What a tangled web we weave when first we practice to deceive.

This debacle over the Labour Party’s handling of the ‘alleged’ sex pest in the Prime Ministers office, employed by parliamentary services yet apparently well connected within the Labour Party is now in the public domain, and is getting some serious legs.

Andrea Vance and Alison Mau have now come to the party, https://www.stuff.co.nz/national/politics/115652892/labour-took-six-months-to-investigate-serious-sexual-assault-complaint and their summation of the omni-shambles that this has now become is somewhat precise. Mike Hosking’s interview with the Prime Minister this morning was scathing, and it’s fairly certain that the princess of posidividy is not enjoying her media engagements this morning. The timing of the Spinoff article release the day before Jacinda’s Tuesday media rounds is devastating.

Nigel Howarths role at the centre of this lunacy is pivotal, and if the Spinoff’s information is correct, then he must go.

Then we have to ask the question if the manner in which this very serious matter was managed is through incompetence or by design. Either option is unpalatable.

The fact that the complainants testimony was never passed back to the complainant for verification prior to it being considered as evidence immediately nullifies any decision made by the committee. This is exacerbated by the fact that the testimony was given to the alleged perpetrator prior to the conclusion of the process, but not passed back to the complainant until after the decision was made, and after the email from Howarth that there would be no right of appeal! Howarth then disappears for 5 weeks!

The complainant even asked Howarth if she needed a lawyer, and Howarth said she didn’t. A first year law student would have ripped this process to shreds! Howarth is either stupid or disingenuous, and he must resign.

Is that how the Labour Party do stuff like this? Party first, justice second?

Abysmal, just abysmal!

  Well that is the way they run their Party behind closed doors. It is all closed doors for them. Just think how they are running the country. It certainly is not out in the open for all voters to see. Secret squirrel every one. The hypocrisy of Labour is just absolutely appalling.     I agree, but it needs to be determined at what point the sexual assault testimony was sanitised from the ‘transcript’ and then submitted as evidence without first having the evidence checked and annotated by the person making the statement in the first place. It then needs to be determined, on the balance of probability, if this sanitising was deliberate obfuscation or incompetence.
    
    Either is disgusting, but given how this is being presented, I am sadly inclined to lean towards the former rather than the latter.
    
    Then we need to look very carefully at Section 71 of the Crimes Act.

And, in the “unlikely” event they knew something, no-one bothered to tell the boss ? Yeah right. I get the Mule (sefl-mod) Communist PM is a part Time PM, but surely no-one from labour HQ had an opportunity to mention this to the (self mod) toothed communist PM at all ? I cant belive that.   What about the PM’s culpability?
  She seems to have been aware at a very early stage their was a big problem with a staffer. He was her staffer in her office precincts so its was her duty to protect the complainant and to call the Police as the allegations were serious.
  
  Ardern cannot absolve herself from responsibility by saying it is a “Party matter”. It’s a Police matter.

  The Standard locals are annoyed that:
  1. This is a public matter;
  2. Jacinda is wasting her “political capital on dealing with this issue” (demonstrating to all of us, why the Labour Party can’t even run a party in Waihi with matters getting out of hand);
  3. The media (and in particular Hosking) for not being sympathetic to PriNZess.
  
  What the dumb Standard Locals don’t get is:
  1. This is 2019, you don’t bully, harrass or assult people in the workplace;
  2. You don’t do a snow job, and blame the people reporting the incidents;
  3. You don’t lie to the victims and then try to prevent things going public;
  4. You don’t try to bury criminal activity; and
  5. Your opponents will make hay out of the opportunities presented to them, so rather than attack Bennett, they would be better turning their anger back on Ardern for her lies and covering for the “Staffer”; Hawthorn for his ineptitude; and seeking answers as to how they plan to improve things.
  
  Beca use their blaming everybody else for their party’s stupidity, makes themselves look stupid.!!!
  
  PS. Fools at the Standard, PrNZess’ fairy dust is gone and her crown looks like a cheap plastic job from a $2 shop! She is a part-time PM, and through her own lies she will be history.

    Sadly, the legal definition of ‘rape’, as defined in Section 128 of the Crimes Act, is the penetration of the vagina by the penis without consent, so, legally speaking, no rape has occurred.
    
    This is more accurately legally defined as ‘Unlawful Sexual Connection’, which is subject to the same level of punishment as is applicable for rape.
    
