real “virus” that has infected our government, and entities it controls. So I am not holding my breath. If the decision goes against the parents, I suspect this will give further cause for an uprising we have not seen the likes of.

    Not saying these parents belong to those groups but I did hear the father on the news last night quote/ paraphrase a scripture from the bible.

      The parents are neither anti blood transfusion or anti vaccines. They want the blood transfusion, but they want it from a source they trust. Not from a source with the potential for their child to receive blood that may have negative side effects.
      We were lied to and gaslit regarding the vaccines being “safe and effective”. It is absolutely without doubt now that they were neither. Why would anyone then trust the same medical “experts” when they tell you that this blood is “safe”?

  It is an absolute appalling and disgraceful act by the health professionals involved. The parents are NOT refusing medical treatment for the child, in fact, they are doing everything they can to make sure the best treatment possible is given. It is the government lackies who are dragging the chain for only one reason, it challenges their authority and it is a precedent for others who no longer trust the system.
  You reap what you sow, and if by any chance this judge fails make the right moral decision in this manner, let the parents supply the blood that will help their child, then all that will be achieved is an even greater loss in trust in our authorities and even greater societal break up and division.

  The Parents request is quite reasonable. They have 20+ unvaxed people who would give blood, but the stupid rule is you can not choose your donor.
  So if all of those people give blood and the Doctor just grabs one lot, then nobody will know who the donor is.

        In an August 26 judgment by Judge Quentin Hix, it was noted Rayner was summoned to court on May 27 on charges of selling non-complying food and failing to comply with the notice.
        
        Rayner didn’t show up. Police arrested her, and later that day she appeared in court where she claimed innocence on all matters.
        
        Judge Hix noted she initially refused to sign a bail bond, but eventually did and was released.
        
        On July 15 there was a case review, which she also did not attend. A date was set in August to go over the evidence. On that day, Judge Hix sent someone to find Rayner in person to make sure she knew her rights to engage with the court process. Rayner confirmed she did not want to participate.
        
        “That is unfortunate,” noted Judge Hix, who had overseen her earlier trial regarding the QR code.
        
        Instead of issuing another arrest warrant to force her participation, court proceeded in her absence and the judge found her guilty of the charges.
        
        From there, a sentencing hearing was scheduled for December 1. Rayner failed to show, resulting in another arrest. On December 2 she was sentenced to two months in prison.

        When we had our Cafe the Chinese restaurant next to us would cut up the meat out the back of their shop on the concrete. Also knew of one Chinese place in Auckland that when their drain blocked up the plumber found it full of cat carcuses. I’ve seen places where the walk in chiller is broken, but they keep using it. Even been into a place I walked straight out of after seeing raw meat above cooked food dripping down into the cooked food in the chiller.

Ruapehu Alpine Lifts (RAL) will receive $6 million from the Government “to support the development of an alternative commercial solution” for the embattled skifield operator, it’s been announced.

“We will provide $6m to enable alternative solutions to be developed and provide sufficient working capital to retain the RAL management team while a potential resolution continues to be negotiated. This is in addition to the $2 million already extended to RAL from the Crown.”

The bill lists among the function of the two State media organisations: broadcasting of content that is in, or uses, Maori language; promotes tikanga Maori, and “reflects Maori history, experiences, and perspectives to a wide audience”; enables iwi, hapu, and Maori entities to have access to content by and about themselves – and ensures that content is preserved.

The duties of the Aotearoa NZ Public Media board are to include “ensuring Maori perspectives are reflected in the development and delivery of content and services for and about Maori, including by providing opportunities for Maori participation.”

The voting tabulators were tampered with I think. Stuart alleges at 11:30 AM a technician showed up to check the machines
Only then did tabulators start to experience issues
Between 11:30-12 PM: 10% of ballots were failing
Between Noon-12:30 PM: 20% of ballots were failing
Between 12:30-1:00: 4 of 7 ballots were failing.
The technician should be in the Sheriff’s Office.
Democrat Katie Hobbs is the Secretary of State. As such she is the person in control of the voting process and setup. She was asked to recuse (let someone else do the job) She refused. The whole thing was Democrats cheating again. It is not over yet.

I was just informed that my attempt to have a discussion about COVID policies with Michael Laws on The Platform was denied. The message I received read as follows, “He isn’t interested in having his views tested by yours.”
    
    So effectively, I’ve been “de-platformed” by The Platform which bills itself as “New Zealand’s only independent media site giving you unbiased coverage, commentary, and opinion and the chance to have your say.” Wow.
    
