One of the eye-opening revelations of the last few years is the power of governments to totally co-opt the media to their cause. In America for example the Democrat party have totally captured the media so they don’t report on issues like chaos at the southern border. When Trump was in power the media were all over suffering at the border. Headlines read “Trump puts kids in cages!” Even though the cages were constructed in the Obama era. Now millions of illegal immigrants are strolling across the border and no one cares. Internment camps are full to overflowing. But the media are just not concerned.

We see this same phenomena here in New Zealand. John Campbell wept on television at the plight of the homeless when National was the government. Now there are more homeless people than ever before. People are crammed into motel rooms for years. Where is John Campbell? Nowhere to be found. Labour is in power so move on, nothing to see. Only next year when National hopefully regains the Treasury benches will John Campbell awaken from his slumber and find the homeless again.

The labour government has paid the media at least $55 million to report on issues like the Treaty of Waitangi. If they take the wrong slant they have to pay the money back. I think any incoming National government should take a leaf from the labour playbook. They should put aside $100 million to fund the media. Issues they could report on include –
– the importance of everyone having a job and the dangers of welfare dependency
– why mum and dad and the kids provides the best place to raise children and avoid welfare dependency
– are solar energy and wind power expensive failures?
– Is the planet really warming?
– The importance of equal treatment for everyone regardless of race
– why Western civilisation is awesome and its contribution to raising the living standards of everyone
– should we introduce the free market into education in an effort to raise our literacy and numeracy rates amongst our children?

I could go on and on. National needs to be wise when they next become government. Part of that wisdom is ensuring the message gets out and they get fair and balanced treatment from the media. Let Labour, when they are in opposition, reap what they have sown.

        The story was about Media Works in 2011 seeking (and being granted approval) to defer payments on its radio licenses due to going bust, which was seen, by labour as a loan by government.
        
        So one arrangement was a deferred payment facility, that either never got called or was repaid, and the other is a $55m grant with strings attached.
        
        Totally the same thing!

      I am merely suggesting that a National government recall those loans in terms of the mechanism setup by Labour.

      (BusinessDesk) MediaWorks’ subsidiary RadioWorks has repaid the $32.28 million outstanding on a “loan” signed off by former Communications Minister Steven Joyce that allowed the media group to defer payments to the Crown for radio spectrum licences.
      
      The balance of $32.28 million of principal plus interest was paid yesterday, almost two years ahead of schedule, current minister Amy Adams says.
      
      MediaWorks had originally owed $43.3 million plus GST and had previously made two payments of $11.9 million. The Crown charged the private equity-owned company interest of 11.2%.

      OK, and with some more information I did more searching.
      
      1. The sum involved wasn’t $50m, it was $43.3m.
      
      2. It wasn’t a loan, as in money given to them. Media works owed the government the money for radio spectrum licences. They could either call it in, bankrupting them, or enter into a repayment plan, much like winz and IRD do.

    Parliamentary Law must be paramount superceeding even the Treaty of Waitangi.

    Random T Person – that is the weak point in my argument I agree. However here is the problem. It’s here in New Zealand. It’s in the United States as well.
    When the left get in power they do whatever they want and make huge changes and in this case totally co-opt the media to their course.
    When the centre-right gets in power they operate by the Marquess of Queensbury rules, they leave all of the leftist initiatives intact and they may be tinker around the edges with slightly lower tax rates.
    
    So I agree in principle with your idea of principles. However the centre-right fight so timidly that they end up being good losers. See the problem?

      In fact the Supreme Court has just changed the law to introduce Tikanga Moari as a new “the Law is whatever we want” statute. Formerly Tikanga had to be fair and reasonable and in line with common law, but this was white colonialist oppression.

        I commented on this elsewhere – very mixed feelings about the Ellis decision. On the one hand, delighted that a long series of judicial travesties has finally (albeit belatedly) been recognised and reversed.
        
        On the other, a feeling of dread that there’s now a judicial precedent for a totally BS principle of “tikanga maori”.

