Treaty – Maori to English translations and “co-governance”

■ The term used in the te reo Māori [Treaty]version, ‘kawanatanga’, was a transliteration of the word ‘governance’, which was then in current use. Māori understanding of this word came from familiar use in the New Testament of the Bible (when referring to the likes of Pontius Pilate – and, although having not yet seen BEN HUR, they understood Pilate’s relationship to the Romans and Jews –), and from their knowledge of the role of the Governor of New South Wales, whom they referred to as ‘Kawana’.

  The second version of the Treaty came along after the forming of the Waitangi Tribunal in 1975, I think. They changed a few words and now the radicals cling to that.
  If Maori are to gain respect, the original version must be used and the Tribunal one destroyed.

    Steve, I may not have been very clear, but my point was the last thing said above – that bearing in mind the screw up the Treaty is, after near two centuries it seems Government (the Crow) CANNOT NOW DEFINE “CO-GOVERNANCE”.
    With all the communication skills and consultants and existing law and modern knowledge w,hy can they not plainly tell the voters what the deal is?

      I don’t think the people doing the talking know what the deal is.
      IMO, the only people who know what the deal is, is the Maori Caucus and they change their minds to suit each invented situation that manifests itself eg MAORI OWN WATER.
      Why didn’t Mahuta pursue this line from the start? She knew there would be no deal if she did.
      Then, came along John Tamahere and exposed their game tactics.
      Game over PM, scrap all legislation, return stolen assets, and sack Mahuta.

  There was an excellent interview last night with Heather du Plessis-Allan and Dr Elizabeth Rata including how the Treaty (and partnership etc) is being re-interpreted by the modern day radical Left to mean something nowadays that was never intended.

        The choice we have at the moment is between two political conveyor belts feeding a stun room.
        The only point of difference, at the moment, is the speed of travel.
        So why vote for the fast one or criticise the benefits of the slow one.

        Krazy. I agree with you that we need wholesale change to get NZ on a path similar to Sweden, Taiwan, Netherlands, etc. where productivity and investment in key industries create wealth.
        
        That path will require pain but that pain need not come in the form of societal collapse if it is planned and executed well.

        My assumption with justification is… Luxon has given up huge money to be a politician, Unlike all other NZ politicians, Luxon was promoted into a position to lead change in large organizations by people who are focused on and rewarded for success so… we don’t have to contend the corruption of Labour Ministers setting themselves up for retirement, we can be confident that Nationals policies will be implemented, co-governance and Maori bias in social services will end, and that a very successful businessman who repeatedly stated he came to politics to help NZers will enact policies which produce wealth.

  Sure, they’re up against it, but only because when in govt they’ve not only failed to fix things but worse enabled these left wing advantages themselves.
  
  NZ is in deep excrement and National are over time as much to blame for this condition as Labour. Many people resent them for this betrayal.

    I agree 100%
    The key issues are TOW and democracy/apartheid. If we continue with the race based models it will not be possible to fix the economy, education and health problems we have. Scarce financial resources will be syphoned off in brownmail. Government departments will waste far too much time trying to teach themselves and the public a few words of Maori rather than fixing potholes or performing surgeries. our kids will be taught to speak Maori and indoctrinated in critical race theory instead of getting a proper education.
    
    It is simply not good enough for National to try to reach a compromise with Maori radicals such as Tamihere, Jackson, Morgan and the Mahuta clan. This debate needs to be had, and won. We need to move forward as a democracy based on equal rights for all citizens regardless of whether or not you can trace an ancestor back to a Maori tribe.

    Failed to fix things, you have a perverse way of looking at things. Remember 2008 when National assumed office, the cupboard was bare. When Peters selected PriNZess, the government was in surplus despite coming out the GFC, Chch and Kaikoura.
    
    Things may have not have been to your liking, but was there the division? Was there the incompetence? The crime NZ is experiencing now? No!
    
    Some of the keyboard warriors on here need to think, do you want more of what we’ve seen over the previous 5.5 years, or would you rather a National/Act govt (whatever you perceive their faults to be) who might begin to fix many of the real issues this country now faces.
    
    Being pedantic over whether you like Luxon or not, whether you perceive National has been right wing enough in the past for your liking, will only serve another term of Labour and the Greens. Is that what you really want?
    
    As Debsta, posted above, it is time for those of us who support the centre/rightto get real about what we want in October. Because with your approach, and that of others on here, you may choose to refrain from voting for National/Act because neither party is not “pure” right enough for your thinking. But don’t bitch on here if we get a Labour/Green/Maori combine post October!