    Wow indeed. Simple answer, because they know they can’t get away with their childish tactics with someone more experienced and knowledgeable on the subject of all things covid.
    This refusal to engage in serious conversation is going to cause serious problems for many years to come.

    I have personally seen it. Guy with a whole lot of meat packs actually stuffed into his pants and arms leaving the store, and a female employee trying to claim them back, and he was mouthing off exactly that.
    From another person who works at Kmart, this is all the bloody time now. They know it, and they tell the staff “You cant touch us”. Which is technically true in the legal sense, unless the shoplifters are violent towards the staff
    
    On the scale of the Youtube examples, there is this, literally trolleys filled up and walking out the door and then violent to staff when challenged.

    I didn’t intervene in the case of the guy stealing the meat, and spoke with the lady afterwards (who had injured her finger trying to grab the meat back) but I did step in more recently when I saw a staff member at the same supermarket having a skateboard swung at his head by a shoplifter who was making all sorts of threats.
    As I approached the shoplifter he turned to mouth off at me, but I threw 2 punches- one a cross as a feint and then a hook to his body. A combination I have practiced on a heavy bag a lot. The guy fell arse over heels backing up. He got up and started talking big, so I flicked off my jandals in anticipation of employing some kicks. At the sight of this he turned about and left without a backwards glance. And the staff member ended up laughing at the guy as he limped off the premises. I expect he will have been grazed and perhaps even a popped rib. Staff member thanked me.
    
    Must have been a delight for them to see a shoplifter getting actual immediate consequences.
    I should point out the supermarket is not far from the emergency social housing motels in Hamilton, and I doubt this has helped with the general class of people nearby.

      My understanding from long-ago study of law at high school is that you “may use that force which is reasonably necessary to stop the commission of a crime” Which I would interpret as making it fine to physically restrain a thief, and even give them a gentle corrective smack or two to subdue them if they threaten you or won’t wait for the police.
      
      Am I wrong in this supposition? If I am wrong then seems to me this would be a sensible change to enable. Let the community step in where the police are absent.

I had reason to see my doctor today.
He was fired/ had to resign, because he refused to be vaccinated.
He runs the reversal NZ clinic out of Taupo assisting many individuals to reverse their type 2 diabetes with enormous success, but sees regular patients like me for a fee naturally.
I asked him if he was seeing many changes in patients since the vaccinations and he answered with a resounding yes.
Heart issues being the biggest. He just can’t believe how this is being intentionally kept quiet.
I posted some months back about a young man I know here who had a heart attack after his second jab and was interested to know if the good doctor had seen more vaccine injured. It appears so, very very sadly.

This is so wrong in my view:

The drivers voluntarily and willingly agreed to terms and signed contractor agreements but now wish to rewrite history and to which the courts have agreed.

And now the unions crow as this is some sort of victory. It’s not. It just fucks the business model which has brought so much and so many benefits to NZers and who, as Uber consumers, will no doubt have to pay through increased charges.

Unless it can be shown that these drivers had guns held to their heads when signing their agreements I cannot understand why the court didn’t instantly dismiss this claim by enforcing these contractual agreements, again willingly made.

And I see now ‘hundreds’ of Uber drivers have joined the union since the court judgement. Chasing the pot of gold that they willingly and voluntarily chose not to accept initially in return for the benefits of Uber driverhood.

Sometimes I wish that the Ubers and Olas would just pack up and leave NZ saying that we’ve made it too hard and too expensive to operate in NZ – so that we can see the real cost of this duplicitous behaviour from the drivers and the unions.

  I’d just add further, imagine if the situation was reversed.
  
  That a large employer who had employees and for many years, went to court to get a ruling that they were in fact contractors and when the court found in their favour the employer then sought to claw back from the employees millions of dollars of ‘overpayments’.
  
  The unions and lefty politicians would be in an uproar and screeching and tearing at their clothes over the issue.
  
  The employer would be labelled all sorts of slurs and insults, would be getting death threats and vast swathes of the news media and our academia would be screaming blue murder – and all saying the employment contracts should remain valid and in force.
  
  I bet my house on it.
  
  Hypocrisy in New Zealand is just out of control on the left.
  
  As a nation we’ve lost our adherence to principles it seems.

  Here’s how these things usually work (such applications are rare but not uncommon, usually with parents who are Jehovah’s Witnesses)
  The parents have a belief that transfusions are wrong. However they also do not want their baby to die. The health provider therefore steps in and applies to the Court for an order such as that granted here. The order is granted, the parents can say to themselves that the transfusion is taking place against their wishes, the child survives and everyone is happy. Usually, the case is not as public. But the principles are the same. Let’s hope it happens that way here.