  I think the Herald is starting to realise this and changing their tune a bit. More balance of stories and often critical or questioning of the government.
  
  Whereas Stuff appears to be hanging their hat on the Labour / Greens position most of the time with slanted articles.
  
  Stuff is in fact stuffed without the media subsidies and government advertising as they have no paywall revenue stream.
  
  I’m not sure of the relative advertising revenues between Stuff and The Herald but The Herald has become a national news outlet online, rather than just Auckland, so each may have roughly the same advertising base.
  
  But it will be interesting to see what happens with a change in government. Perhaps the Stuff strategy is ‘we can’t do without them’ – not enough competition- so they can’t be allowed to fail and the subsidies must continue for everyone.

Seems like our Supreme Court is very deliberately straying into extreme activism in the Peter Ellis case. This is deeply disturbing. It involves tikanga. They are making up the rules as they go without any legislative framework. They have jumped ahead of the Law Commission who were carrying out work on how tikanga should be incorporated into suitable cases.

The outcomes are obvious. The delivery of the law becomes whimsical, determined by the judge on the day, without a recognised and established framework and without Parliament’s authority. It is a dangerous precedent. It is arrogant and ignorant.

    In Friday’s decision, the Supreme Court justices said the granting of the continued appeal was specifically tied to the circumstances of Peter Ellis, in terms of the public interest, concern and the possibility of a miscarriage of justice, rather than tikanga itself.
    
    But, significantly, considerations of tikanga and Ellis’ continued reputation were incorporated into the end decisions, with each justice dwelling on it in their reasoning. They did, however, say it stood alongside other factors, such as the interests of finality, the weight of personal and public interest, and whether there was a potential miscarriage of justice to be addressed.
    
    Three of the justices – O’Regan, Glazebrook, and Arnold – wrote that while tikanga may be relevant, it “did not necessitate a modification of the test set out”.

    It would seem that in this case a potential miscarriage of justice should to be addressed and considerations of tikanga (the specific aspect tikanga being a right to clear his name or re-establish his mana, even if dead – as mana and reputation carry on in whakapapa, rather than an individual’s life) or simply Ellis’ continued reputation, were only a follow-on from clearing the injustice.
    
    While the contra view is –
    But Friday’s reasoning from the highest court were expected to clarify questions about how two systems and world views could be melded, particularly in the case of Ellis, a Pākehā.
    Even among Māori, there was concern about whether Crown institutions, like courts, should ever be the arbiter of tikanga.
    Because tikanga is an expression of rangatiratanga determined within iwi, hapū and marae. For the courts, which sit within the sphere of kāwanatanga, to adjudicate on tikanga would seem a gross overstep, a breach of the promises of rangatiratanga.
    And after all, 90 percent of judges who would be weighing such decisions are Pākehā.

    Ellis had died before the case was heard. The court had to decide whether Ellis’s appeal should go ahead despite his death and asked lawyers to consider the relevance of tikanga, which held that a person’s mana continued after their death, the mana also applying to a person’s whānau.
    
    In regard to tikanga, the court said it was unanimous that tikanga “has been and will continue to be recognised in the development of the common law of Aotearoa/New Zealand in cases where it is relevant”.
    
    The courts have had regard to matters of tikanga previously but within strict guidelines. Three of the judges decided these guidelines were “colonialistic”, whatever that means, and should no longer apply.
    
    So now we have the courts making up the “rules” as they go along. Any activism is dangerous and should not be tolerated as it means the courts are usurping the role of Parliament and undermines the very core of democracy.
    
    In regard to “tikanga” the activism aspect is multiplied many times because no one knows the definite meaning of the term. It varied between tribes and has been interpreted and enhanced over time. It is corrupting our legal system and should be stopped. There is no place in the courts for indistinct and unknown terms and concepts. More trouble lies ahead.

      The Ellis family knows the definitive meaning of Tikanga, you sound like you want to remove that from them. Activism or not it is timely. Arguably Tikanga was already in existence under the Royal Prerogative of Mercy.
      Prove your claim that no one knows the definitive meaning of the term, a definitive meaning will be tested many times in the future. In many respects, it has been used before to acknowledge the wrongfulness of the wrongly-hanged chief from Opotiki.
      The Haig case where certainly information continues to be blocked by the SG is another case where it may apply, there are others.

