The New Zealand Herald broadcast video of the October 2017 appeal where Mark Lundy challenged his conviction.

This is now part of the public record, which is most unusual for an appeal against a conviction for murder. The contents are hugely revealing of the credibility of both the prosecution case and the defence case. Transcripts of this hearing will soon be published to demonstrate some quite vital parts, and so the people can clinically assess for themselves who is telling the truth.

    I consider you one of the sane analysts on this message board, and you bring an international perspective. You know well that there is no continuity between facts and the legal interpretation of the facts. We are dealing with this conundrum in the Lundy case. The funeral is an interesting case, Mark was deemed unpresentable by his sister at the funeral because of the state of his eyes, he was commanded to wear dark glasses to conceal his tear stricken grief. All this bullshit about an act is demeaning to the facts in the case.

Clearly the Worst Government Ever is also the most Cunning Government Ever.

They have known full well since Jacinda was DJing that it is impossible to solve their manufactured ‘Housing Crisis’ without drastically altering their beloved Resource Management Act, let alone relying on the now laughable ‘Kiwi Build’ scam.

So: Cindy’s “Government” quietly sets about relieving Rich Pricks from their hard-earned property(s) by:

Signaling to Landlords crazy stuff like tenants should be allowed dogs and paintbrushes

Loading ever more taxes and regs on Landlords so the whole thing isn’t worth it

Signaling strongly a CGT is on the way / and / or other property taxes, removing the loophole etc

Advising the public just before Xmas via a poorly camouflaged ‘leak’ that seaside properties (and there are many of those in NZ) are going to be ‘swamped’ LOL in less than 20 years – and become uninsurable

There are more examples but the only flooding we’re going to see will be in the NZ housing market. That’s their plan.

    We got to hell out of domestic rentals years ago, going to commercial, which attracts a decent type of tenant, they being responsible and appreciative.
    Contrasts to the shit out there wrecking houses, defaulting on rent, too lazy to mow lawns or open windows, and supported by a sleezy government and tribunal.

  Properties would be effectively uninsurable against rising seas since the company can pull the plug on the policy at each renewal. Perhaps the bigger hazard insurers face is arson if an owner considers there is no future in owning that property.

The Diversity Dividend, update 2. Bloggers may recall my earlier post re new Viet neighbors not mowing lawn. Still not mowed and looks disgusting in our well kept street.We offered our mower but no understando English.The council said theres no bylaw about it and go and see Citizens advice!
They may be refugees, but can people just arrive in nz with no English,and no basic cultural knowledge?

        Bridges has certainly changed his questioning technique over the last few months. His supplementary questions are short, succinct, and to the point, and he will often repeat the question until such time as the PM attempts to give an answer.
        
        He clearly goaded her into her well-rehearsed “Simple Simon” dig yesterday, and it was pleasing that Mallard at least made her withdraw and apologise. I guess her “kind and compassionate” style of government is just a myth, like her open and transparent government.

        Maggy – don’t forget that Peters’ accusations about Sroubek’s ex-wife being a “National Party informant” are now the subject of a Breach of Privilege complaint by Mark Mitchell. I am not sure whether Mallard has yet ruled whether a matter of privilege exists, which would require the Privileges Committee to meet. Let’s not forget 2008, when Peters was censured by his peers for misleading them.

MSD has decided not to release results of a 2017 survey (post Nat. government) to assess levels of poverty in NZ. The drop in numbers were (to their mind or the mind of their political masters) was too large to be believable (or acceptable). So they have decided to do it again (and make sure the numbers are high!)

  No, keep that side right out of it. Senior managers are judged by the quality of their work, not the ability to punch a clock at the right times.
  A direct criticism of her time allocation would backfire on the critic. Aiming at the indirect consequences of this (eg not involved in a major Foreign Policy speech) is far better.
  If they want to wisecrack about ‘Simple Simon’ and it gives them warm fuzzies then so be it. The more complacent and secure the COL feel, the better. Similarly if they think National is in disarray, then let them think this. If they get a warm feeling with Simon being on 7%, let them think this – an opposition leader’s poll rating at this point in the electoral cycle means nothing.