    Although it’s a legal term rather than an emotive one, it does tend to sound as if the assault has been minimised. “Oh well, it’s not like someone has been raped!” Yeah, a man can anally penetrate a woman with his penis without her consent, but as long as he doesn’t penetrate the vagina, he ‘legally’ cannot be charged with rape!
    
    It’s a very strange part of NZ Law, and one that probably needs to be changed!

  The papers are still not digging to the real issues:
  1) These are criminal matters, not Party matters. The Party should not be investigating. Handling these as internal matters is a perversion of justice which is, in itself, a criminal matter. Why do they think they are above the law? Why has plod not been around?
  2) Why is a serial cock-up artist like Haworth still in the picture? Does he know where all the skeletons are?

        They will have seen what happened to the two girls who were brave enough to make a complaint about their being sexually assaulted at the Young Labour drunken party.
        His lawyer said about one of them that it wasn’t a sexual assault because “she wanted it”. Would you go to the Police after something like that, knowing that the Labour Party would rip your reputation to shreds?

    1. Of course she knew. Paula Bennett discussed it in the house. Every main news channel discussed it. Adern herself was questioned about it and said the process hadn’t been handled well, and it would be reviewed.
    
    2. Even if the complaints weren’t sexual in nature, but “just” assault and bullying, she should still have done something earlier.

    I am old enough to remember the Watergate affair. At the time I followed it with a great deal of interest as I found it very hard to believe that Nixon could have been so foolish in his actions.

Sorry sweetie, when your own people lie to you then it is because either:
A) A fish rots from the head. They have watched you bending the truth so much that they follow your lead and lie too. You have grown up in the company of truth benders and surrounded yourself with truth benders. It is all down to your leadership.
B) Plausible deniability: You ask them to shield you from the truth because you don’t want the hard job of leadership and decision making.

Either way, it’s incompetence.

  Not good enough at all. Even if as she asserts
  she wasn’t told she should have probed, asked, sought reassurance – that is what a Minister, let alone the Prime Minister, is supposed to do. Why didn’t she challenge her advisors at the beginning and especially so after the Party’s handling of the Young Labour camp mess.

  however Option
  C) Those in the party know she is incapable of making a decision, she is out of her depth and pretty much useless, so they figured no point in involving her cause she will just nod her head & say nothing, so they figured they would deal with it themselves
  D) She is hardly ever there #PartTimePM, has little interest in actually making decisions cause “they are hard” & even when they did tell her she was too busy preparing for a fluff piece or photo shoot that she just nodded, said Um Ahh about a dozen times, said “Look ….. Look…..Absoludely” and did nothing

Last night I was reading KB re: the spot of bother that Jacinda and the Labour Party are in. Oh dear never mind!

However, while looking at at KB, Maggy Wassilieff had posted a link to TDB and a blog post by Chris Trotter, suggesting Jacinda has 24 hours to look decisive (that’ll be a first), but what caught my eye was a post by Bradbury – which I thought was a good piece of fun…..

The government has announced it’s plan to get 1 million Kiwis speaking Te Reo by 2040. Mostly I just regard this as a pointless and futile waste of time and resources. But there was one point that seriously pissed me off;

Other priorities include: getting more New Zealanders to value te reo Māori

No. Just absolutely no. It is not the government’s place to tell people what they should value. That’s not how democracy works.

A government trying to tell voters what they should value is getting things arse-backwards. In a democracy people damn well get to decide for themselves what they value, and elect a government to implement policies that fit those values.

Government money should not be being spent on shoving blatant propaganda down people’s throats.

    The elders spoke against Te Reo as the way ahead 80 years ago when they sensed their people would move into the cities. The language is primitive and was suitable for 1835 use but not later. Some cultural matters are dealt with on the marae by assigned people. Other Pacific Islands like Samoa, where the Palangi population is insignificant, have developed their language but have been taught English as well.
    Te reo is too primitive now to be developed.

      I heard it is possible for people to speak two or more languages. In Singapore and Switzerland this is compulsory. I don’t expect this mindset to take off in NZ as these countries are much more advanced.

        That only has value if there are significant populations which don’t speak the most common language. Sure in Singapore there are enough people who don’t speak English that there is value in knowing Malay, or Cantonese, or Tamil. Likewise in Switzerland there is value in non-native speakers learning German/French/Italian.
        
