What really gets me about this whole Sroubek debacle is this ‘very last chance’ thing.

‘You’re on your LAST CHANCE you naughty boy!!’

Reminds me of numerous parents I know who never disciplined their kids when they were small, because of Sue Bradford and now try to blame their teenager’s appalling behaviour on some bullshit ‘syndrome’ dreamed up by a psychologist.

It’s basically part of the reason nobody wants to be a teacher anymore. ‘If you do that ONE more time…’

No swift and meaningful consequences. And we’ll never put the genie back into the bottle.

The Chinese love it. They watch us floundering around, unable to address basic fundamentals that keep a society ticking over because the Progressives have wiped away any long-standing, successful traditions refined over thousands of years, like effective discipline.

Like I’ve said often enough on here, the Chinese will be back.

  My son’s doing fine now, got an honours degree and makes a fortune, whereas his cousin had learning difficulties brought on by fear of his father and is violent also.

        Re Tracy Watkins – she seems sane and reasonable compared with Stuff’s Verity Johnson who tried to tell Judith Collins over the Kiwibuild business. Her ‘opinion’ covered a major portion of the DomPost’s editorial page the other day. I have news for you, Verity – It was no ‘petty rant’ as you put it but a well aimed attack on Labour’s Kiwibuild policy. What is surprising is Phil Twyford and his (and Jacinda’s) did not see it coming. They painted a target on their backsides and Judith aimed right for it. Far from a ‘petty rant’ one expects opposition MP’s to hold the Government to account for its stupidity and that is just what Judith did.

A Dermot Nottingham update – over the last week or so he has failed in two bids seeking leave to appeal with the Court of Appeal (four respondents, myself, APN, Allied Press and Lynn Prentice).

His record in litigation has been abysmal, as has the way he has conducted litigation, with numerous breaches of law, court rules and timetables. The courts are dealing to him now but not stopping him – he currently has three appeals to the Supreme Court in the system after previous failures.

In my opinion and experience (over three years) the courts have been far too lenient with him. Just in the one Court of Appeal proceeding he:
– filed his application seeking leave to appeal out of time
– failed to file a submission as directed by a judge to give reasons for applying out of time
– failed to file his submission as Applicant by the due date
– after being told he had not filed by the court he set his own timetable
– he finally filed his submission after both respondents had filed our submissions on time
– two hours prior to the appeal hearing he filed another submission.

None of this was addressed. I believe that the courts should demand reasonable standards of conduct from lay litigators – their current laxity is patently unfair on targets of vexatious litigation, and it wastes a lot of court time and resources.

  I agree. I have been the victim of one. However, it is a balance. People should be able to represent themselves but there should be some logic and merit in their claim. In my case, the judge accepted and illegible scrawl from a retired lawyer.

    In my case there have been I think 13 hearings (failed private prosecution, costs and three appeals). I initially had counsel but when it was obvious the case was hopeless I took the risk of representing myself – a steep learning curve).
    
    I and Allied Press always filed on time. Nottingham rarely filed on time, and was often quite late – right from the start his disclosure, required by law within 15 working days, took 3 and a half months which included ignoring court timetables and admitting deliberately withholding it. On quite a few occasions he filed submissions the night before, the morning of, two hours before and even during (twice) hearings. And the courts did nothing about it.

        Good question, but this was criminal proceedings (a private prosecution) and I think that declaring a litigant vexatious applies more to civil proceedings.
        
        But multiple courts – District Courts (Auckland and Dunedin), the High Court and the Court of Appeal have all given him a lot of leniency, which has made things much harder and more costly for those he has harassed through the courts.
        
        Effectively the courts have aided and abetted his vexatious litigation.
        
        And as he has now admitted being insolvent and claims to have debts of $2m (a quarter of a million in unpaid court costs) he appears to have no means and no intent of paying costs.

      Pete, have you been in contact with the other parties? If one or more of you take action you can make his an adjudicated bankrupt. This will make it more difficult for him to initiate legal action.
      
      In my case I worked with 2 other parties who were represented. This helped a lot although the bar is too to get someone ruled a vexatious litigant.
      
      We exchanged information and documents.

        I and others owed outstanding costs were involved in that.
        