When are the twats suggesting this going to realise that the majority of drivers that have one or two drinks and then drive are NOT responsible for the fatal accidents caused by recidivist offenders many times over the limit? Me speak no English – such an oldie but a goodie.
Friend of mine pulled that one on the cops when he got pulled over in Whangarei for drunk driving. The cop was no slouch and doubled down on it. Wrote him down as a non native speaker. They actually got him a Russian interpreter for his court appearance all the way in Whangarei. Threw the book at him too. Which was funny to everyone except my friend. He lived in NZ for 10 years at that stage.

        Unfortunately we are not in possession of the full facts or the judge’s sentencing notes here. The accident would have been subject to a rigorous Police investigation which would have included what traffic signals ere showing at the time. If there was doubt then this would have come out.
        I too think there is hysteria over this similar to the Salem witch hunts.
        To me, the sentencing issue is simple – is a custodial or non custodial sentence better for the long term future of the accused? The home detention sentence seems to be one that will get her back on the rails. A prison sentence could result in her being derailed permanently. She needs to be held accountable, but it is not for the victim’s family to have her punished so they ‘feel good’.

        If that is home d then thats what it is.

He did not even realise he had hit somebody… You can’t see every angle and take in everything in our peripheral vision. The brain only focusses on an area about the size of your thumb nail at any one moment. Demonising this woman because she was drunk doesnt change the fact that the cyclist rode through a red light. And arguing that if she hadn’t been driving is just a bulshit sargument. If her parents hadn’t had sex and conceived her, he would still be alive today, so blame them.

    The plea only acknowledges that she accepts the Court’s judgement. To plead not guilty could bring a higher level of sentence. It’s often a bargaining situation when facts and outcomes are not fully clear. When the Police, defendant and counsel all agree on a tolerable result the Statement of Facts can reflect that. That statement is persuasive but the decision still remains with the Judge.
    I have participated in such a situation where the outcome was prison and felt the whole process was fair and the sentence reasonable.

Am disappointed with regard to Megan Wood’s comments regarding Southern Response in using investigators to get an inside look into what may even be called conspiracies against them set up by Christchurch Lawyers chasing business.
Lets look at the situation a little un politically.
AMI was a local insurance company with no Capital, and as a Mutual was owned by the people who took out Insurance Policies with it. They are the Owners where in any normal situation owned all the Debts too – if incurred.
AMI (Board and Management) changed its policy some years ago into a local cheap cut price Insurer. It undersold the rest of the market.
Now the tragic two Earthquakes occurred. It was election time. AMI as a mutual should/could have called on its Owners – its policy holders – but no – bad politics at the time.
So for political reasons the Government said it would bail out the Shareholders – the Policy owners who didn’t get paid as AMI had run out of Reinsurance Cover (Bad management and Board decisions).
Southern Response as a final cover again for political reasons was formed under first class Management from throughout the Industry.
Personally I am for personal responsibility so would have voted against sloshing out Taxpayers money from throughout the country to pay on an open slather basis.
They did very well paying out legitimate claims – remember there were over 400,000 claims paid in all mostly paid by Overseas Reinsurers until the cover ran out.
What we had left were claims often the subject of dispute. There have been a large number of prosecutions for attempted fraud. Remember it is the New Zealand game to screw any insurance claim anyway and has been for many many years.
At the beginning of this year Woods and King got together and decided effectively that give them all the money they want – after all it is only Tax Payers Money and we have all of it.
Now it is revealed that Southern Response took professional advice fro Claims Investigators as to actions being taken by Legal Groups to do what they can to get hold of Taxpayers money.
After a lifetime in Insurance including as a very senior buck stop person it has been for many many years both here and overseas to ensure that fraud or the like is not taking place. I have instructed actions agains possible misinformation and even actual fraud. How else would any Claims inspector’s nose tell him/her they are not convinced.
Try a simple claim in Australia and the USA and see what happens.
So w have here people doing their jobs to the best of their ability, unrestrained by Taxpayer’s money being the subject of median and political witchhunt to screw Taxpayers money out of the system.
After all this Government has all your money to spend to get re elected. The media ae helping as expected.
Buy a cheap insurance from a market driven Mutual (not Company) which you get to own then renege on your financial responsibilities as Owner and Shareholder.