        But in New Zealand the number of people who speak only Maori is insignificant, if there are even any left. As a functional means of communication, learning Maori has exactly the same value as learning Klingon.

    Urban Maori youth don’t seem to value Te Reo either.
    They have developed their own style, based on US black urban culture. They seem to take great pains to sound like the character voiced by Taika Waititi in that Thor movie.
    
    Oddly enough, the ethnic-Chinese youth who have grown up in this country all sound exactly like white Kiwis.

        On YouTube, the Americans frequently comment about the Taika’s Thor character voice as having a “New Zealand” accent (when it is really an urban Maori accent).
        
        I suspect that the next Caucasian or Asian New Zealand character in a Holywood movie will also have that same accent, as it is now what American audiences have grown to believe New Zealanders all sound like. Answer: If you teach them the scientific facts instead of the alarmist lies spread by the environmental swamp, children would be concerned but not scared witless. That would set a sensible basis for discussing adaptation pathways over the lifetimes of the children and their descendants.

    SJ Actual: Ms Ardern’s mispronunciation of the English language (especially her constant use of the letter “d” in the place of the letter “t”) creates a very poor example for young people who grow up and develop their own speaking styles and habits, substantially, from people in the public eye and news media.
    
    Our PM could fix this personal idiosyncrasy readily by (a) obtaining some decent / honest advice from Party colleagues around her; (b) engaging a top speech trainer; and (c) doing the hard yards of practising repeatedly the correct pronunciation of the letter “t” .
    
    But our PM, not the most industrious person at the best of times, lacks the personal determination and energy to rid herself to this minor-but-important personal distraction. Our young people, in particular, deserve better from a public figure whom they seek to emulate.

Ardern has had a couple of trainwreck interviews this morning. She says she has taken control of the issue, and that had she known about the sexual nature of the allegations, she would have acted.

She was told five weeks ago that the accusations were sexual in nature; the stories were all over the media, and complainants had taken their complaints to Paula Bennett. If the PM was going to be the one to sort this out, why did the complainants not go directly to the PM.

Yes, she has been let down by the party, and MUST demand the resignation of senior party officials including the President, Nigel Haworth. But that does not excuse the fact that Ardern presides over a party that has given serious sexual complaints the once-over-lightly, because of the importance of the alleged offender to the party.

This is an indictment on Labour, and an indictment on Jacinda Ardern, leader of the Labour Party.

    The issue is that Haworth as president is elected by the party, so Ardern cannot simply sack him. She can publicly express no confidence in him (as she almost did this morning with Garner), and she can suggest to him in strong terms that he resign, but if he wants to stay on in spite of that, he can.

      She didn’t deny it completely, but qualified it heavily with “what she had been told.” Everything she said was qualified when challenged by Duncan, in the same way. While I do believe she is misleading on some aspects, a lot of the interview I felt was a waste of time due to her lack of knowledge.

    Then, i listened to her interview with Hosking. Once again, it was one contradictory lie after another.
    
    For example:
    “We appointed a QC 4 weeks ago to investigate serious allegations”
    
    She claimed
    “The first she knew of the sex allegations, was yesterday when she read of the in ther Spinoff”.
    
    What a lie!!! Doesn’t she listen to or read NZ media

    So, under her “No Surprises Policy”, we are meant to believe everybody lied to her, when she asked them a question.
    
    It appears, Jacinda and the Labour Party operator a policy of “Plausible Deniability”. The only problem for Labour they didn’t make sure they had control of the story and events. The result is they are now reacting to what has been published, and are making matters worse through:
    Obfiscation;
    Half truths;
    Lies; and
    outright denials……
    
    The result, Haworth will be gone for a price and Jacinda will have another start to a new year looking like she is managing a shambles….only it will be election year…..oh dear how sad, never mind!!!

