    I may be the dumb one here but Green Party co-leader Meteria Turie, seems to be arguing for customary ownership of the foreshore and seabed based on common law as being territory occupied by indigenous tribes at the time the treaty of Waitangi was signed. On RNZ I heard her say she didn’t think a lot of foreshore would be involved.

    ““This created a fundamental injustice. The new Marine and Coastal Area Bill does nothing to address this injustice.

    “There is no substantive difference between the ‘common marine area’ and the ‘public domain’.

    “Instead of letting Maori have claims to customary title determined by common law, this bill spells out what those rights entail. These are substantially weaker than the private title rights enjoyed by non-Maori owners.

    “Under this bill, Maori will only get what the Government has decided they can get, irrespective of the strength of their claim under common law.

    “Yet 12,500 private titles over areas of the foreshore and seabed are unaffected. This is unfair and creates a double standard which treats Maori customary title as inferior.”

    What are common law customary rights?

    These are rights, interests, practices and activities exercised by Maori prior to the acquisition of sovereignty by the Crown (although there is a strong argument that that sovereignty was never ceded only kawanatanga). The basis of common law aboriginal title is the legal recognition of the continuity of aboriginal property rights upon the Crown’s acquisition of sovereignty. Native title is neither an institution of the common law but is recognised by the common law. Therefore they exist prior to the Treaty (but are guaranteed by it).

    The last time I was in Christchurch SO MANY locals were SO rude to me that I resorted to pretending to be from Wellington, rather than Auckland.

    One Christchurch resident explained to me why they hate us. All the assets of the South Island flow up to the north. All the bad things in Christchurch come from the north.

    Hey folks, wise up. A lot of people believed that Hitler didn’t REALLY hate non-Aryans. it was only after the war that his hideous crimes were revealed to the world.

    Face it, there are huge numbers of Christchurch folk who really hate us.

    GOD is now punishing them for their wickedness.

    I stopped caring about Christchurch and it’s people years ago. I loathe the place.

    And THEY started it.

    Looks like the Maori party will renege on their seabed deal if they get a better position in parliament in the future. Could be one of three scenarios:
    a) they are genuinely unhappy with the deal they made with National, in which case they should say so now, and break their coalition agreement
    b) they don’t want to end the gravy train
    c) you can’t trust them to make an agreement and stick to it if they think they might get a better deal later on

    or the fourth, a combination of all three.

    What NZ wants and needs is an end to all the native land claims so it can move on. What it certainly does not need is one party not acting in good faith, for whatever reason.

    If they prove actually totally unreliable, the govt can pass a motion of no confidence and ditch them as coalition partners.

    I don’t know about his colleagues but Pita Sharples is capable of seeing the shotgun pointing at his foot and re adjust his stance.

    @ Brian Smaller – just blogged about the Williamson “furore”. He was addressing a crowd of lubricated builders FFS – doubtless a union shop steward heard the soeech, and breathlessly reported it to an EPMU card-carrying journalist colleague.

    In the overall scheme of things facing the building industry and the Minister at the moment, I doubt that it will be high on his worry list today, or that of the PM’s, and rightly so. It’s a beat-up.

    The well-funded Natural Dairy PR squad under Ralston continues to be busy in Auckland. Leftie NZ Herald columnist Rudman has come out backing Maurice Williamson after Williamson’s inept, stupid playing of the race card in the bid by China’s Natural Dairy to buy the Crafar farms.

    Rudman, too, supports Williamson’s claim that opposition to the bid is racist. He ignores reports in his own newspaper about the integrity of the principals on Natural Dairy (I repost the links below).

    Rudman ignores the fact that foreigners are not allowed to buy land in China. (A feedback post on the Herald web site points out that Natural Dairy is Hong Kong based and we can buy land there — at the moment. However, the big shots in Natural Dairy are mainland Chinese, and clearly in or closely connected with the Communist Party hierarchy or they would not be big shots.)

    Rudman also ignores big donations to our political parties by Auckland Chinese, at least one of whom seems to have some link with Natural Dairy.

    The Herald, Irish owned (until the Paddies can find a buyer), has become distinctly pro-Red China. It would be poetic justice if a branch of the Commmunist Party of Red China bought it.

    Did the Herald, and specifically Rudman, oppose the blocking of the sale of a chunk of Auckland Airport to a Canadian pension fund than undertook to be a passive investor? I doubt it. Would that have been racist, in light of the fact that the Labour Government, while blocking the Canadians allowed Chinese interests to buy Wellington’s power lines network?

    The Canadians should have hired an ex-TV PR specialist then they might have got somewhere.

    I find it offensive for Williamson and Rudman to brand as racists NZers opposed to sale of agricultural land to China. They are doing so in the defence of Chinese guilty of barbaric and heavy racist suppression of ethnic Tibetans, of Uighurs, and probably of ethnic Mongolians in Inner Mongolia.

    If Natural Dairy does get the Crafar farms, there will undoubtedly be a full-on, growing campaign against China-based investment in our agricultural industry, and this campaign will be waged up to and through the next election. By then Ralston will have to dream up for his Red Chinese clients a different stratagem from shouting loudly racism on behalf of those grinding Tibetans under their Han Chinese heels.

    Natural Dairy shelves $1.5b expansion plan

    The Hong Kong company hoping to buy 16 Crafar farms has shelved its ambitious plans to spend up to $1.5 billion setting up a dairy business in New Zealand – for now.

    Natural Dairy has announced that it has terminated its agreement with May Wang and her backers to expand its business in New Zealand, after a dispute with the Hong Kong Stock Exchange (HKSE).

    The company voluntarily suspended trading in its shares in February, pending further details about a potentially substantial acquisition.
