  Paul Little, like so many apologists believe you can sprinkle glitter rainbows by an imaginary faerie and Hawthorns alcoholism and disregard for other people’s safety, will disappear.
  
  Only one person can help Hawthorn. And if he doesn’t want to stop drinking and driving, guess what Little. He’s gonna continue.
  
  If he takes the life of a loved one Little knows, I doubt he’d be so empathic towards Hawthorn.

      Igm, I often wonder that too. I realise judges are drawn from the legal fraternity and tend to live in leafy suburbs, generally safe suburbs. Pollies are more likely to be exposed to crime but amazingly seem to escape being victims. The spread of Islamic terrorism though may change the game.

    It seems from the above article, that Hawthorn had couselling and underwent programmes.
    
    One gets the impression from Little’s article that there were no attempts at rehabilitation and the sole focus was on retribution.
    
    Maybe Little could have done further research and reported on all attempts at rehab before denouncing the system and treating Hawthorn as a victim of an oppressive and uncaring system.
    
    Maybe he could provide some analysis of the nature of a man who didnt did a tinker’s cuss that he killed his mate and let us know, given his inestimable wisdom in this area, what treatment would have turned him about.
    Otherwise, this article is no more than puddle deep pandering to the jaundiced SJWs who seem to love the Herald.

      Years ago in Sweden, they decided to give everyone caught drink-driving 3 months in prison.
      (I.e. before they actually maimed or killed anybody.)
      Wonder how their road toll compares with ours?

  It was reported that Hawthorne refused alcohol counselling whilst in jail.

    Why is this being dragged on so long?
    
    About the same time as Fingergate, Haami Hanara murdered Kelly Donner. It took them over a month to hunt Hanara down where he was hiding in a shed on a property 270km from the scene.
    
    The system has managed to process this relatively complex case and reach a guilty verdict in just over 7 months.
    
    Fingergate is pretty straight forward. Lots of reliable witnesses, known perp, no hiding in sheds. Yet the case is being kicked down the road.
    
    Are they hoping that with enough time name suppression will be breached enough that they can calim miscarriage of justice etc etc? If so, everyone directing this case is complicit in defeating justice, just as the Labour party are already.

Last week, I met an amazing family from South America. The couple are both working hard as chefs and love New Zealand. However their daughter has been not been granted a Visa because she has an intellectual disability. According to her mother they are can support her and she isn’t a burden, but Immigration NZ disagrees so the family is now separated.

Meanwhile, Labour has granted residency to an imprisoned drug smuggler, in what the PM described as a careful and considered decision.

well and truly phucked the Goff from Clevedon, with his new Super Empire which can override anything that Goff wants in Auckland.
I can hear the shit hitting the fan at Auckland Council along with the fight as to which new staff will transfer to the the New Wonder Super KiwiBuild organisation.
It will of course be a disaster as there are still no Builders who would want to take part in the Jerry Build Slums of the future.

  Phil Twyford is not going to get the RMA changed, yet there is a pressing need to free things up to enable housing to be provided as cheaply as possible. Setting up an alternative legislative regime for specified blocks of land to ‘bypass’ the RMA seems a pragmatic way forward. Hopefully for Phil, hope he succeeded in getting this ‘bottom lined’ in the secret document, also he may have already had Phil Goff lined up ie Government money for train sets in exchange for Phil Goff’s support.
  The need for housing is far too important for things to get bogged down with RMA and the existing building inspection regime. Seems Phil Twyford is proceeding with a ‘circuit breaker proposal to help ease things and for that I support him in principle.

    Despite all the noise I have yet to see any real evidence that we are short of houses.
    Those that want one can get one, those that have a bad record can’t.
    Now we can’t always click our fingers and have instant gratification with a brand new house. At 72 I have had one. At 22 they seem to think they are entitled to do what most of the rest of us never do.
    
    There is already signs of overbuild in some places.
    House building is slowing and after this will go slower as builders respond to the market.
    Commercial on the other hand is flying.

      IMO it is essential that housing is provided for all, even those who have abused rental housing.
      I would establish container housing areas adjacent to refuse landfills and designed to be ‘foolproof’, eg having Corrections style toilets / handbasins. When the tenants show that they can keep it clean and tidy and pay the rent they can be offered something better.

I have known judges having to deal with serial offenders like Hawthorn. They are frustrated and it is a judgment call: is the prisoner this time going to exit the system or not?
There is a high cost in locking someone up and that is weighed up against the chances of re-offending. There are age cohorts for maturity where many criminal successively exit the system. These are well known to sentencing judges.
There are also probation staff who report on the criminal prior to inform the judges decision.
Frequently these sentencing decisions work out and the probation staff are active in supervision.

Judges cannot get it right all the time. It has to be a compromise otherwise a robot can do the job and we would have neither justice or mercy. The only solution to preventing re-offending is to eliminate the offender completely at the first offence. That might cut parking ticket revenue in the cities.

  There shouldn’t be. Why does it cost over $100k per prisoner?
  
