  Couple of points: 1) the West Bank was part of the British League of Nations partition for Israel and the much larger Trans-Jordan across the river, the Arab homeland (ie the 2 state solution). It was invaded and taken by Jordan, Palestinians moved back there, and it has been managed that way ever since.
  
  2) Arabs snd Muslims live freely inside Israel, own businesses snd homes. What’s with this anti-Jews apartheid that Jews are never allowed to exist ‘inside’ Palestinian occupied areas. Many of them work inside Israel ( a hugely diverse cosmopolitan multi ethnic multi religious tolerant state).

There is nothing complex about this guy. He is a criminal so lock him. If he hasn’t got the brain power to rehabilitate due to drugs then institutionalize him. Why should society have to put up with his violence and theft?

Clearly the time he spent in prison was no deterrent or of any help to anyone.
It sounds like he likes the accomodation provided by our prison services.

I guess he is very upset with his lawyer.

This from stuff yesterday, Monday 22nd April –

Restoring 3 strikes – good. Cutting public sector jobs – understandable and necessary. Luxon out there advancing economic ties and trade, also good.

These are good things people. Every week this government is doing good things! 😊

I’m particularly pleased to see 3 strikes coming back in. Law and order has declined drastically and we need to stop the ram raiders, the boy racers and the jewellery shop smashers.
Update – some are saying the new law is going to be too weak? I would see it as change going in the right direction. They are at least reintroducing the principle of 3 strikes. The law can be amended as the principle is accepted.
Always remember the government faces a woke electorate and a hostile media. There has to be compromise.
But I repeat every week we are seeing something good out of the government. 😊

  The article is quite disingenous given they will actually look and feel like houses when completed. Container house design is quite innovative. The article is another beat-up. What would the residents prefer, the street, a car, a motel or these as a community? Proof you can lead a horse to water, but you’ll still have it whinge.

  They need to quit complaining and should be grateful that more housing is going up.
  
  They’re not containers as the final cladding hasn’t been installed yet. They are modular construction units where the units are built in Vietnam or China fully furnished already.
  
  These people complain that there isn’t any housing, complain when there is housing, then complain they don’t like the housing. They all expect to be living in mansions at the tax payers expense.
  If they don’t like it, may I suggest that the house they next live in be clad in cardboard….

  They are certainly not shipping containers. Seems like a good modular solution and the finished design looks pretty good.
  
  I suspect the problem most people have with a KO development is the whiff of state house subdivision that comes with it. But the original state house areas were populated by working families, often former servicemen with young families who saved for their own and moved on. It was only in the 70s and 80s with the huge growth in single mothers on the DPB that state housing got its current reputation. Some of us should keep in mind that huge numbers on the emergency housing list aren’t wastrels and meth addicts but people with full-time jobs who have been priced out of both the private and rental market. KO would do well to make sure working people populate individual housing developments which could only serve to *elevate* the tone of the surrounding neighbourhood.
  
  Tiny houses are a huge growth industry for people who simply can’t afford the high cost of modern homes or want to downsize but still want a space of their own.
  
  Whole communities are formed around the tiny home concept.

    I have several friends live in off grid tiny homes. One has two phds in STEM and works as a sport coach, the other was an economics lecturer who now drives a forklift.
    
    They both got divorced (shafted!) fed up and downsized, one still has a teenager living full time with them, they both say they are much happier with the mentally easy jobs and small space. They don’t care that lights are solar and toilet is composting, they only thing they said is that they would like to be able to own the land before they retire but subdivision of rural land is so expensive that it’s unlikely.
    
    So nice to be with people who don’t always want MORE.

  Mags, I’d note it’s probably a better idea than spending an absolute fortune on land in Auckland suburbs and plonking 10 super cheap boxes masquerading as houses on them. I see they are building a pile in Howick. Probably $1.5-2m for the property. Just go to any Placemakers trade shop. They have sections for KO supplies. Plastic mortices, super cheap, ultra low qual door handles etc. They build shite, and fit it out with shite.

    It’s shocking to see how little you get for $850k.
    
    A couple of these China-built modules on a larger section 20km out of town would have been better for the wallet and the soul.

  ‘Container houses’ from China are often flat packs that are shipped in containers. They range from one roomed cabins to 3br houses which are pretty basic, but hey, if you need a roof over your head, not to be sneezed at. They’d probably be disposable after 5 years or so, and be cheaper to replace than to repair a real timber house.

Elon and Rumble both said on Twitter yesterday they were getting an increase in request to censor content.

