Captain Mainwaring

Cindy is away on the RNZAF’s Broomstick One and won’t be back for a while.
No Parliament Question Time for two weeks.
We should be regarding these as just minor impediments in the campaign to skewer Iain Please Gallopaway and whoever he’s protecting.
In the meantime Simon Bridges is using his skills as a prosecutor to edge closer and closer to the truth without stepping over the mark.
We need to keep the bouncing Czech and whoever’s mowing the lawns for him on the front page every day.
Sooner or later a committed and resourceful journalist is going to become famous by connecting all the dots in the correct sequence.
Then we will be rid of the Corrupt Coalition of Lying Losers.

    Jethro long ago decided being daddy isn’t as much fun as it looks from the outside, has quit Dad duties and is swanning around the Pacific shooting his ‘fishing show’ which has less than 10k viewers. Baby is rapidly becoming a classic ‘raised by grandparents’ case, which so often flows from those who are not yet mature enough to have kids, having had kids.
    Bit sad for the child. In my experience, babies and small children need their parents just about all the time.

This is the core argument by Mark Cooper j to keep Mark Lundy caged, and suggested by Rod Miller of Texas he should be executed.

[338] On the basis of the evidence about the DNA and the CNS tissue, the Crown
submitted there was an irresistible inference that the CNS tissue on Mr Lundy’s shirt
was CNS tissue that had come from Mrs Lundy. As Mr Morgan put it in this Court, it
had been demonstrated that Mr Lundy, apparently going about his ordinary activities
and staying overnight in a motel, eating routine food, had ended up with fresh
CNS tissue (and nothing else) embedded into his shirt in two separate places.
The conclusion that it was Mrs Lundy’s CNS tissue can then quite easily be reached
in two small steps. First, on the night that the appellant was wearing the shirt,
Mrs Lundy was murdered by having her head attacked with an axe with the
consequence established in Dr Pang’s evidence that a significant portion of her brain
was exposed and indeed missing from the skull cavity. Second, the only human DNA
found in association with the CNS tissue was that of Mrs Lundy. It was of good quality
and found in substantial amounts.

If you read that carefully, then this debate in the appeal court broadcast by the New Zealand Herald.

Asher: Yes this topic is one we need elucidation from you so we have the dna lifted in what has been described as quite considerable quantities . We also know the defence argument is that is not unusual in husband wife situation.And it seems it is not suggested that the scientific evidence shows the dna comes directly from the tissue that has been identified as CNS tissue. That’s obviously a very important mssing link.

MGN Thats the science, the science does not establish that a CNS cell was a cell from Christine Lundy by means of dna analysis, that is accepted. The question of course is how do you get on this tiny little bit of fabric CNS tissue that has been smeared into the fabric? Its the only tissue that the neuropathologists can see, it must have been applied when it was fresh, because its such a small quantity it crumbles and you can’t smear it in, and then the little piece of material, in fact its two pieces of material which sort of adds to the weight, one above the bicep and one on the front of the shirt are eluted into a beaker soak, and this according to ESR removes about 20% of the biological material in the stain, and the only dna is CL, and this is the inference, this is an inference case. There is a passage in KOS where he makes the very point Asher has just made, the science can’t do this, its a matter of inference.

WMN Can I ask 2 questions did the elution for each spot produce dna…yes… and was the dab slide or paraffin block taken from the shirt tested for dna? Were the remnants tested for dna?

MGN It didn’t work. There were a number of methodologies looked at but we only used those relevant to the case.

WMN. Did they produce any dna readings from those samples?

MGN From the tisue in the fabric blocks themselves answer no.

So despite there being copious high quality dna from the vicinity of the stain material there is no dna incorporated in the stain material. This material also yielded no brain neurons, to which Rod Miller said, this material came from part of the brain with no neurons.

This is the sole argument, and depends on a few forensic dabblers claiming this degraded air dried substance is PURE Central Nervous System tissue. (but no dna from the most abundant source in the body)

There it all is, laid out, in the words of a prosecutor and some judges. I hope someone here bothers to read it and think about it, because it is being internationally trawled over. It is bringing New Zealand into disrepute once more.\

It could not have been Demler (or with assistance of Norma), with his arthritis, he wouldn’t have been able to move the bodies, let alone put Crewe in the Waikato tied to an axle. The only proposition that works is if up to 3 people were involved ie. at least 2 men and a woman. Who was the woman?.

        His research is impeccable and makes complete sense.
        The murders had to be done by someone with free access to the Crewe house, that is Len Demmler, and someone with clear access to the Waikato river, once again Len Demmler.
        He did it.
        Chris posts the forged signature in his book The Last Chapter.
        Jeanette spotted it immediately, so what were Len’s options? Have you ever tried to talk your way out of a dodgy situation with a strong woman?