  Very good Paulus. I too have knowledge of the industry & I think it is fair to say that most people did very well out of earthquake claims.
  
  I also think some people who are yet to settle have received some very poor advice from the legals. Insurers want claims closed, not dragged on year after year as it always leads to increased cost.
  
  Anyone who has not settled need to take a long hard look at themselves rather than blaming the industry in my opinion

  Hard to disagree, however the tactics used by Southern Response are the same as EQC/Tower/IAG & Vero who also seem to have run out of re insurance to some extent so. I consider such practices by the industry to be their standard but unacceptable to their customers. Research US legislation and consider why states like Texas & Florida have what appears to be draconian legislation of claims settlement and yet the industry there continues to use the same practices and it appears that the consequences are less costly than complying with legislation.Like so much blaming a corporate which is just a name rather than identifying and punishing the individuals responsible for the policy or decisions allows continuation of such immoral practices and some may get a nasty surprise when the next recession(Hope) or depression hits and they are held to account by others using the practices they promulgated. Their squeals of injustice will be music to many ears.

Some of you may remember a month or so ago about news of two schools in Sulverdale (Stella Maris & Silverdale Primary) not doing prize giving awards this year. Well, I can report they were not alone. Another primary school also in the Rodney/Hibiscus Coast area did the same last week.

Instead of a prize giving, it was meant to be a celebration of what the children had learned during the course of the year. It was anything but. It was nothing more than the waste of 90 minutes.

It was a poor PC attempt by the principal to avoid making those who wouldn’t receive awards feel like losers. Instead because the school is relatively small (circa 80 children), the principal managed to highlight the achievers and spotlight who the failures were. This was achieved by the fact that not all children were involved, that is the “losers”. For those that did participate, let is say it was obvious which children had and which children hadn’t written their speeches – the clue is when a child uses adult language they cannot read or pronounce.

Let us say there were/have been a series of complaints to school, so much so that the principal had to issue a statement on Monday advising parents that next year the prize giving will stay as it was this year, but at each weeks assembly (whanau time) the achievements of the students will be acknowledged weekly.

Just a couple of questions:
1. When do these left wing, PC buts realise they are damaging our kids with this no winners/no losers bullsh*t? Life is competitive, just get over and get on with it.
2. These principals may be the managers of the school, but who gives them the right to pursue their own agenda without consulting with the school board or the parent community as to whether this is what we want for our community?

  hullkiwi– Thanks for a very informative post. I would say that the main defining principle of the left is “equality”. Now that is not equality of opportunity, it’s more than that. It’s equality of outcome.
  So they are always very frightened that some might win and therefore some might lose. They believe it will damage a child self-esteem if they lose and are rated poorly in front of others.
  
  The left also don’t like winners. To them someone who is winning can only be doing so at the expense of someone else.
  
  This is another reason why I prefer the right. The defining principle of the right is “freedom”. If people are given reasonable opportunity, and I would argue that in New Zealand people are given reasonable opportunity to succeed, then the rest is up to them. Some people will do very well, some people will do moderately well and some people will do poorly. That is real life.
  
  It is no good to educate young minds that life is a bed of roses and all they need to do is show up and they will do great. Young people need to understand that they need to work hard, they need to get a good education and they need to behave reasonably responsibly. Character, perseverance and determination are often forged in those early years of life.
  
  Life does not owe us a free ride. If you want to win in life you need to do more than just show up. You need perseverance and determination and good character. You need to work hard at school. That’s something it would be good to teach our children.

    Trust me, there are many many fine young people coming through but the current system encourages them to keep their heads down.
    
    They do shine though when they exit the pathetic excuse we have for an education system.
    
    I spoke with an awesome young woman at the checkout of my local supermarket last week. She had just completed her BSC and was taking a “gap” year to refresh herself and then return to do her masters. She has a clear career path in her head and a minimal student loan as she worked night shifts and weekends at the supermarket while she studied.
    
