Synlait tried to raise capital on the local stock market but wasn’t supported, hence the need to get foreign capital. If we want growth we have to be prepared to invest ourselves or accept increasing levels of foreign ownership.

One man got pinged for pointing a firearm at cops who attended a possible burglar call at his house as he thought they were intruders.

“Mr Graves chose a firearm. The primary purpose of firearms is to kill at a distance.

Outside court Graves said he was unhappy with the decision.

“The judgment says a man can no longer consider his house his castle.

“I told the police it was my house and I could do what I liked in it.”

I’m interested in why would Mr Graves had not been convicted if he had used a baseball bat?
At what point did he know they were police?
Why was he convicted of assault unless he committed that?

It appears all the info isn’t here mores the pity.

That’s what capitalism is about Pete. You should rise and fall on your own. Take a bet and invest your own money and if it hits gold, then you’re sweet, but if it went wrong, then you lose your investment. You’re all over the place Pete. You doubted capitalism on the other thread on Food Price Speculations last week, now you’re implying that investors shouldn’t speculate the risk but just throw in their money by good faith into Synlait so as to avoid foreign ownership, in which a sane investor wouldn’t invest his/her hard earned dollar simply for that purpose? Don’t you see your self-contradiction here? Or is it the contradiction of socialist ideologies that you so cling tight too, thus ignoring reality? Which one?

The The primary purpose of an air pistol is not to kill. A baseball bat is more dangerous when used on a human.

The judges reasoning is flawed with factual inaccuracies and I would appeal based on his summing up. If he’d phrased his decision better I would have a problem with it, the guy was a dick to take aim at a cop with a laser sight after they’d identified themselves and he was lucky not to get blown away.

In other countries he couldn’t have expected to live long enough to be charged.

People in NZ complain about (a) lack of growth, and they complain about (b) foreign ownership. If they want (a) then more local investment is necessary, or they have to accept some of (b). That’s nothing to do with socialism.

My point is that in regard to the recent past – concerning the Democrats partisan treatment of Republican Supreme Court nominees, Mr Durbin’s comparisons of his own country to the regimes of Hitler, Stalin and Pol Pot, and finally the partisan rancour of Dana Millbank – people who trumpet the wonders of bipartisanship in this era of Democrat control of the Senate, Congress and the White House are either profoundly ignorant or deliberately partisan themselves underneath the cloak of being a “moderate”.

Tom, you first criticised the source and the writer – it was verbatim quotes of a public speech in the senate, reported in the same words by hundreds of news outlets.

And now you suggest that a glimmer of bipartisan hope should be stamped on because of all the crap – from both sides – in the past.

Dick Durbin acknowledged past stupidity – “During the course of his statement I reflected on some of the things that I have said and how I’ve voted in the past and thought that perhaps his statement suggested there was a better course for many of us to consider in the future.”

You didn’t answer my question, I’ll try again:

I would think my answer is implied – but strongly implied – in my response to your ever present questions.

But if you need me to be explicit then I will put it this way – I’ll be more receptive to these calls for bipartisanship from the likes of Mr Durbin and Mr Millbank when they are made in a situation where Republicans control the WH, and possibly the Senate and Congress as well. Would you like some information about how Durbin and Millbank reacted in such situations?

My reading of the recent past is that there will be fat chance of sweet reasonableness in such a situation. CSPAN has it’s video’s of the Bork and Thomas nominations as well as those of Alito and Roberts – perhaps instead of stamping your foot about having your questions answered you should take a trip down memory lane and then come back to talk about whether your fond hopes can still be justified.

If people don’t want overseas investors to come in to ‘progress’ our country then they should provide the capital themselves … one solution is to be making bigger deductions via Kiwisaver such as 10% instead of the ridiculous 2% introduced by the Nats. It was also a foolish comment by John Key that we don’t change our rules because of what other countries do. If the Chinese do not permit overseas ownership of their land then it makes sense for us to reciprocate the compliment … instead of always trying the lead the world in freindship and enlightenment. We should be bloddy minded from time to time, instead of stupid minded.