    Ben. The allowing of an appeal to continue when the appellant is dead is not normal under British based law.
    
    The appeal here has been bolster by an argument that Ellis mana continues even though he is dead, so under tikanga his family has a right to restore his mana via the appeal.
    
    At least that is my understanding.
    
    This of course is another strand in the attack on Western values in NZ – pushing Te Ao Maori as superior to all else.
    
    IF NZ wants a dead person to have rights in certain circumstances like these before the courts, then it should be via an Act of Parliament, not by Supreme Court jurists deciding what they think should be how we do things.

  In the absence of legislative framework the High Court (and above) have to fill in the gaps – they always have done. If Parliament does not like it, then Parliament can legislate accordingly. Not sure how ‘tikanga’ is involved in this case. One could argue that there was ‘extreme activism’ when the case was originally tried and the sort of expert evidence advanced and the way evidence was adduced from children. These were areas not legislated for.

  Surely an Appeal is to question whether a miscarriage of justice occurred.
  A consequence of a successful appeal is that the appellant’s name is cleared.
  The aspects of tikanga that may have paralleled this case is then that it restores the man’s mana, or clears his name.
  Tikanga offers nothing ’new’, it just augments the obvious.

    Sadly, in this case the appeals process was exhausted for Peter Ellis. He served every day of his sentence, and later died. The law in New Zealand is that a dead person cannot appeal their conviction, and the only way that this appeal was allowed was to introduce a complete non-sequitur: that Ellis’s mana must be protected, even after death.
    
    So unbidden, and unasked for by either the appellant or the Crown, the Supreme Court decided to introduce a new concept into the justice system, one which puts as at the top of a very slippery slope, and gives it a good push.
    
    That’s not only new, it’s terrifying. The obvious was to recognise that no crimes of the nature alleged ever (or could have ever) taken place, and that Peter Ellis is the victim of egregious miscarriages of justice at every stage of the process. But they left it too late.

    Was reported the crowd was 34,000 but they sold 40,000 tickets- so 6,000 at least bought a ticket and didn’t bother? Maybe corporate tickets.

  I’m a 50 year Liverpool supporter. We’ve had a great few years but something isn’t quite working. Salah is off his best, the defence is leaking like a sieve. Mane is missed obviously and I think they’ve changed their system to accommodate Darwin Nunez as an out and out striker.

The media seem to be rushing to explain that the Local Body results didn’t have a high enough voter participation to show that it wasn’t a vote again Labour.
Of course, the sixty percent that didn’t vote could all be Labour voters withholding their votes to show that they think there should be small tweaks, to the way we are being governed.
Or, they could admit that they have been failing to reflect the true feelings of the electorate.
However, if National do succeed at the General Election, this fault will be instantly rectified.

        IMO, most of us, including myself were inclined to vote one way or the other in order to send a message to our National Govt that all weren’t happy in the land of Hermit Peasants.
        Maybe if those standing for election had some charisma and presented alternatives in such a way as to attract votes, we peasants would have turned out in mass to vote for those presenting the best options and clear unbiased avenues ahead.
        However, that didn’t happen and the peasants who did vote voted along Political Party lines.

  A huge number of people are not interested.

  Maybe, just maybe, the voters of Invercargill remember how Marcus Lush treated any dissidents who rang his talk-back show during the pandemic. He showed his true colours – abusive of anyone not towing the party line, & was given to prolonged monologues about the effectiveness of the vaccine. He refused to let anyone give their own opinion on anything to do with the management of the pandemic – in short he adopted a bullying, hectoring stance.
  Now, why would you vote for someone like that?
  I am not the only one who noticed how agreeable he became when he was in line for the mayoralty.
  And I heard on the radio yesterday, that he would often leave Council meetings early because he had to go to work, and that he planned to keep his radio job even if he became Mayor – so, two part time jobs!