      First, lets drop the silly pretense that National under the Luxon regime are “center right”. They’re center left, like Labour. In fact on any full political spectrum, meaning one that truly did venture as far to the right as small govt and low taxes, they would be seen as far left.
      
      Skipping over that, we have one glaring example of typically gross incompetence by the Nats that should have seen Ms Willis expelled from the party. That is her ardent support for Labour’s bill to allow intensified housing to be built on sections that once accommodated only a single house.
      
      This policy has so many downsides but they were all apparently invisible to Ms Willis who in a sickening display of political unawareness (giving her the benefit of the doubt) couldn’t wait to run to Labour’s assistance in passing this monstrous piece of legislation.
      
      Its a policy that has its roots in the Obama administration’s long term plan to change voting demographics in the US, so that leafy suburbs voting Republican were converted into high density multi-national suburbs voting Democrat.
      
      Willis went for this, thereby helping cripple National’s election chances further down the road. Then we have Debbsta whining on here that the Nats are “up against it”.
      
      They’re up against it because they allow shallow blind leftists like Ms Willis to not only join the party but become its deputy leader! And then join Labour in pushing through bills like the housing density bill.
      
      FGS, the Nats did it to themselves, and they’ve been doing to themselves for decades, and now with Luxon et al in charge, they’re doing it at the speed of light.
      
      Every policy they’ve announced so far has been weak frittering around the edges and characterised by a determined refusal to deal with the real deep seated problems in NZ. Education for a stark example.
      
      Don’t ask me to vote for the bunch of left wing fools who are currently impersonating Sid Holland’s party. I’m done with that. I’m backing Democracy NZ. No matter the cost, at least I won’t feel nauseous with hypocrisy when I cast my vote.

        Indeed. National has no right to expect anyone’s vote just because they may have done so in the past. They don’t even have a right to be a major party. Clearly, some will vote National no matter what, but that’s not a very rational approach. If change is needed, then changes may need to be made, both in the case of the voter and anyone they may vote for. I’ll vote for nobody if nobody appeals to me.

  Meh. I’m electorate vote National and Party vote ACT this year – but the stench of them is bad.
  
  Besides that, people here at KB have been acknowledging for years the simple fact that KB is a place for political tragic’s to debate while not having much influence among the general public, who still switch on One News at 6pm every night.
  
  So, enough with this crap about how we have to stop criticising National/ACT because it might cost them the election. That’s bullshit, and it’s important for those who do pay attention to politics to stay on their backs to do the right thing when they get into government.
  
  And my hopes on that last are not high. I saw someone saying that tax cuts won’t be happening and they’re right – but that’s just one aspect if all National do is some incremental, tinkering crap in the next six or nine years. Then Labour will just fuck us again starting in 2029 or 2032. You’ll then be looking down the barrel of endless tax increases.

      It can be done. It needs courage, principle, and political acumen. That’s why Luxon et al can’t do it here in NZ. They lack all three.

      1. It’s not impossible to win the right vs left debate from opposition.
      2. National haven’t really EVER tried to win this debate from government either. The raison d’etre for National to exist has always been “to keep Labour out”. For most Nat MPs, that is the limit of their ambition. There have been rare exceptions, such as Maurice Williamson. But overall, they are content to hold the line for a few years and tinker around the edges. This is why we are in the crisis we are in today – where our democracy itself is under threat to say nothing of the parlous state of our economy and institutions.

There will be many eyes on Dr Canaday’s disciplinary hearing Dr Canaday before the Health Practitioners Disciplinary Tribunal. The charges appear to be of two types – misinformation and discrediting the medical profession.

The Tribunal’s witness, associate professor Dr Mark Thomas, an infectious diseases physician, said his expert statement had kept to published facts rather than “Trump-influenced lies and fantasy”. And that he believed the information provided by the country’s various medical bodies on the vaccine has been “as close to the truth as could be achieved…”

There looks like an opportunity here for some cross examination of the “published facts… close to the truth”. Maybe the hearing will reveal some actual statements of alleged misinformation from Dr Canaday allowing some counter evidence. I expect there will be cherry picking involved.

  @Chuck… In NZ we have the no fault ACC scheme. I gather very few people have made it over the claim accepted hurdle.
  It will turn into a runaround chase for those with adverse reactions. Blaming long covid is one of the red herrings.