        The Court of Appeal proceedings were started before he was adjudicated bankrupt.

        No DUI’s Holysheet. And the liver is fine. Thanks for asking. Lost the license though temporarily due to a medical condition that alcohol withdrawal causes.
        Too much of a good thing became dangerous three months ago.
        Actually two years ago. Little known fact is that alcohol withdrawal can kill. I’m just happy I got this in my 40’s. I’m Day 43 in Camp Rehab in Sonoma. It’s been a blast. Mixture of rustic and luxury and I don’t have to cook.
        Five kids. A wonderful husband and I’ve survived a traumatic brain injury twelve years ago that paralyzed me.
        Great day to be alive and I’m off to Bodega Bay for dinner. Then home to my kids and dog.

Well said duggledog. The Chinese are not only back, they’re on our doorstep having just signed Niue and the Cooks up to their team. While these islands are self-governing “in free association” with New Zealand, I thought we were responsible for their foreign relations and defence? So we now have China projecting its power to our immediate north in the South Pacific and to our immediate south in the Ross Sea, as well as buying its way into our two main political parties. Nothing to be alarmed about of course….luckily there are no Uighurs here…

  Here’s a funny one for you. I munched my USB stick about 2-3 weeks ago and couldn’t get certain MS Office files to open, they just would say “corrupted” and wouldn’t open. So I went to one Chinese guy, “I do for you $150 per file.” Considering I’d lost numerous files, it didn’t sound like a good deal. So I went around the town to data recovery expert after data recovery expert that would only charge if they found the files, which sounded better and nothing. So I went back to the original Chinese guy, then he called up wanting my laptop because they’d screen the hard drive for historic saved for too. So last night at 10-11PM I was at some Chinese guys home/office because he wanted to identify any files found. Anyhow he had someone on the other side of the world screening the laptop and USB stick. And they did find some older saved files from February, something no one else could do. So I asked him if he had friends in special places, he nodded his head. He told me he had a 24 hour a day business with people in Australia and the US (and obviously China). I asked him who taught him and his “friends” to do all this because they certainly are A grade and he more or less told me the Chinese govt. Ha I LMAO, they’re everywhere. There’s a digital cold war going on and we may have already lost.

    They’ve been pulling the things apart and reassembling them since they were weaned.
    
    (Yonks ago.. I was delivering some of my school’s hockey boys home after an evening game… they couldn’t believe I didn’t have a car radio installed….
    next day (saturday), there’s a knock at my door and young Indian student tells me he’s got a radio to install in my car… so I take him out to the garage and let him start wiring it in…. decide to tell hubby what’s happening (Ph.D – Physics)… Hubby goes berserk, rushes down to the garage… then goes very quiet, and mutters to me… he knows what he’s doing.

    The rules which came into effect on July 1, 2015, residents of Cook Islands, Niue, and Tokelau are eligible for NZ pensions is they were resident in NZ for at least 10 years after they turned 20, and spent at least five of those years in NZ after age 50.
    
    So the rules were introduced under National. Backster, are you saying that these rules have now been extended?

I have been pretty positive about the Lime Scooters whizzing all over the roads and footpaths of Christchurch but after being woken at 4.00 am by a bunch of Lime Scooter employees in the business of very noisily collecting the discarded scooters I am changing my tune. Their response to my request that they quieten down their shouting and just take their scooters in their collection vehicle and leave and stop waking up the neighbourhood was to turn aggressive and threatening. ‘We know where you live’ and all that belligerent nonsense. Upshot is that when I got up at this morning I see my letterbox has now been vandalised. Thanks Lime Scooters

    If they use Bill English’s data idea’s then we should be able to learn a lot more about ourselves and what is needed. GDP is a crock of shit and forever has been.
    Its just a measure of the money go round and nothing else. It doesn’t tell us if we are betting better, if people are better off nor does it tell us as Kiwi’s if we are getting wealthier as a country. which of course we aren’t.

So not much demand for the new Kiwibuild Wanaka homes, to the point that the developer has asked for the time for ballots to be extended. 20 ballot entries received, and some places have no entries at all. It is probable that some have entered for more than one place. This happened with the McLennan development where it was reported that shortly before ballots closed there were 55 unique entrants but 650 entries.