Nefarious having delt with fairly large numbers of both cops and crims in fact it would go a long way towards me NOT pointing a weapon at someone who could articulate himself in English.

Arsehole crims tend to use languge like “pigs” and call the police “useless wankers” which tends to give them away.

Anyone with any experience in the field will tell you that the mannerisms of the police tend more towards the civilised end of the scale and are easily picked out compared to the bottom feedign scum whose first reaction when you bust them where they are not suposed to be is to get abusive and either run or attack.

Get fucking real yourself, and do try to read up on some elementary property laws and rights of entry, they had probably cause with the broken window and the complaint from the neighbour.

The only example Graham sets in one of treachery. Quite an accurate alternative term for what the elft call “bi-partisanship” actually, especially seeing as a large part of the ideology Progressives subscribe to is unconstitutional.

True bipartisan action by true patriots would see 90% of Democrats and Republicans swing from the lamp posts.

The GOP was in opposition in the House for 40 years, from 1954 to 1994. During that time they were usually in opposition in the Senate as well (I think there were only a couple of majority periods, and those for only a couple of years).

During that time they took the traditional attitude that Graham alluded to, that people nominated by a President should be subject to questions about whether they are qualified to be on the Supreme Court, but not be turned into proxies for a fight in cultural or ideological wars.

That crap started with Edward Kennedy’s speech on nominee Bork, and it has descended from that point on. What Millbank is really asking for is that the two sides play by different rules. What has finally become clear is that the Republicans are not going to play that game any longer and it is perhaps that which is penetrating the skull of Mr Durbin rather than the Graham’s appeal. Of course it could also be this, as pointed out by Ed Whelan in NRO:

Gee, I wonder whether the arch-partisan Durbin—who not only voted against both Roberts and Alito but also voted to filibuster the Alito nomination—was just pandering to Graham. That’s a tough call, don’t you think?

As goes Durbin so goes Millbank.

You do realise that Millbank is using his praise of Graham as a stalking horse to implicitly condemn the “tribal logic” of well-known hardline, right-wing extremist Republicans such as Olympia Snowe, Susan Collins, and John McCain – or did his honeyed words so soothe you when you linked to the article that such a thought passed you by? Let’s go to NRO again:

It’s touching that Milbank is so smitten by Graham that he now gives the impression that he thinks that Graham’s position of deference is correct. But I’ve uncovered no signs that Milbank had that view when the nominees were John Roberts and Samuel Alito. And I’d be willing to bet that he won’t hold it the next time there’s a Supreme Court nominee who’s perceived to be conservative.

I’d be willing to bet that too.

Mr. Lugar said he carefully followed Ms. Kagan’s confirmation hearing testimony and the debate about her nomination, including recommendations from his constituents, and concluded that she clearly is qualified to serve on the high court.

I prefer to applaud current positives rather than dwell on past negatives.

The “police’s” primary role is to protect the community, not apply the law to the nth degree and instill fear into society. Fear of being unable to protect yourself from others or fear of falling foul of some ridiculous enforcer, judge dredd style.

I have gone into houses on just the same circumstances with weapon drawn in uniform and plain clothes and have had people point firearms at me.
In all cases but one as soon as they had seen my uniform (with both of us shouting out and peeking round the corner) they put them away and we then “cleared the house” with them to make sure they we safe.
They did not take my word for it that I was a cop until they could see me and rightly so, that is common sense.

We did not lay charges against them and never would have, I think the judge erred.
but then we don’t know everything as the report is incomplete.

I once collared a burglar that a previous patrol had just missed (they were about to have a cup of tea with the tenants in the kitchen) who was hiding in the bath (lying down) with the shower curtain pulled across. red faces all round…..