    I have dealt with ACC before. Very hard to deal with. I fought them for 7 years. They do NOT give a shit about your health other than getting you off their books. The method is, while you are in pain and medicated, they will deliberately obfuscate(?) or delay all sorts so as to wear you down. You need to be mentally strong and get legal help.
    ACC will try and get you to throw it all up in the air and walk away. It is a tool!
    Anyone in this situation should never give up.

    Nickc2 – I’ve posted this further down the page, but just in case you miss it, have a read. It’s shows the “vaccine” approval process was extremely dodgy in both Australia and NZ. That’s being very polite.

    Sooner or later some kid would be sent off to get the cane by someone. He’d come back and show us the welts on his bum.
    Didn’t buy any respect for the teacher and soon enough another kid would get sent off to be caned.

    This would go on all year. It was always the same small group of kids that were thrashed.
    Didn’t happen with the good teachers.

  In the past we have seen Labour dish dirt on the Greens as a way to move the left leaning vote back to Labour from the Greens. With the current state of Labour I wonder if some of the recent ‘leaks’ and stories around the Greens a stirred by labour and their friendly media. Labour need every seat they can get, they are going to loose a lot of MPs.

  We already have one of the highest OCRs in the world (5.25% vs 3.6% in AU) and yet one of the highest levels of inflation. In the US inflation is already trending down at around 6%.
  
  Food prices growing 12% in the last year
  
  With all this going on we have a finance member who seems to have joined Kelvin Davis in witless protection and a govt still keen on borrowing and spending as much as possible. The NZ public just sits back and thinks ‘Luxon’ / ‘Seymour’ bad. We know that Labour have been total failures, surely its worth the ‘risk’ of giving someone else a go. The racist division in NZ took a giant leap with the McNulty statement. ACT wants a referendum to clear the air once and for all. National wants to pussyfoot around the issue as usual. Time to step up to the plate, Nats. NZ needs a root and branch clean out. No more Avis and that means NO more. All reference to special this and that must go. This disease has even affected my retirement village, Arvida, which states that its care facilities will have special benefits for Maoris denied every other race. All of that has got to stop.

    Why have a referendum on the name when opinion polls are overwhelming that New Zealand is the name?

Watching 3 News last night, they had footage of the Rail Protesters in Wellington going onto the motorway to START their protest.

Which begs the question, did 3 News know the protest was going to happen? And if so, why did they not warn the authorities that a crime was about to be committed?

I’ve just been reading The New Zealand Herald. It seems the knives are out and glinting in the sunlight for Dr Elizabeth Kerekere.
They’ve reprinted a Radio New Zealand story that several Green Party staffers have spilled on the MP’s very bad behaviour and bad manners, and not just towards Chloe Swarbrick.
Not that I am concerned. I loathe the Greens for their sanctimony, hypocrisy, self-righteousness, and their virtue-signalling.
But it’s nice to see even Greens finally getting sick of a Maori who accuses them of racism when they disagree with her.
I imagine that in the reranking Dr Kerekere might find herself ranked below even Celia Wade-Brown.

Also in the Herald they alsmost wet themselves over the French patrol frigate Vendémiaire . Why was she lurking in the waters of Nouvelle Zelande? Zut Alors!
And she had a Big Gun.
If they had bothered to look across the Waitemata Harbour to Base Devonport they would – should – have known she’d been undergoing maintenance there for probably a couple of months.
I knew she was there because I’d seen her there.
From my limited experience a ship that has been on the slips for maintenance usually goes out and tests everything to make sure the gear works.
Vendémiaire is an old ship – she’s nearly 30. She patrols vast areas of the Pacific from New Caledonia.
She is a regular visitor to New Zealand, often in Wellington, where I chatted with a petty officer. ‘It is a nice posting,’ he said. ‘Three years. Then I go back to a submarine.’
The Herald seemed excited that she carried a 100mm gun in an ‘artillery turret’. And two 20mm cannon that fired eight-shot bursts.
A 100mm – 3.9-in – gun is not a big gun. It’s the next-lightest main gun carried by some warships, usually if they’re French or in some instances Russian.
The French like it.
The 20mm is just a big machine-gun but it fires rounds that explode on contact.

I also suspect the government gets a good deal when I hear Ingrid Hipkiss gently guiding Chris Hipkins through what was essentially a party political broadcast with Ingrid encouragingly saying ‘okay’ at the end of his sentences.

  I hope that was just early nerves, and not a sign of her lack of knowledge and inability to control the interview.

  They said Twitter responded with a ‘Poo’ emoji, after RNZ complained to the Twitter hotline.. The poor dears.. One of them said they get $48 million from NZ On Air, but countered with: it’s in our constitution to be “independent” blah, blah.