        The principle you invoke here is appeal to authority. My degree is not in law, and neither is Mark Cooper’s in science as far as I am aware. If you read that comprehensive opening post of mine, you will see that Mark Cooper is appearing to wax expert on matters logical and scientific.
        Law has everything to do with keeping Lundy in jail, and nothing to do with his factual guilt status.
        The legal machine has trumped the scientific community, and this is a bad thing.
        There is nothing to prevent them doing this to your family.

      Notsofast: If Lundy is innocent, and I mean entirely innocent of any ill-harm/killing of his wife and daughter then who did it? The reality is undeniable that:
      a None of the judicial officers involved were present at the time of the killing,
      b There has not been a replica crime in Palmy North to raise the prospect of a serial maniac being at large,
      c There were no sightings by neighbours of strangers near the family home,
      d The genuine possibility that Lundy arranged for the killings.
      
      My suspicion is that if Lundy was not the killer he knows the identity of the killer therefore he is open to protesting his innocence. If my suspicion is right then Lundy oughtn’t to have been gaoled for murder but certainly for conspiracy to murder.

        I clearly remember seeing the Police Officer in charge of the investigation stating on TV after the not guilty verdict was given that the Police were not looking for anyone else in connection with that crime.

        This will be covered in the coming months with some legal initiatives. It is known what happened, but not by who, but certainly there was a hit commissioned. This had nothing to do with Mark, but quite a bit to do with parties close to him.
        I am virtually certain the murders were due to escalation of a situation about midnight, but not a desired outcome by anyone.
        He is definitely and totally an unwitting party,but related by association. Of course people saw him coming.
        I hope there will be a succession of stories that might interest the media, but they are an appalling apathetic lot in New Zealand.

  They have no proof the material on the shirt came from anybody.
  They used the fact the Mrs Lundys DNA was found on the shirt, just as it would be found everywhere, to say the spots were hers. Despite never getting DNA from the spots.
  They know there arguments a clearly false argument but present it anyway.
  
  That’s corrupt.

    Thanks DJ Ward, it is frankly not a good look for the forum this mindless down voting without examining the argument. The case facts are lucid and thoroughly known, by a few. They will be known by everyone soon, as in AAT and Teina Pora.
    Those seem to be the undebated cases, but the other ones are clear too, all except Scott Watson in my view. That one is less clear.

        We do, and appeal courts to correct, except they failed twice in Thomas and twice in Pora. I am quite certain they have failed twice in Lundy and once in Tamihere. And once in Bain. And once in Rex Haig.
        This is like serial plane crashes without looking for the root cause.

    But the defence could not prove that Lundy would not be able to the do the round trip south. ( petrol consumption ) Their test was highly flawed as they used a racing track for their tests. The police actually did the exact road route that Lundy followed and proved he could do so.
    
    The murders were highly unlikely not the work of an unknown intruder/burglar who would have no need to to get rid of Amber as a potential witness

      Raynor Asher was at his mediocre average when he spotted this in the sessions. Gotcha the mediocre judge proclaimed, but this is appeal court judges sliming their path from the science.
      
      This stuff about Amber is of course not supported by common sense.
      A mature woman may be persuaded to keep quiet, but what a story for a 7 year old to spread in the play ground about a man attacking her momma….

      The Crown relied on the consumption figures from the police’s first tests, which were supposedly to replicate Lundy’s breakneck (impossible) return drive to PN during peak hour. They couldn’t replicate it, and said they wouldn’t do it at those speeds anyway for public safety concerns. Not sure how they can assume that fuel consumption they got from their tests would mirror the consumption during Lundy’s breakneck morning drive back to PN (*averaging* 100 km/h). Essentially they just discard the test track results simply because they differed too much from their own results. The test track results for *normal* driving are close to the manufacturer’s claims and Ellwood’s own fuel economy figures – but they don’t mention that bit. They’re selectively rejecting results because they don’t agree with their own. Nice science.

      Not So: Lundy was never a “pretty regular guy” he was a bloated self-opinionated “I am!” of the highest order and as irritating as your blind shots at the Judiciary. Of course the judicial system is not right 100% of the time (like the medical profession, airline pilots etc) but give me the system we have ahead of dribbling conspiracy theories from the absurdly under-employed.

Judge McNaughton has been a member of the Odyssey House board of trustees since September 2013, according to the Charities Services register.

An organisation which the offender’s mother worked for also hosted Odyssey House, the court heard yesterday.

When referencing his “direct experience” with defendants undertaking substance abuse programmes in his decision, Judge McNaughton claimed a resident at the clinic quit his treatment and went on an armed crime spree “as a direct result” of a Weekend Herald story.

In addition to Judge McNaughton, Odyssey House has had only one other sitting judge on its board of trustees, Judge Philippa Cunningham. She left the role in 2012, the Charities Services register shows.