Once again a panelist on ‘The Nation’ has reminded me I am responsible for New Zealand’s terrible record of violence against children.
I am unable to remember any occasion when I had any involvement, or knowledge, in any such behaviour.
However, it must be true because whenever the subject comes up, I am reminded it is the case.

    Do you think a State Surgeon General just does this for shits and giggles? Do you not understand the concept of balancing competing risks?
    
    Here, I’ll make it simple for you: the risk of getting seriously ill or dying from any variant of the C-19 virus for people aged younger than 40 is almost zero – vs. the elevated risk from normal of heart and other problems in that age group who take the vaccine. It’s that simple.
    
    Oh, and obviously the whole argument about getting jabbed so as to prevent transmission – even if you’re not much at risk from C-19 yourself, the “selfish people” argument – collapsed back in early 2021.

    Just an addendum. I got sick of it about 6 months back, but I devoted about 40 – 60 minutes per day for 2 years reading all the data analysis I could on COVID and the vaccines.
    
    On balance, I decided to get the vaccine, because of my age and some underlying medical conditions. That is my choice alone.
    
    However there are two trends in the analysis that the New Zealand Government has never admitted.
    
    Firstly, most of the vaccinated become infected and are highly contagious. That made a nonsense of the vaccine passes and mandates in New Zealand.
    
    Secondly, there is a small but statistically significant risk of myocarditis to young men who are vaccinated.

Florida’s state surgeon general advising against 18-39 year old males getting jabbed.

analysis found that there is an 84% increase in the relative incidence of cardiac-related death among males 18-39 years old within 28 days following mRNA vaccination. With a high level of global immunity to COVID-19, the benefit of vaccination is likely outweighed by this abnormally high risk of cardiac-related death among men in this age group. Non-mRNA vaccines were not found to have these increased risks.

As such, the State Surgeon General recommends against males aged 18 to 39 from receiving mRNA COVID-19 vaccines.

Here in NZ they are still pushing it onto little children. Whoever is responsible should be on criminal charges and facing jail time.

    It states clearly These data are preliminary and based on surveillance and death certificate data, not medical records.
    
    But this is more honest than the outrageous lies and distortions of data we have been battered with for 3 years. Like vaccines having 95% efficacy. Did you see the articles in both $$tuffed and the Ferald in the weekend re ‘maybe the reserve bank governor is going too hard to pull back inflation – may cause hardship’.

Straight out of Ardern’s PR office to MSM media, trying to justify more loose fiscal policy by her government. Not a mention in these articles of Robertson continuing to fuel the fire with irresponsible and wasteful spending on upcoming election bribes. Just trying to blame it all on Orr and his interest rate rises.

Robertson and Ardern have truly backed themselves into a corner both from a budgetary point of view and how they are going to pay for all the bribes and exercise responsible fiscal management, as well as announce tax cut bribes.

I guess in the end they will use the excuse that Orr has the remit to control employment levels as well as interest rates and instruct him to put the brakes, in election year, on the interest rate rises.

All very predictable.

I remember when

Getting hard to see the good for the trees: Keith Woodford.
According to MPI website, we already have 10.1 million hectares of forest of which 8 million hectares are native forest.
This means 30% of NZ total land area of 26.8 million hectares is already in native forest.
There is a need to recognise that planting natives is not a paying proposition and unlikely to happen unless publicly funded.
The exception for native establishment costs is where regeneration is feasible based on existing seed stock in the soil.

PayPal has just changed their terms of service. And this change doesn’t fly under the radar: –

In the last 48 hours a sneaky amendment to PayPal’s acceptable use policy widely captured the public’s attention. Free speech advocates had spotted that customers agreeing to the update would be allowing a sum of $2,500 to be lifted from their accounts if PayPal ever found them guilty of “sending, posting, or publication of any messages, content, or materials” that “promote misinformation” or “present a risk to user safety or wellbeing”.

If the case was still going now after Peter Ellis’s death, then I see no reason why others involve cannot be charged. Must open a huge can of worms.