On what basis should it have been removed.

“Police Commissioner Karen Webb called for social media platforms to do more to prevent the spread of harmful content online.”

**** Me: So are they saying that any truthful videos that fuel an emotional response or protest are “harmful content” and should be censored by the state. What is the actual law here?

Should we not have news of Palestine bombings? Or the Israeli attacks? They result in emotion and protest. But surely truth is the most important thing here.

George Floyd videos weren’t censored, and resulted in protest. Does the world not have a right to know exactly what happened to George.

It is chilling how truth is being manipulated by the state.

Behind the thrust for a parallel system of government is a completely fallacious interpretation of the Treaty of Waitangi. If you go to “Waitangi Tribunal” on your computer and scroll down, you will soon come to a claim that Maori did not cede sovereignty to the Queen in 1840, despite what reputable translations of the Maori version of the Treaty actually say. Professor Sir Hugh Kawharu who was from Ngati Whatua, and head of Maori Studies at the University of Auckland, translated the Maori version of the Treaty with the words “The Chiefs of the Confederation give absolutely to the Queen of England for ever the complete government over their land.” That translation was accepted by the government in which I served, and was endorsed in the late 1980s by the Maori Queen and by Sir Paul Reeves, the two Maori patrons of the 1990 Commission which celebrated 150 years of living with the Treaty. It was accepted by the Waitangi Tribunal during my ten years as a member.

But a tiny collection of Maori radicals in our modern universities and on today’s Waitangi Tribunal, despite Sir Hugh Kawharu’s erudite translation, refuse to concede that Maori ceded sovereignty to the Crown. And, having contrived confusion around what Article One of the Treaty really says, and claiming that sovereignty still rests with Maori, they are now pushing for a parallel system of government.

Is this why a bill should re-state the Government’s right to govern, obvious as that may seem? – although apparently not obvious to all.

Mind you, unlike a doctor or lawyer found to be wrong, I do “hope to God” that all settlements made by a mistaken or wilfully misguided Tribunal do not have to all be re-examined. That could be a bridge to far.

Meanwhile, How many Maori members (elected by the tyranny of the Majority*) of Parliament did not swear allegiance properly and therefore have another agenda –

    Health New Zealand is not a government department. AFAIK it is not subject to the across the board cuts that apply to Government departments.
    
    It is impossible to know what is happening. However these budget pressures in health have been happening forever. The previous DHBs were running deficuts forever. I assume that Health New Zealand has just inherited the combined problems.

  Years ago my employer called for savings. Some Department Heads thought they could achieve savings by charging for services to other departments. The CEO had to intervene and say he expected REAL savings, not just shuffling costs around.

  I disagree. Across the board cuts and leaving the agencies to figure it out is the wrong way to do this. It is up to the government to determine the role of government.
  
  The government should have established an Expenditure Review Committee to review all agency functions.

    If you want to cut public spend you need to think about what programmes you cut, not just issue blanket edicts that then get played and perverted (for example Health proposing to cut suicide prevention programmes).
    
    This new Luxon government wants to present the appearance of corporate-like efficiency, but so far the actions seem clumsy not efficient.

    Then why bother having senior management then Ben? No CEO worth his salt should be happy to run budget deficits. The CEO must have been involved in the budget process. If the CEO is running deficits, they should JUSTIFY it to the Government, and make the business case for additional funding. If you can’t make the case, then you better work within the budget you have been involved in putting together.

  I seem to remember David Garrett saying it was difficult getting three strikes related data out of Justice Ministry officials. I do not think the officials particularly liked the ‘three strikes’ regime.
  It seemed that whatever information was available pointed to the previous three strikes scheme reducing in aggregate the total person-days spent in prison. This would be because the extra person-days due to three strikes sentences would be more than offset by people not being imprisoned because they were deterred from offending.

  There’s even a suggestion that the council wanted to upgrade water services and building inspections .
  
  Reading between the lines I suspect this is just “greenwashing” to evict .

‘Essential public services….’

I had a friend come to stay over the weekend, from Wellie.

For a few years she’s walked client’s dogs for a living. 5 days a week, a morning run and an afternoon run, usually bush or beach, and usually 6 or 8 dogs a time.

We were taking about her licensing arrangements through the Council – yes, you read that right, to earn a living taking dogs for a walk you need permission from the government, in this case local – and with commensurate fees both up front then annual.

It’s been on my mind ever since.

And we think we live in a free society….