  Families of 5 can exist perfectly happily on far less than $100k including paying off a mortgage, running a car and a whole lot of other things that a prisoner does not have/need.
  
  A couple on NZ super has to make do on $15k a year each.
  
  Since prisons are large organisations they should have economy of scale advantages. The prisoners should also be providing some labour: cooking, cleaning, gardening etc.
  
  It really should cost no more than $10k a year to hold a prisoner, including all the admin costs.

    We live on the National Superannuation. However we don’t have anyone cooking our meals, making sure we don’t make a run for it (a walk more likely), tuck us into bed every night or check every now and then to make sure we’re not going to top ourselves.

      Let’s do a bit of a budget:
      
      The Super is $41 per day per person for a couple.
      
      1) Let’s say a prisoner’s basic feeding, clothing etc should cost 25% of the super: $10 per day. It should not have to be more than that given the prisoners can make clothing, grow produce (would do them good), milk cows,… and food is bought in bulk so hefty discounts.
      
      2) Let’s say that the majority of prisoners are non-violent, so most of them should need no more than 1 guard per 10 inmates. If the guard is paid $70k a year then that’s $20 a day for direct guard costs.
      
      3) If the prisoners do maintenance etc, then the cost of the actual buildings drops significantly: $20 per day per prisoner.
      
      4) Other costs: admin, welfare, etc. : $20 per day.
      
      Total so far = $70 per day, $25k per year.
      
      5) Prisoners do work that earns $5 per hour = $40 per day of which they pay $30 as board and lodging and keep $10 for lollies.
      
      We’re at $40 per day = $15k
      
      Any more than that is nonsense.

        Yup, in many countries prisoners work. THey earn a bit of pocket money and some actually learn useful skills.
        
        In the South African wine lands many of the vine pruners are prisoners. Once they get out they are normally in high demand for their skills.
        
        THe bullshit NZ/UN directive banning forcing crims to work actually does the crims more harm than good. It helps to keep them in cycles of offending.

I had a minor argument with some otherwise-intelligent teens at my brothers’ work yesterday. They really believe in this climate change stuff – spouting the slogans, “there is no planet B”, and that the world only has 12 years left (seriously!). And there was nothing I could say to disabuse them of the notion. I poo-pooed the plastic bag ban and they were horrified – what about the whale they cut open recently with bags inside etc…

The media and academics really do have a lot to answer for, for their part in the brainwashing of today’s youth.

    An out of boundaries decision may be appealed by the Crown or the criminal.
    
    Judges do not act merrily on their own in sentencing. Sentencing is not immediate. The criminal will have been reported on by the probation service and others such as doctors, employers…
    The Police have a say too. That can be implied in the charges they choose to offer for prosecution. There is an implied ranking of severity and sentence options. The Police present a statement of facts and their comments in those are intended to be influential.
    
    In general the Judge delivers the sentence that the officials agree with and the criminal’s lawyer expects.
    Many people would consider any sentence other than exile for life as one from a dud judge.
    
    I have sat through more hours in sentencing courts than I would have liked. Our judges do care for the best all around outcomes. Aberrations are rare.

I am surprised that the call from some to bring back the guillotine hasn’t been made. There is a system for removing “dud” judges, but they have to be severely unfit, a threshold rarely met.

        I take your point; however, there is a case to be made for a change in the law, whereby a recidivist addict such as this, who is a clear and present danger to the public, could be subject to a form of preventative detention. The number involved would be probably very small.
        Failure to comply with rehabilitation plans would result in further detention. It might be hard on the addict who is, after all, arguably sick rather than bad, but public safety must come first.

      That is where it becomes a very tough judgement call. Everyone in Court or advising the Court is usually agreed. Because offenders mature at different rates and maybe by the time the offender reaches the next exit age group they may have matured makes it doubly difficult. Evidence for that is sought for.
      
      A long prison sentence after a string of appearances over an extended time almost invariably is an admission that the criminal can expect to be incarcerated almost permanently in future. The lengthy sentence will institutionalise the prisoner so they will not fit outside society. Prisoners often re-offend to get back inside.

        I’m neither but I’ve done prosecutions, law drafting, spent quite a lot of time supporting in the criminal Courts and in social work dealing with outcomes.
        
        My opinions are personal and others may not agree. I have seen the input and outcomes of the justice system. I believe the merciful approach aiming to avoid incarceration unless necessary is to be preferred. Creating institutionalised persons is fairly easy: getting them back into regular society is not. Most won’t be employable. Giving the younger ones hope to establish themselves in regular society as useful citizens is important. We need them in work not prison.
        
        In my view the Courts don’t tolerate dangerous thugs readily. An offender aged 20 is much more likely to be given the opportunity to grow up and be useful than one aged 34 who bashes someone deliberately in apparently similarly circumstances. The differences are in the likelihood of eventual outcomes. The older is exhibiting behaviour that suggests very strongly that this will continue and so they should be ejected from society for its safety. The younger may be part of a bad group and immature. Probation Officers and social workers work with these wild youth in transition and thankfully most do drop out of the Justice System over about a 15 year period.
        