What happens to developers and their subbies if some don’t sell? Is there something in the contract with the government that covers them? If not they, and other developers, will be very wary of further development.

  Amusing artemisia we may well expect there is an option for HNZ to “buy” any of these shiny new houses that do not attract private buyers. Just as we might suspect this would be part of the secret agreement to prop up failing developments. Remember HNZ have an even more direct line to any additional funding they require by doing their own borrowing. No extra funding need be sought from the normal channels but Twyford will sure take credit twice. Firstly for the success of Kiwibuild and secondly for increasing housing stock in which ever order suits the audience he is addressing. The Wanaka failure indicates that in the price point they have ended up rising to there are only a limited number of buyers willing to compromise on location. It is far from their kiwi dream to be surrounded by state houses not only threatening their peaceful dreaming but limited potential resale prospects. That is more like getting on the real estate ladder and moving down instead up the ladder.

What has not been made clear by anyone is if the claim by HDA is totally true. Would the 108 cases be just those case where someone has appealed their deportation? If this case the criminal would have been deported if his lawyer did not appeal the deportation order. Maybe the system needs to change and the Court decides these cases and not a Minister.

Labour and NZF have mentioned cases where the person has committed very serious crimes without giving details. If someone gets here with no passport or is from a country in civil war like Syria they cannot realistically be deported.

  Careful Chuck Bird not to be swayed by HDPA just quoting from the Labour handout she got just like all the party people. Sometimes it is 100 or a little inflated for more impact. The system works fine when used in accordance with the relevant acts with appropriately detailed information passed to the Minister where his decision is required. It can be a simple matter of his sanction for an intended decision of the department that might have complications beyond their level. The key issue is that the Minister must read, comprehend and decide on all the details submitted. Or any additional information he requires on other relevant issues or impacts the decision is made.
  The problem ILG is he made a monumental stuff up for reasons known only to him that may or not have come from the department. His incompetence is his downfall and not the system. There is absolutely NO need for another tier in this process and that is just another example of the Labour type thinking. All too hard so lets have it sidelined to somebody else. Like 150 odd special inquiry groups needed after 9 years of doing nothing in opposition.

I heard on the radio (haven’t been able to find a link yet) that the economy is so bad that NZ is going to abandon the GDP measure and instead use “well being” to quantify how well we are doing???

Gee, that would translate into real life well. Kid not doing too well in school? Let’s ditch NCEA and just concentrate on what his manners are like…

Let’s just abandon the standard of measurement that every other country uses if we’re doing badly.

As Ardern flails about now trying to blame the quality of information, or lack of it, in the Sroubek saga, one should also remember the absolutely adamant support of Winston for Ardern as well as Lees Galloway.

The Deputy Prime Minister has voiced support for the Immigration Minister over his decision to grant a convicted criminal from the Czech Republic residency.
Winston Peters says he has reviewed the case and is comfortable with the outcome, telling RadioLIVE that criticism over Minister Iain Lees-Galloway’s decision is unjustified because people don’t know the details of the case.
[Winston so loves knowing anything he can tell you – you ignorant pleb – that he knows and you don’t ]

Mr Peters pointed to the minister’s right to make decisions with “absolute discretion”, which means he does not have to provide a reason for the decisions he makes.

The deputy PM said he’s read over the case and is fully satisfied with the minister’s conclusion.
“There is an enormous amount of precedent for a minister to make a decision like this, and one of the things that is bound with the decision is the privacy issue, because it goes to the very safety of the people involved,” said Mr Peters.
“Do I like it? No, I don’t. Do I understand it? In the circumstances, yes I do.”

It is of course worth comparing the decision in Sroubek saga with the decision of banning of gas and oil exploration, which was more premeditated than most think, when you remember the Ardern placard Greenpeace displayed on the steps of Parliament. But trying to blame the quality of information, or lack of it, in the decision banning gas exploration is immaterial, since no information whatsoever was sought !