      Just a last comment from me. There are two mutually reinforcing behaviours that mean that this function does not need to be regulated.
      
      1. Only experienced ‘dog people’ become dog walkers.
      
      2. However if (1) fails, what kind of people pay to have their dogs walked? People who care about their dogs and who are going to ask questions about the experience of the dog walker, including looking at reviews and testimonials.

A while ago now, the United States Supreme Court ruled that “abortion” was not mentioned in the US Constitution, their founding document, so has to be dealt with in other ways, namely it seems: by individual State legislation.

Similarly “co-governance” is not mentioned in the Treaty of Waitangi, claimed to be New Zealand’s founding document.
In fact “co-governance” would have been so unique in the context of the British Empire, negotiating with the First Nations of a country, that it would have dominantly featured in a Treaty.

But it doesn’t.

It would seem that the Waitangi Tribunal has decided that it is some sort of self-appointed constitutional court.

This needs to be nipped in the bud – before it gets too entrenched.

NZ lacks a constitution and constitutional court which has allowed the Treaty, and the Waitangi Tribunal to grow to fill this space.

Most countries have a clear constitution. Whether or not that is a good thing is another matter. But lacking one has allowed an old, obsolete, treaty between the state and the natives to grow to larger than its intended purposes.

If we look at USA, for instance, they had treaties between the blossoming USA and native American tribes. These were surely similar in nature to the Treaty of Waitangi, but nobody ever confused those with the American Constitution.

Ditto Australia, and pretty much everywhere else that has a constitution.

Perhaps it is time we got ourselves a constitution so there is something to fill this space.

That said, the old warning of “be careful what you wish for” applies. I would expect that any constitution drafted during this current period of wokeness would likely be extremely “treaty inspired”.

  NZ does have a constitution. It is largely modelled on the British constitution, with specific alterations to suit our circumstance. Just because it is not in one sacred document of numbered articles or clauses does not prevent it from being a constitution.

        In theory, USA has so far had 28 constitutions – the first then 27 amendments.
        
        Amendments to the constitution are not a problem – it is a way to keep it current.
        
        As broken as it is, at least theirs is written down and formally amended when required – rather than just having something from the 1800s that is dragged out and called our “constitution”.

      The treatyis law, to the extent that it has been incorporated in statutes. Just the same as particular pieces of Magna Carta or the 1689 Bill of Rights are expressly part of NZ law.
      But beyond statutory law, the treaty is part of our constitution to the extent that a consistent majority (National and Labour) of elected representatives maintain conventions making it so.

Policewoman on talkback say she and her partner (also a cop) have 12 years experience between them… are now off to Queensland.
Been offered 50k relocation allowance, overtime pay, better holidays, and a starting combined income in excess of 220k.

Made me think about someone like the ‘Member-for-Tijuana’.
That drain on society does SFA every day, yet still pulls more in a year off the taxpayer than the wonderful pair referred to above.
Know who I’d rather see leave the country.

  Long service leave after 10 years or pro rata after 5 years. 8.67 weeks paid after 10 years service. That’s state minimums. The police get 13 weeks.
  
  42 days annual leave too for police.
  
  Ability to do things like novated leases for cars off pretax income, lowering your overall tax bill. Ability to claim work related costs off tax as a individual.
  People who mention “oh, but they have higher tax” don’t mention the other side of the tax system, being more deductions available.
  Even the CGT regime has deductions after 12 months, unlike the daylight robbery system NZ would no doubt bring in due to envy.
  
  The ‘Member for Tijuana’ can stay exactly where he is. No need to ruin another country.
  
  Mrs Dalee and I have already made the move to Brisbane. NZ just lost a combined tax take of around $120k between us. (I’m in aviation, she’s a teacher)
  And I’ve picked up $50 K payrise myself moving here, plus super.

      It was home, until My worth as a NZ citizen was far more important to NZ if I were Maori, rather than European or Asian.
      Never mind all the years of voluntary service I served with FENZ, search and rescue and Coastguard trying to make NZ a better place.
      
      NZ certainty doesn’t feel like home yet I was born and grew up there. I have had a much warmer welcome by the Australians who have been nothing but generous and welcoming of my skills aand experience. I think I identify more with the average Australian than the ever more average increasingly woke left wing Kiwi.

  Agreed. I’m not sure if Seymour claims to be a libertarian, but some libertarians attempt to argue that personal liberty should extend to right to suicide (and sometimes assistance to die) at any adult’s discretion.