I made a great friend with one guy who was trying to get back into his place having left the keys inside, that he had his little daughter in a pushchair whilst he was climbing through the window as I drove past made it easier to decide what was what in that case 🙂

Sadly 90% of our burglar alarm call outs were false alarms but had to be treated as in progress and on windy wet nights there could be many.

The Government is rushing to implement the Standards without any evidence that they will raise achievement. National standard regimes in other countries have failed and are being abandoned. New Zealand children are already achieving very well compared to other countries.

Since Mr Graves, being inside, couldn’t use the firearm at a distance [Judge’s words], it then was a weapon of secondary use, whatever that is. And everyone knows a secondary use of a baseball bat is as a weapon.

we responded to the same call and arrived about 5 mins after the other van, they were making them a cuppa to (three lovely lasses).
I asked the other crew if they’d checked the wardrobes etc which they hadn’t being distracted by the lassies!
So I went to look in the bathroom on the way to the nearest bedroom.
talk about red faces, but the biscuits were nice and we let them have the collar (and the paperwork) 😉

I’m not, this is a continuing case of the judiciary and Police abrogating our rights to self defense.
Stephen Franks has written very comprehensively on this issue.

When I first got to NZ a business owner way down South had had his insurance canceled because of the many burglaries he’d had.
The alarm went off so he went down to the business and apprehended two people on site and because he had his hunting rifle with him was able to frog march them up to the nick to hand them over to the police.

He was charged with pointing a firearm!
I realised then we had come to stupid no common sense liberal land and nothing has changed that view, even meeting and talking to Greg O’Conner about the issue either.

From what I can recall, I never finished one, and my recall is quite bad becuase you had to be drunk to attempt one.

Emery has served about 18 months of a four year three month sentence. He killed someone. He wants out because he is “under stress and depressed”.

Bailey Kurariki agreed to serve his whole 7 year sentence, he didn’t kill anyone himself, he was convicted of manslaughter for his involvement as a lookout when someone was killed.

Where is the problem?

RKBee – I wouldn’t blame the front line police, I realise the situation they’re in. I think the problem is the direction given to police by their administration and the government. Clearly the attitude of the judiciary is also questionable.

Almost a decade ago I was arrested for assault. I had witnessed two guys beating the snot out of another guy, and pulled one of them off him. He slithered off down the road just as the police turned up, and since he’d ripped my shirt when I pulled him off I decided to assist the police and pointed him out to them. I went with them when they went to apprehend him and his cohort, and agreed to give my details and be a witness. The police arrested this guy first, and he was sitting on the footpath handcuffed. His mate was putting up a struggle while two cops were trying to arrest him. This was close to where the first guy was sitting, and I saw this guy reach out his leg to try and trip up one of the cops. Without thinking I reached my leg out and kicked him in the nuts. Next thing I know I was arrested, bundled in the back of the cop car and taken to the station. I don’t actually blame the cop, he obviously has a job to do and had witnessed me kicking the guy when he was handcuffed, sitting on the ground. I know the police who processed me were sympathetic to my situation, as they had me processed and out of the station within an hour and were very pleasant to me. Ultimately I ended up in court, and the judge also displayed some sympathy to my situation. Although I didn’t avoid the conviction I was given no penalty provided I kept out of the courts for 6 months. The conviction no longer appears on my record (as per the results of a pre-employment check for criminal convictions) so it’s no problem for me now.
What is has reinforced to me though, is that police really don’t like the public to do anything more than give information. I’ve taken this incident as a very useful lesson that unless I’m under a direct threat I should stay out of it.
However, in my opinion, if anyone came into my house uninvited I’d be very much attack first, find out who they are later. While I don’t have firearms or air rifles in my house I could certainly find something to make a useful weapon.

One thing that also concerns me about the case of this guy in Taupo – the air rifle wasn’t loaded.

Not quite Fot. Bruce Emery is eligible to apply for parole. The Parole Board is under no obligation to grant his application. We’re quick to criticise the Parole Board when they release people before we judge that they have paid their debt to society, and even quicker to condemn them when someone released on parole reoffends. I think they’ve got this one pretty much right, and I note that they have called for a psychological report before Emery applies again.