        I wouldn’t like to be a judge no one allows them any relief for not knowing the future. I believe we are blessed with a judiciary of integrity who aim to do their best. Some outcomes will be disastrous: that is the nature of decision making.

        Judge James Johnston:
        He is a relatively inexperienced judge having been was sworn in on the 10th of June 2016.
        He is Ngati Porou, and has done a lot of work with Waitangi Claims.
        He works in the Youth Court, also with an influential Marae Based Justice outlook.
        He is part of the Rangatahi Courts (for Maori and Pacific youth) which means finding information on their ‘sentencing’ decisions will be nil. Youth court sentences are not published nor do they appear in national offending statistics.
        He is pro restorative/whanua led Justice. (he rarely sends an offender to prison)

Mark Thatcher, son of British Prime Minister Margaret Thatcher, was reported missing in the Sahara desert while competing in the Paris-Dakar rally on this day in 1982.

Thatcher, 28, his co-driver and mechanic had last been spotted two days previously, driving in convoy with two other cars near the border between Mali and Algeria. It later transpired that they had become separated after stopping to repair a damaged rear axle.

The trio, driving a Peugeot 504, waited for help and told the other members of their convoy to report their position. Unfortunately, these cars’ crews passed on the wrong location to the rally’s organisers. With only a compass to help them navigate, Thatcher and his team were hopelessly lost.

    a) govern its own people and to follow its own laws; and
    b) control its own borders; i.e. decision-making power as to who enters the country and who is entitled as of right to residency in the UK.
    
    Those matters are the ultimate basics of independent nationhood. Well done to the UK in retrieving its national independence. If it wants to make concessions to other countries, it can still do so through specific nation-to-nation agreements that suit both parties.

Jacinda Ardern’s Tax Working Group, conceived just prior to the last Election to allow her to shove undeveloped water tax ideas sideways, is now talking about a Capital Gains Tax for “small businesses”.

So what is the definition of a “small business” and does it include “self-employed”?

        I know of Indian families in NZ enjoying and honouring their daughters. One of those daughters aged 18 was working at a Montessori School and her parents arranged a marriage with a surgeon intern living in the USA. Within weeks she was on her way there. She had never met the fellow but her happiness was real. I know it has since continued.

        I personally know three Indian couples with an “arranged” marriage. It is not always as it seems and these three span 3 separate generations.
        
        All are still together and all seem happy to me. I just wish that when the wound is so deep and so fresh others would show a little restraint before spouting their unhelpful comments, although I see original abusive comment received 10 up ticks, so far, and my condemnation has received 6 down ticks so far so I guess there is plenty of hatred on this site towards Indian immigrants or those citizens of Indian descent.

Universities and industry bodies insist nothing is wrong in Australia’s booming $32 billion-a-year international education industry, but an ABC investigation has uncovered an abundance of international students who describe struggling to communicate effectively in English, participate in class, or complete assignments adequately.

Here’s an extreme example:

Recently at an elite Australian university, a senior humanities lecturer opened her office door to a young international student who was accompanied by another woman and seemed nervous. The student had emailed the lecturer in advance about changing to another degree — but right away there was a problem. … The woman accompanying the student, whom the lecturer assumed was a friend, was in fact a translator hired for the meeting. The student had gone through the first year of her degree without the ability to speak English.

The article provides some interesting statistics:

University / Total # / Int. Students #
UNSW 59,781 / 20,204 (34%)
Melbourne Uni 50,270 / 19,903 (39%)
Uni of Sydney 60,000 / 19,000 (32%)
RMIT 49,408 / 22,034 (45%)
Monash Uni 62,400 / 27,800 (45%)

So the international student percentage at those 5 universities ranges from 32% to 45%. That’s an extraordinary statistic.

Some international students will have academic-level English proficiency, but others (perhaps a majority) won’t – leading to a drain on lecturers’ time in providing extra tuition or detecting cheating – to the detriment of local fee-paying students.

Im fucking livid. How can this senseless government ban oil and gas and are now banning triple use plastic bags when they are turning a blind eye to disposable baby nappies ?
These single use disposable nappies are 50% plastic and 50% wood pulp which can take 200/500 years to break down !~
Can anyone on here tell me why this petty government haven’t banned these nappies..?
If the answer is they don’t want to make a change they perceive as difficult, why ban oil and gas..?

  THey are called Presidential because in the USA the Federal govt controls this channel and the prez is in harge of the federal govt. Likely other people actually send the messages.
  
  Whether or not you get the alert will depend on various factors including your phone firmware.
  
  The messages are similar to, but not the same as, text messages so they are handled differently by different phones.
  
  Unlike text messages which get stored by the carrier if your phone is off (or in flight mode), these messages are broadcast – not sent to individual phones – so are not stored if you are out of range, phone off, etc.

    Evidently it can’t be ‘modified’ either!