The policy was apparently agreed at a confidential meeting of three MPs, and then announced. The three authors were unaware that their covert plan was (a) illegal and unenforceable and (b) financially and environmentally disastrous – because all the normal protections for bureaucratic advice were by-passed. No formal consultation was undertaken with the industry or anybody else. The plan was not considered by the cabinet or any other constitutional organ of government. This was the worst example of autocratic and unaccountable governing since the days of “King Dick” Seddon.

So Grant Robertson has promised a Wellness Budget for 2019.

This is code of tax the rich pricks and the middle class and give to the lazy and slothful. Along with the Tax Working Group this will see the largest transfer of wealth in the countries history.

For the past 40 years Labour has been operating a Communist policy by stealth. Slowly but surely it has been ensuring more and more citizens are reliant on the State for all or part of their income and support.

Even to the extent of taking taxes off them only to return them after incurring significant costs to do so. Think WFF.

But the Nats haven’t reversed any of this and wont reverse any of Labours future actions.

This is because to do so would consign them to the Opposition benches for a long time. As the saying goes turkeys don’t vote for an early Xmas.

So the rich will move their capital and income to countries with a less punishing regime meaning the Government wont get any tax. Think Michae Fay and David Richwhite el al.

The plan is to move all citizens to a low income base with the Government deciding who will get more and who will get less.

The trouble with the Nats is they took too long to implement and then found themselves in opposition. No time for pussy-footing around, jump straight in and get the job done. Having just spent two weeks there and some time talking lots of people I reckon that the Repubs will fly in.
Detroit which has been very depressed is growing again and building and rebuilding is massive. All the car companies are rebuilding plants there. People are happy because they are working.
At a conference with small business people from all over and the common theme was “can’t get staff”. Have we not heard that here.
Unemployment is down to 3.7%.
Wages are rising quite quickly in many area’s although some inland companies are still trying to get staff for $10 and hour. Not succeeding though.
Ford have just bought the Central Rail Station building in Detroit and are spending a fortune revamping it to house 5000 new technology workers for their plans. Google just signed a deal with Chrysler in Detroit to build 60,000 driver less cars. Not a small chunk of change.
What do you think those cars are for?

Philadelphia is much the same. the inner city is full of building refurbs for apartments. again staffing is an issue.

People happy and no problem walking around day or night in the city.

Airlines busy as anything. Planes full.

Was there any mention of the 2.7 million vacancies that proving hard to fill at the gathering? Opportunities abound so it is critical that the Immigration policy is sorted soon so they attract the best that can be had to fill those gaps being generated by such rapid growth. Imagine a good IT prospect considering to opt for USA on the rise or NZ on the slide. Or a capable untwisted teacher for that matter. It’s a no brainer.

  Clearly the woman was foolish and impulsive. The driver failed in his duty of safety to his passengers. (He’s getting assaulted but continues to try to drive at the same time.)
  
  Mind you, the driver did steer to the left for no apparent reason, so maybe he had intended to commit suicide and the woman had noticed that something was wrong.

What a surprise, a media nobody stating the minister must go but it’s not really his fault.

According to reports, he spent 8 minutes with the file, probably had a coffee waiting for some serious treatment.

I very much doubt the the file was scarce especially as the Dept recommended deportation. The previous minister had not seen the file as deportation was the decision so why bother the minister. Who requested that the decision be reconsidered and why? That is a more pressing issue and perhaps the dept thought anyone with half a brain would endorse their decision so kept only the pertinent points on the front page, because that is all he gave himself time to read.

If there is an error by the department it is that…they incorrectly assumed that their minister had more than half a brain.

  But the department did NOT make a recommendation to L-G – they never do. They provide the decision-maker (whether a departmental senior officer or the minister) with all the information pertaining to the case but do not express an opinion. This has been the case for many, many years. The decision was Lees-Galloway’s to make based on his interpretation of the facts. Neither he nor Toothy can blame the department for giving them an incorrect steer.

    They may not physically make the recommendation but as the sentencing judge already had the default action was deportation, at least that’s why I have been led to believe and trust me, the “minister” does not make these decisions on his or her own.     Partly right Kabull but Michael Woodhouse explained the real path it takes through two other Government official on it’s way to the Minister. It is not just a direct simple handing it over from INZ to the Minister. Thus it makes the COL look even worse apart from suspicions that another unofficial third party “guided” the Ministers strange quick decision. It is staggering to even imagine they were so stupid to assume it would just slip past any public scrutiny. They must feel almost bullet proof by being so well protected by the Media party. It has ended up again with another self-inflicted cut that will lead to their downfall helped in large part by ignoring or being ignorant of the the established Parliamentary process. It also blows their attempt to through the department under the square wheeled bus especially as at least 2 other officials already distance the Minister. He stuffed up end of story.