Justice Anne Hinton was a board member but relinquished her role in 2015 shortly after being sworn in as a High Court judge.

  These beaks tend to be from richer families , have lived cosseted lives and perhaps never been the victim of a lot of the shit that career criminals are happy to dish out to the less fortunate in society.

Unable to respond to your post re Rolex last night due to visitors.
Yes, it was quite an event – a first for any New Zealander, and narrowly, for any Australian as well.
But while DPF knows, coming out from under my shell and saying “what” would remove my anonymity. Suffice to say that it took more than 15 hours and attracted considerable nation-wide publicity here and in the UK. Rolex UK used pix of me and the watch for UK publicity ….. hence the gift.
The watch is actualy an SS Rolex Submariner Oyster Perpetual, guaranteed watertight down to 660Ft. It has a monstrous moveable bezel, and weighs a bloody ton. It costs fortune to maintain to a top condition standard. After 53 years it needs proper maintenance checks once every 3 years. The movement is up-graded where necessary, the luminosity re-done, and the seals are replaced before being pressure tested. Following an accident five years ago I had to get a new Rolex bracelet (other brands ‘will not do” don’t you know) . – at a cost almost $1500.
Although there is a warranty to 660ft, mine normally was kept above 150ft, Once did a bounce dive (5-6 secs) to 310 ft at the Poor Knights …. but only once. It was like being squeezed in a vice (I imagine).
Should I pre-decease DPF, he is free to say who, what, and precisely when. ?

First – Its the apparent failure of the Kiwibuild initiative.
Now it’s the plant of a billion trees. They ordered one million seedlings to plant in a particular plot of land, which needed to be reduced to 191k. Apparently no-one inspected and evaluated the state of the plot. Seems it is covered with scrub, weeds, and what can only be described as ‘previous rubbish left behind from a previous felling’.
Incompetent morons – the lot of them.

A couple of questions:

How do you deal with red zone residents who had no insurance?

How do you deal with people with no insurance?

How do you avoid people cancelling insurance, because you remove the need to have cover for an earthquake?

There, that should keep them busy for the next 6 years.

  Four names: Ian Simpson, Gail Kettle, Barry Searle, Reid Stiven.
  
  Simply OIA all correspondence between those four and Fletchers EQR and you’ll have your answer.
  
  For example, I OIA’d my own house case with EQC/Fletchers EQR. Quite amazing email evidence of them colluding to bring it under cap to save money – they lost, as we got put to insurance once I pointed this out.

    1. the EQC model – is it a state agency with clean hands or is it a state agency playing at being a bad insurance investor/broker; and
    2. How to deal with future Red zones (& residents) – because there will be future situations- we just don’t know where or when.

      The red zone is an impt one agreed, eg. most of downtown Wgtn will be red zoned in the next big event.
      EQC, like ACC, is reasonably unique, and as such, heavily prone to fiefdom and fuckups.

    One of the things that really contributed was the lack of skilled tradies, particularly painters etc, and the stupid money involved.
    
    The guy who fixed up our place had a small crew going. He had training (6 months at poly), but the crew had no trainig at all.
    
    As he put it: if you can hold a beer bottle, you can hold a paint brush and get paid $50 an hour.
    
    We were “lucky” since our place got hammered in the first (Darfield) quake and thus got a better sort of tradie. Sign off was by a local builder who had his kids in the local school and knew he’s have to look you in the eye.
    
    When the Chch quake happens they got really desperate and real bad cowboys came out: painting over light switches, drips on carpets etc etc. Really shoddy work.
    
    $50 an hour, more if you have to go back and do the job twice. Where’s the incentive to do a good job?

About that Kiwibuild. 1,000 homes to be ‘delivered’ by 30 June 2019. Just as the start date for the programme was ‘adjusted’ to 1 July 2018, I expect there to be an ‘adjustment’ – aka spin by Mr Twyford – to what is meant by ‘delivered’.

Most people would expect 1,000 homes to be occupied or at least ready to be sold. I predict ‘delivered’ will include under some sort of post ballot contract to buy off the plans for actual delivery one day, maybe. Only 75 officially under construction, so a massive construction surge is needed but is it happening?

Atm we don’t know how many ballot winners will actually complete and move in. The official Kiwibuild site still shows only 4 sold.

This Government is going to get caught out by promising to much to grab the vote and put together the Coalition of fools that we have. Shane Jones and his trees, Phil Twyford and his housing, Cris Hipkins and education and Sweet Cheeks with all the money but not enough to fill their promises. One year on and 238 houses under contruction 18 finished, millions of seedling trees ready and no where to plant them as thousands of hectares of land is over grown with weeds gorse and other problems, Scools on strike as they think that they are worth more money for the work they do the coalition promised and they would fixthe years of neglect. This is without mentioning the corruption in Immigration and a Minister out of his depth and a inquiry into appointment into a officer that should have not received the position he has that says he was bully of women but was still cleared in the inquiry with out these woman being taken seriously. So interesting times ahead and will people finally take notice that you are being conned and Jacinda only needs you to enhance her image and feed her lust for fame.