My reaction on reading the article about the Vendemiaire was that the authors knowledge on the subject was lamentably thin. A proper sub-editor would have fixed up the glaring errors made in the piece but they are thin on the ground at the Herald these days.

  Another thing about the Herald’s (and Stuff) story: the French embassy was not responding to requests for comment over the weekend.
  I knew an embassy staffer. He was a naval warrant officer. His daughter was friends with one of my daughters.
  He said that when the embassy closed for the weekend ‘it closes. It does not open again until Monday unless a war starts’.
  I also found it was a routine in the Italian, German and some other European embassies, and, notoriously, the Australian High Commission.
  The New Zealand Defence Force most likely refused to comment because Vendémiaire wasn’t their ship and so wasn’t their story to tell.

Also, something critical came to light in between the publication of my first piece on Australia’s vaccine contracts in October 2022 and now. A lawyer from New Zealand (publishing under the nom de plume of Cranmer) discovered that the Australian TGA and NZ’s Medsafe were not only working together during the Pfizer vaccine approval process, but Medsafe had severe misgivings about the Pfizer vaccine (particularly in terms of long-term safey data) that were ignored by both the NZ government and the Australian TGA:

The Pfizer vaccine was granted provisional consent for use by New Zealand’s regulator, Medsafe on 3 February 2021. The development was immediately welcomed by then Prime Minister Ardern who stated, “Medsafe’s decision is the culmination of a rigorous assessment process over many months to ensure the Pfizer/BioNTech vaccine is safe and effective to use here. It is informed by the most up-to-date medical and scientific data. We can have confidence in their decision.”

However, in reality, the government’s representation of Medsafe’s assessment was overstated. Specifically, Medsafe’s clinical assessment found:

“The duration of the vaccine protection has not been established beyond two months.”

“At this stage, there is limited evidence of protection against severe disease.”

“There is no long term safety follow-up information.”

“Vaccine prevention of asymptomatic infection and disease transmission has not been established.”

The benefit risk balance of Comirnaty (COVID-19 mRNA Vaccine) for active immunisation to prevent coronavirus disease 2019 (COVID-19) caused by SARS-CoV-2 in individuals 16 years of age and older, is not clear. At this stage, there is evidence only for short-term protection, and longer-term safety data are lacking. However, experience with the vaccine is accumulating rapidly.

Medsafe also received information from its Australian equivalent (the Therapeutic Goods Administration (TGA)) which was also considering an application from Pfizer at the same time. The TGA shared tranches of evaluation reports with Medsafe in December and January. Medsafe received a copy of TGA’s final report (granting provisional consent in Australia) on 25 January 2021.

Read it and then ask, why is nobody in the opposition or in mainstream media in this country asking questions.
It is either corruption or people are being blackmailed. It is no longer possible to call it incompetence.
These are questions that should have been asked months ago, but still the blanket silence continues. How much longer can we circle the toilet bowl before someone in the opposition stands up? We are rapidly running out of time. We will be round the S bend before we know it.

Whatever investigation happens has to be thorough and totally above board. NO restrictions on scope. If it is done properly there will be people who deserve jail time and very many destroyed reputations and careers.
This is why there is such an effort being put in to shutting this down. Every politician in parliament is complicit to some degree. Not one of them has had the courage to ask questions that demand asking.

Whilst standing for fifteen minutes in a queue at my local ASB branch yesterday I had no choice but to watch the ASB in- house video loop alternating between ads for ASB products and a propaganda clip about some dude who thinks he’s actually a shiela- complete with the ASB logo gaily adorned in rainbow stripes.

What is it with banks that they feel they have to push this woke agenda. Just focus on your core business, for heaven’s sake. A fifteen minute wait in a queue is bad enough but when it’s accompanied by a never-ending piece of woke indoctrination it is not conducive to happy customer relations.

I got a reminder yesterday to complete and return the Census forms for my household, even though a full set of completed forms was returned by mail on 9 March. (Father-in-law wanted to complete his own form, but doesn’t drive a computer).

I phoned the information number shown in the reminder, and it transpires that Stats NZ don’t think I completed a dwelling form.

I wonder then if we’re going to make a fuss about any potential connections with the US or French police .

One of the minimisation tools suggested is “Take care driving your car over potholes a sudden physical shock may lead to internal damage to the battery, which may cause thermal runaway”.

One more reason to stay with my gas guzzler.