Fact is, Emery has been judged to be effectively in the same state of mind that he was when he offended. Part of his defence for his offending was his state of mind.

Parole board got it right. IMO.

How odd that when McVicar’s poster boy is found not to have rehabilitated in jail and is refused parole, no one in the media (to the best of my knowledge) rushes round to McVicar to ask him what he thinks.

Whenever any other offender is asking to be let out, there’s the obligatory phlegm from the SST about how “scum” never change, “danger to society” blah blah blah and when the Parole Board opts to keep them in McVicar is crowing that he’s been proven right.

Was his phone off the hook? Or doesn’t Emery’s continued self-justification whilst mewling about his “stress and depression” (because of course every other prisoner is happy and carefree) fit the storyline the MSM tries to ram down our throats every day?

AN ARAB man has been jailed on a rape charge after an Israeli court ruled he had duped a Jewish woman into consensual sex by lying about his ethnicity.

The Jerusalem District Court sentenced Sabbar Kashur, 30, to 18 months behind bars on Monday, after finding that he had had sex with the woman by posing as a Jewish bachelor interested in a long-term relationship.

When the woman found out he was not a Jew, she filed a police complaint that led to charges of rape and indecent assault. In a plea deal, Kashur later agreed to the charge of rape by deception, the liberal Haaretz daily newspaper said.

“If she hadn’t thought the accuser was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated,” Judge Zvi Segal wrote in his verdict.

Kashur, who is married and has two small children, called the verdict racist.

“If I were Jewish, they wouldn’t even have questioned me. That’s not called rape,” Haaretz quoted him as saying.

“She agreed to everything that happened.”

The newspaper noted that the Israeli High Court set a precedent for the charge of rape by deception in 2008 when it rejected an appeal against a rape conviction by a man who impersonated an housing ministry official, promising women he would get them an apartment if they slept with him.

Haaretz quoted Elkana Laist of the public defender’s office as saying yesterday that the Jerusalem court had gone too far in its application of that High Court ruling, “opening the door to a rape conviction every time a person lies regarding details of his identity.”

The argument that obtaining sex by false pretences is a form of rape has been used in several countries, including the United States.

Israel’s Arab community numbers 1.3 million, about 20 per cent of the population. It includes the descendants of the 160,000 Palestinians who remained in Israel after the 1948 war and establishment of the Jewish state.

Relations between the two communities have always been controversial as Israel describes itself as both a Jewish and a democratic state, with rights for all its citizens.

Speaking of which, I watched Campbell Live today for the first time in buggered if I remember (late 2008?). It featured some teacher who got sacked by a school, a sympathetic story on those fuckwit long-boarders who pissed around on the motorway (and should have wound up spread around the axles of a lorry) and the Harry Potter theme park. You know, real pertinent issues that affect everyone’s lives delivered in a way that doesn’t seek to make the audience empathise with them. Real objective journalism.

On NatRad this afternoon Brian Edwards made some accurate and scathing comments about TV1 and TV3 “news”. It seems those are commonly impressions of the magazine shows, what demographic actually takes them seriously?

Related to other recent Edwards comments, Duncan Garner comes across as full of self importance and opinionated on the TV3 show, thinks he is the news rather than reporting it sort of thing, but for the first time I watched him interviewing on The Nation and he is a lot better at that.

Synlait tried to raise capital on the local stock market but wasn’t supported, hence the need to get foreign capital. If we want growth we have to be prepared to invest ourselves or accept increasing levels of foreign ownership.

The most scary part is where the foreign capital comes from, ie which printing press, and how long is it actually going to be a valid currency. Land will always be land but “money” can be anything and usually is. There are a few trillion dollars floating round the world (well most of it in China) that came off various printing presses (computers) that is being used to buy up assets worldwide. The monetary system is developing the characteristics of a very bad religion. Ya gotta have faith…..