Re the LP sexual assault claims, it has now got to the point where the public need some clarity over several contradicting issues.
The PM claims that she only knew of the claims 4 weeks ago and immediately engaged a QC to investigate. In the next breath she advises us that the alleged perp has not been in the Parliamentary precinct for 5 weeks. When a critically important member of the Leader’s office is vanished from sight (site) and the Leader doesn’t notice or her COS does not brief her, there is something highly dysfunctional about how the country is being run.
The PM has dodged the question about who told her what, she mentions ‘the Labour Party’ at every turn as if the Party is a functioning organism seperate from the individuals who interact with the PM. She knows who briefs her and who tells her what but is trying to get cute when this is the time for truthful clarity.
The PM claims that there has been no formal complaint made, hence no investigation by Parliamentary Services, the Speaker’s office, or Police. It has been clearly claimed that at least one victim made formal reports to functionaries in the Leader’s Office and that formal interviews were conducted. Even a bear of very little brain can connect the dots between these uncontested events and the ability of any one of a number of people to refer the matter on to PS or Mallard, or Police. You can only conclude that a conscious decision was reached to keep it all in-house in the LP and go into stealth mode. That this was done relative to an employee of PS. Is bordering on criminal, certainly is amoral and cynical to the point where words are starting to fail me.

On a related (sort of) matter:

Last week a jury in Auckland found a taxi driver not guilty of a crime against Jay-Jay Feeney, an apparently popular broadcaster.

I’ll repeat that: he was found not guilty.

In post-match comments Ms Feeney told Anna Leask of The New Zealand Herald, who breathlessly recorded:

“I am absolutely dumbfounded and devastated,” she said.

“I stand with all victims of sexual assault who have never been believed.”

Cleverly, Ms Feeney has turned herself back into the innocent, disbelieved victim rather than a complainant whom a jury did not believe.

The man must be guilty, of course he is, is the subtext.

After all, he is brown, has a brown man’s name (that means he must be dodgy), and so all brown men with brown men’s names who drive taxis are prone to letting their hands get a bit gropey when they have a peroxide blonde woman riding in their vehicle.

How impertinent of the bloody jury to believe a brown man with a brown man’s name and who thus by definition must have gropey hands instead of a middle-aged white woman with peroxide blonde hair who works in radio and is ‘known’ to thousands.

This is subtle racism.

It is made worse in Stuff – that bastion of rampant and shrill anti-racism these days – in a piece penned by Michelle Duff.

She continues the ‘she’s the real victim here because she is another real victim woman’ theme.

Remember? The brown man with the brown man’s name – Baljeet Singh – and so must be dodgy with gropey hands was found not guilty of the crime.

Yet white, middle-class women with media power and influence at their fingertips continue to disregard the verdict and portray him as a villain – because he is brown with a brown man’s name, probably an immigrant trying to earn a living far less than privileged white women with media power at their fingertips. He must be guilty, eh.

      The British Parliament is a real mess. What’s the point in attempting delay after delay–the people need certainty through Government. At times it look like a bunch of headless chooks in charge.
      
      The EU have done themselves in. What started as easing commerce has turned into rule by faceless unelected officials in Brussels. Britain and Europe have been at war for centuries so this was continued by proxy. English waterways were not allowed to be cleaned by edict of Brussels–the flooding was horrendous. The Roman law legacy of Europe doesn’t mesh well with the Magna Carta freedoms of the British.
      
      Commerce can always be renewed but not the remote controls.

Barry Sooper says some questions the Herald asked the Police were declined in regards to the alleged offender in the second complaint due to Section 6 (c) of the Official Information Act 1982
… if the making available of that information would be likely—
(c) to prejudice the maintenance of the law, including the prevention, investigation, and detection of offences, and the right to a fair trial; or …

Is there not other but similar law relating to other agencies interfering in Police inquiries?
Did not the earlier Labour Inquiry into the Summer Camp issue have to avoid any issues the Police were investigating in the same matter?
So what is the legal position of the QC whom Ardern mentions –

Ardern was grilled by Mike Hosking on Newstalk ZB this morning in which she said the party had bought in a QC four weeks ago to help her get to the bottom of the employee’s complaints
“I absolutely need to be the one to fix it and that’s what I plan on doing“

When Ardern has directed the New Zealand Council of the Labour Party that they are not the appropriate body to investigate a sexual assault complaint, why is she undertaking to do that herself?
Is she not already in a position of prejudicing the Police investigation or perhaps a fair trial?

Ardern has form for protecting “alleged” sex pests/ offenders and assorted pervs amongst her coterie, on the other side of the house a National party MP got the arse card for saying “do you know who I am”, Collins got demoted for holding a glass of milk.
The reality is that every member of this coalition of the Damned is in way over their capability and competence and earning way above anything they could demand in the private sector and there is no way they would have the gumption or honour to relinquish their unearned status.