  That’s a problem with referendums in general unless they are non binding like the Brexit referendum
  If it’s a binding referendum one would think any amendments to the resultant legislation would, in fairness, have to be put to another referendum
  Personally I’m not in favour of referendums.
  For example one may support assisted dying in general, but there is not way to vote on particular details

  Those that opposed state sanctioned killing of old sick people stated at the time that we would also go down this same road as has happened in every other country. But this was dismissed by those that know better and people like myself were labelled as dinosaurs that worshipped “bronze-aged” sky gods.
  Once it became allowed then it was just “feelings” that set the limit. Like John Key’s guiding principle in life: “I’m comfortable with that”. As in other jurisdictions people will eventually get so numb to this evil they will get “comfortable” with teen-agers with depression being put down as though this human life was nothing.
  If we can’t even agree that human life is special then I’m not sure there is much point arguing about anything here.

  The referendum was based on the principle of assisted self termination.
  
  All laws go thru review(which is what is proposed here). and that is fair and reasonable.
  
  As mentioned Seymour is suggesting that only 6 months to live was a concession to get Greens onboard and that maybe 12 months may be better.
  
  I dont understand Benedict why you think Seymour is making a mistake?

    Because the referendum was a vote on details of the law as enacted. It was not a vote “Do you approve of assisted dying?” There may be people who would not have supported the referendum if the now proposed ’12 months’ provision had applied.
    
    I recall many folk saying that once enacted, there was a danger that politicians would relax the rules so that it was easier for folk to access assisted suicide. I did not believe that would happen, hence my surprise at it now being canvassed.
    
    BTW I personally would support the relaxation to 12 months but that is besides the point.

      EVERYONE I talked to about the referendum ONLY talked about voting the principle, not the detail.
      ie I would have voted differently if it was 12 months not 6 months etc etc.
      
      I think most mature Kiwis understand that laws need to be reviewed. Especially controversial ones.
      
      That is why I said they voted on the principle.

This may have been discussed already but what are your thoughts on taking a baby to a comedy show and being asked to leave.
There is no way would I take a baby to a show like that. I wouldn’t enjoy taking a baby into an environment where people have probably been drinking and it would be hard to watch a show and deal with a wriggling baby.

This is a good move. Not just for the abuse, but for the thieving bastard runner to ID them. It is one thing that gets my goat. Staff can’t stop the runners and neither can security. Public can though. Dangerous because these bastards carry knives and guns.
Why do staff have to notify customers before recording. The mall security cameras don’t notify.

Been listening to Michael Laws show on The Platform and discussion around the public service cuts. The point has been made that many, perhaps most, of the job “cuts” have been in unfilled roles. An arising question has been that as the people actually working in the public service haven’t been universally effective why are there not more cuts pertaining to *actual people* in *actual jobs*? A fair one in my view.

My mind then wanders to the overlooked utility of the neoliberal reforms of the 1980s (Reagan, Thatcher, Douglas et al). No doubt these were imperfect and in some cases savage, but they seriously turned the tide against many years of post WW2 state creep that had become cumbersome and inefficient. I think we have moved back in similar territory to 1970s NZ where the answer to every actual and perceived ill is more state control and without serious reduction in the government sector we face a grim future. This is in stark contrast to the mood of the 80s when west was embracing the idea of a smaller state. Without that climate this time what chance do we have?

As far as I can make out, regulating fresh water quality, and its availability to farmers has been a mess for 30 years in New Zealand. I can’t see that changing. The problem in New Zealand is that influential Maori interests claim that they ‘own’ water, or at the very least are best equipped to govern water.

  The legal profession are populated by two generations of university-woke-indoctrinated and are predominantly women (now ~70% of grads). They are far removed from NZ’s political center, particularly those who turn their backs on money as solicitors to be involved in poorly paid criminal industry, marking them out as strongly motivated by political agenda (almost always far left) ahead of economic self interest.

The Report says the Knife did it. Not the Man holding it. Case Law revisions will need to be made across the board.

Patuawa Nathan had had enough. Angry and terrified of his older brother, he grabbed a knife in an attempt to scare him, an attempt to get him out of the house.

That’s what his lawyers said. He never had any intention to use it. The Crown said the opposite he had the intention to use it.

That knife would plunge twice into his older brother’s body. Eventually killing him. The brothers fundamentally loved one another, but while Patuawa was being questioned about the assault, he found out Challas had died.

On Tuesday, after deliberations across three days, Patuawa was found not guilty of murder, and also the alternative charge of manslaughter.