Merkel or Hitler – who was worse for Germany

With the news this week that Merkel’s iron grip on the German political scene is broken, it seem apposite to consider her legacy vs Germany’s only other significant leader in the past 100 years.

I know that the “feelingz” brigade like SB, MM and M will be losing their collective hysterical marbles over this comparison but no other German leader has come close to having the shattering effect that Merkel has had on Europe in the past 100 years.

Who has done more damage to Germany?
On this one I have to say Merkel wins hands down, she started off so well presiding over the highs of the successes of re-unification – I for one thought that Germany was going to be carrying the DDR cot case for several generations but miraculously the united Germany just went into high gear. However, her insane mass importation of sub-humans from sub-Saharan Africa looks set to tear Germany apart. Everything that made Germany so powerful on the world stage (even though they were sans the nuclear arsenal usually required) is being watered down. The social cohesiveness is gone forever and the creeping influence of Islam will constitute an incurable social cancer that will destroy Germany from within. Given how quickly West Germany bounced back from the Hitler years, where the damage was really only to bricks and mortar, Merkel is way out in front in this regard.

Who has done more to damage Europe?
Again, while there was a massive loss of life in Europe as a result of Hitler’s tenure and it triggered the Cold War, at least it was over by 1990 when the Berlin wall came down and Europe blossomed into a new age soon after the 50s ended. Merkel’s leadership brought in massive social disharmony across the continent. I would go so far to say that she was the catalyst that pushed Britain over the edge into Brexit far earlier than it would if Merkel had been satisfied to follow the hithertoo largely successful strategy of creeping federalism. If she’d stuck with just settling for taking an inch every few weeks, her federal European dream would have been realised and it would have been her greatest legacy. As it was Britain is going and much sooner than it might have happened (if at all). Brexit and the subsequent flourishing of an independent Britain will trigger hope from the sane in Europe that they can escape to a brighter future. Merkel’s legacy will be that she tore the EU dream apart, Hitler created the context that gave birth to that dream. There is no end in sight for what Merkel has done to Europe – the continent will suffer for her vanity for generations now.

Other areas?
Largely, it’s a tie. I find it hard to tell the difference between the rise of brown-shirted left wing fascism under Hitler and the rise of black-shirted left-wing fascism under Merkel. They tie on the strangulation of free speech. They tie on the massive use of propaganda to hide the truth from the population and to brain-wash the populace. And finally, there’s a tie on loss of democracy, I see little difference between the effects of unelected EU mandarins and the early days of Hitler’s dictatorship.

The real winner however, are the German people who saw the danger of another Hitler in the making and they booted her out before she hopped off the democracy bus like her mate Erdogan has already.

Merkel wins by a country mile – but only if you are interested in the long-term effects and the facts.

If you judge things by “the feelz” then well you’d better resort to ad hominem attacks – hadn’t you?

Dear Stuff

Your website, and your company in general, is pants. Please allow me to indicate where it has gone wrong:

– too many ads. This leads to slow loading, incorrect by-line loads and fishing in the extreme by you into my PC.
– sub-editors who can’t spell, providing links to stories by contributors who can’t write. Seriously, so many stories have double entries, poor spelling, incorrect links and headlines that overstate a minor component of whatever the article is about.
– very little actual journalism. In contrast, there is a lot of opinion, deliberately written to influence the public, as well as lots of stories about stuff no-one cares about. No-one really cares that Wendy Petrie is 50 or that Jason Gunn repeatedly tries to mutilate himself via household implements.
– over-zealous comment control, yet paradoxically coupled with promotion of discord between opposing political views. For example, most opinion piece comments get shut down when their utter stupidity becomes apparent, yet on some reports of current issues (eg. JLR, HideAndSeek loser ILG), you allow comments that are irrational and simply ridiculous from both sides of the fence.