Why, amongst all the mess of the Haumaha Inquiry has neither the Government nor the Opposition mentioned a “New deputy promoted alongside Wally Haumaha as size of police executive grows”
… the police have created another deputy police commissioner role, by internally promoting Assistant Commissioner John Tims to run the 12 police districts.

Why was Haumaha selected to be the one statutory Deputy Commissioner, appointed by Governor-General, on the recommendation of the Prime Minister?
(Current structure: under Police Commissioner there are 4 Deputy Commissioners – one statutory Deputy Commissioner, appointed by Governor-General, and three Deputy Commissioners, appointed by Police Commissioner. First two were appointed in 2014}

Does new Deputy Police Commissioner Tims in fact have greater responsibilities, running the 12 police districts, than Haumaha in his duties, which are unchanged?

Why was the appointment of Deputy Commissioner Tims not publicised as was the promotion of Haumaha, when Tims probably controls more of relevance to the general public?

Prompted by the questions of one person, Louise Nicholas, and now a further three women’s allegations, this Inquiry was to ascertain how an appointment – involving the Prime Minister and then Governor General – was made regarding a man who apparently is now performing the same duties as he was before.

As a Yes, Minister series plot line, this would have been dismissed as being too silly to be plausible.

  It’s good in theory but of course government can still screw it up, especially when it starts producing outcomes that are correct but not politically correct.
  
  The big technical problem is that causes and effects tend to be correlated and it’s hard for the computer to decide which is important while a human using common sense can more easily do so.

  Of course governments use “algorithms”. They have since 1086 in Britain with the Doomsday Book (quite likely earlier in China and Roman Empire too) and all the census data gathered since then.
  
  But the talk about AI is bullshit. AI, in this context, is just pattern matching that finds patterns then uses them to make predictions. eg. AI algorithms notice that rap music and KFC go together and predict an upswing in KFC consumption when rap music plays on the radio.

What utter stupidity, I went into my local store to get amongst other things a couple kgs of apples and bananas and there was nothing to put them in. Not shopping there again until this changes.

I had a look at Stuff’s KiwiBuild Tracker: https://www.stuff.co.nz/national/politics/105105107/how-our-kiwibuild-tracker-works

Actually quite a decent bit of work in it. They do however accept some of the Twitford’s lies, like the Northcote project, which was actually work already planned under National. For anyone with half a brain, its clear that KiwiBuild won’t be building any MORE houses than would have been built previously. I think Liebour have to be smoking something to think they can ramp up their 1000 by July 2019 to 5000 in 2019/2020, to 10000 then 12000. At 12000 MORE houses a year, KiwiBuild on its own must build about 55 houses a day, allowing for builders holidays, weekends and public holidays, etc.
Does anyone have stats on total houses built annually in NZ over the past 10 or 20 years so we have comparative numbers going forward?
Based on the current numbers they have about 36 days to complete houses currently under construction before they start falling behind even their own generous targets. After that they have 195 days (total) to build 535 houses. This translates to about 140 work days, so 3.8 houses a day! Ha bloody Ha, they can’t do it, certainly not without pulling resources from the open market, which means they will achieved nothing.

I love this. Ireland may well be over thinking their own worth.

The All Blacks played a conservative “turn them around” game which was a very fine line decision but a win is a win.

I think..and hope.. that they unleash hell this weekend. I hope I am right but that was the most conservative I have seen the All Blacks play in quite a few years, although the weather didn’t help.

  We open an embassy when we do less than $400 million worth of trade a year with Ireland.
  
  TVNZ says Ireland is important after Brexit as one of only two English- speaking countries in the EU (presumably the other one is Malta).
  
  Most countries’ diplomats will be fluent in French, and likely in German, too. Where are they recruiting NZ’s diplomat trainees from? What courses do they need to take? Mandarin is certainly important, and probably Japanese, Spanish, German, too, but French is still important in diplomacy.
  
  A little ironic, if the purpose of the Irish embassy is that it’s an English-speaking enclave, then in the opening ceremony we stress the culture of another of NZ’s official languages – Maori.

Best article I’ve read on NZ’s Rocket Lab and its founder-leader, Peter Beck, is in the English-language version of Germany’s Der Spiegel.

Gives a picture of the market Beck aims for.

Beck is from an old Southland engineering family. His grandfather ran one of Invercargill’s bigger motor garages. Peter’s father, Russell, was a pretty much self-taught, but very bright, man who ran the Southland Museum and became the leading authority on greenstone.