  Two other helpful hints in the article by Ralph Cooney, an Emeritus prof of Chemistry at Auckland Uni, are to avoid charging your battery to 100% capacity as this can cause overheating. Around 80% is better. Also allow your electric vehicle or hybrid to cool down after a long trip before charging the battery.

Yesterday on Lambton Quay, I was approached by two RNZ reporters with their mobile microphone. “Would I mind answering some questions”. Certainly I said but first tell me why KimHill provided a platform for the Auckland Gay Pride activist to spew a pack of lies and misinformation about Kellie -Jay when she was here, without any contradiction on her part.Their microphone which had been in my face and recording, was very quickly withdrawn and clicked off.
They walked away, was it something I said??

Love him or loath him the best response I have seen to McNaulty’s 3 waters interview the other day is from Winston Peters:

“In an astonishing and dangerous interview on Q+A on Sunday Local Government Minister Kieran McAnulty stated his justification for continuing to include co-governance in the ‘Three Waters’ reform, is because “the treaty recognises that Maori have special rights in water in particular…it’s been tested in the courts and found to be New Zealand law.”
It’s astonishing not only because he stated that mistruth, but because Jack Tame didn’t question him on it’s validity.
The fact is it has never been tested in court and there is no law. If it was, then why did Minister David Parker leave those Maori property rights out of Labour’s own RMA reform legislation?
What’s worse still, were his comments that there are “provisions in our laws around the treaty that aren’t democratic….There are provisions that we have in this country that wouldn’t stand up to a purely academic democratic framework, but that’s not how we work in New Zealand.”
The cavalier nature of McAnulty delivering that statement about Labour’s plans for our democracy should be of serious concern to all New Zealanders.
The likes of McAnulty and Willie Jackson’s anti democratic claims of legal precedence for special Maori rights under co-governance, base their argument on the Treaty being a partnership.
They have never been able to explain the origins and historical foundation for their claims.
The fact is there is no legal precedence.
The moment the Court of Appeal in the 1987 ‘Lands Case’ handed down its judgement, certain Maori, having protested for years that the ‘Treaty is a fraud’, all of a sudden started arguing that the Treaty was a partnership.
Partnership in a constitutional and legal sense was never ever part of that 1987 case. But it’s on the deliberate misconstruction of that case that claims have been made over, and over, and over again.
The fact that their claims would have required the Court of Appeal in 1987 to ignore the words and meaning of the Treaty of Waitangi is flippantly dismissed.
In the Treaty of Waitangi governance was conferred on the Crown.
The tribal leaders ceded, conceded or yielded government to the Queen.
The rule of law is enshrined in the Treaty by reason of the Treaty’s promise of equality – and in addition equality under the law is a basic element of the rule of law.
And that means policies, like co-governance and ‘Three Waters’, that create inequalities under the law are repugnant to the rule of law.”

Then he gets in government, becomes Foreign Minister, and you only see him occasionally when he comes home (tired of the duck pate and champagne in Emirates Business Class) and abuses journalists (“Listen sunshine” 🙂 who want to ask him a question.

  I was surprised too; it wasn’t that long ago that I considered John Tamihere a fairly centrist balancing force to Willie Jackson on Radio Live. I guess he’s now firmly in the grip of his special interest role at The Māori Party.
  
  It’s not out of the question though that these strong comments are a deliberate attempt to speed the debate. I am not averse to the idea of having a national debate and referendum.

Now, folks, this is Belfast, Northern Ireland, where for decades the religious and nationalistic animosities between people of the same country resulted in tens of thousands of bombings and shootings, thousands of deaths, and the sundering of the social fabric.

Yet apparently the Irish people have the ability to respect each other’s rights and the Irish police know how to conduct themselves in a dutiful manner.

I wonder what a far-off country, hitherto exemplified as a bastion of peace and goodwill, could learn from such a display? Perhaps that violence is no proper response to the exercise of free speech, and that police should not operate in such a manner that has them standing by, staunch in their politically-motivated dereliction of duty, while women are beaten and otherwise assaulted and plead for their help.

NEW YORK—The FBI arrested two people on April 17 on charges of operating a secret police station in New York City on behalf of China’s regime, according to the Justice Department (DOJ).

The duo, Lu Jianwang, 61, and Chen Jinping, 59, conspired to work as agents of the Chinese Communist Party (CCP) and took orders from the regime in order to track down and silence Chinese dissidents living in the United States, prosecutors said.

  JFK was allegedly a sex pest (like forcing girls from the typist pool to felate his brother while he and other senior members of his government were watching) and won his election through election fraud (to be fair the Republicans were also committing election fraud in Illinois – he just did it better).