These are some of the issues that are immediately apparent. There are many others, much more serious in nature, which will hopefully come to evidential light soon.

You can take heart though: NZME is just as bad. No wonder the CC knocked back your merger.

  I’m spending less and less time on Stuff now. I run down the headlines and gag at most of them, scan one or two articles to glean what few hard facts I can, then leave for somewhere that offers harder, better edited, more authoritative news – the Daily Mail, for example.

And whomsoever asked if I was planning to run for office? Yeah. One day I’d like to come back and give back to the country that gave me so much for the first 37 years of my life.
But I’ve got a lot to do here before I do including becoming a dual citizen, finishing some writing projects and raising said five kids. I’m a great believer in having adequate life experience before you’re a suitable candidate for office.
In the meantime I’ll continue to be opinionated and amused across many forums.

They say the law (2002) would ‘help redefine the role of women in society’
I’m scratching my head.

  All laws are reviewed by the Ministry for Women for bias agianst women. By default laws are neutral or biased agianst men.
  
  The Law Commision is playing two roles here. It uses our natural instinct to protect women and it’s protection of the Law industry. In the 2002 change under Clarke and probably the worst man hater of all Wilson, we got the simply abhorrent injustice of pre relationship asset theft that overwhelmingly benefited women. The presumption was women could asset strip males and lawyers would be engaged in the resulting fight asset stripping both parties. The end result however is women are getting preyed on by the false love sexual predator as well, some judges, lawyers, and people with influence. 14 years later the current law became unsustainable and a review was asked for.
  
  Be scared however.
  The new law fixes the pre existing asset flaw but cements and introduces more anti male bigotry and increases conflict for the legal parasites to feed on.
  Alimony for stay at home mums.
  Plus 50% for the custodial parent.
  Automatic, get the house for the custodial parent.
  Best interest of the child principles, which is code for best interests of the mother.
  
  This adds more incentive to reject males from parenting roles as the financial rewards can be huge.
  It adds more incentive to have a child without consent of the man.
  
  Custody fights will merge artificially with property fights.
  With men presently getting custody in only a tiny percentage of disputes the desire to reject consential shared care will be maximised when relationships end.
  
  Lawyers will see increased workload. Men can easily be strung along by the legal system for $100,000 just trying to see their kids every second weekend. And they have done nothing wrong to deserve it.

The chief constable of Hampshire police pretty much nailed it last week. Objecting to the pressure put on police to pursue an ever greater catalogue of hate crimes, Olivia Pinkney said, with a succinct lucidity that professional commentators might envy,

“…there are lots of horrible things that happen where police are not necessarily the first or best service”.

In other words, not everything horrible that happens is a crime. Language that is hateful, behaviour that is hurtful (or even frightening), attitudes that are cruel or unjust, are deplorable but they are not – except in a metaphorical sense – criminal.

  Will they give male MP’s a suit (uniform) subsidy as females get to use normal clothes.
  Will male parents get a free parenting course as Plunket refuses to deal with fathers.
  Will males get a viagra subsidy.
  Will male DV victims get free passes to stay at Women’s Refuge as the footpath is the present option.
  
  Make the $2.00 budget version tampons free then. But only at schools. The financial burden is obscene, help the ladies.

    Of course making the government funding of a $5 per month expense is going to end up costing the taxpayer something like $10 per month.
    
    There will have to be a Department of Sanitary Products with expensive offices. They’ll commission that “artist” who did murals in her own menstrual fluids to do a $350k panel.
    
    There will be a separate funding for a Commissioner of Maori Periods.
    
    Trannies (male to female) will be given tampons so their feelings are not hurt (as well as offers of a pap smear).
    
    Trannies (female to male) will not get free tampons because we don’t want to hurt their feelings. No pap smear for them either. They will get prostate checks if those ever get the same degree of support.

      Possibly but although I think it’s a hare brained idea offering a solution to a problem that doesn’t exist the actual distribution will probably be put in the hands of the various ‘family planning’ clinics who already hand out free contraceptives.
      
      If they’re not delivered door to door most of the intended recipients are too fat & lazy to walk to the nearest clinic so all may yet turn out well.