    She is an excellent addition to our country’s working citizens and I wished her well for the future.
    
    So, they are out there plus the majority of my close friends have children who have grown up to be great citizens, we just don’t get to see them as they do not support the narrative that the left and the media seek to visit upon us.

2 By making a cannabis referendum on at the same time as the election ( plus possibly a couple more referenda) the Govt is being very cunning. The convergence of the two, they will be hoping, means all the leftie greenies etc will come out to vote

Some random thoughts at Christmas.

Why do pollies and civil servants display such more judgement over so many things. Why cant they exhibit the common sense of so many of my fellow citizens. Why cant they follow good ethics ( my definition of ethics is ( As I should do).

With Leighton Smith leaving radio we now have only 2 conservatives Hosking and Williams to battle all the other Lefties. So depressing that radio TV continues to be one sided run by Lefties for Lefties no balance no alternative views.

And KB the only place a conservative can vent online. The rest of them a conservative free zone yet the largest portion of the population support a more conservative view than a Leftie view.

The Nats are conservative with a tinge of red at the edges but Labour is red with a tinge of alt red (commie) whilst the Greens as red.

Winston is what ever he decides to be each day when he wakes up so he cant be considered a true conservative.

So sad.

“The move was announced by the attorney general of New York State, Barbara Underwood, who will supervise the distribution of its remaining monies.

No. 60: Paul Gadd, AKA “Gary Glitter”

….Gadd, from Marylebone, central London, had denied the allegations against him but was found guilty at the end of a three-week-long trial earlier this month.

He had been at the height of his fame when he attacked two girls aged 12 and 13 after inviting them backstage to his dressing room.

His youngest victim had been less than 10 years old when he crept into her bed and tried to rape her in 1975.

Judge McCreath described Gadd’s abuse of a girl under 10 as “appalling” and said: “It is difficult to overstate the depravity of this dreadful behaviour.”
He noted that in 2011 Gadd sought professional help to understand his sexual behaviour but said: “Whatever changes may have been effected in you by this treatment, they did not include any admission at all on your part of the wrong that you had done.”

The allegations against Gadd came to light only years later when he became the first person to be arrested under Operation Yewtree – the investigation launched by the Met in the wake of the Jimmy Savile scandal.

Scotland Yard confirmed that it had received other information in light of Gadd’s conviction, and that it is “currently being assessed”.

Det Ch Insp Michael Orchard, from Operation Yewtree, said Gadd was a “habitual sexual predator who took advantage of the star status afforded to him”. He added: “His lack of remorse and defence that the victims were lying make his crimes all the more indefensible.” …

  There’s a suggestion that no tender process was required because the amount of each contract was less than $1m.
  
  I am suspicious of that. Our business tendered for contracts from a government department a few years ago which were in thr $75,000-$100,000 range, and we had to go through a robust and exhaustive tender process. Payment was made instalments, and only after we had supplied significant evidence of agreed milestones having been met.
  
  This process sounds very loose, and I wonder if contracts were split up so that they were of a lesser value individually, and not subject to the same level of scrutiny. It would not surprise me if the Auditor-General is called on to investigate. Strangely, the PM’s assurances that there is no conflict of interest do not reassure me!

  Parliament still has to pass some sort of law no matter how ‘binding’ the reeferendum may be.
  What is most likely is for a law to be passed prior to to the election to come into force afterwards.
  (Of course there might not be the numbers . . . .)
  If National or any other party, says they won’t recognise the result of the refeerendum they might have problems in the General Election.

      Cannabis contains a mixture of plant created chemicals. Commonly essential oils which hash is one have 100-200 different ingredients. Any of those may be biologically active and not all of which are safe in humans.
      Further growing conditions and harvesting influence production of the chemicals in the final product. Each batch is unique because even the extraction method changes the composition.
      
      Are the COL now proposing a free for all on cannabis production and use? That would be highly risky.
      Homemade pot oil made from “cabbage” boiled in isopropyl alcohol then the solvent boiled off is a fire and explosion hazard. Makers have brewed up whole 200L drums out in paddocks because of that. No one knows what they have produced without a chemical lab and the safe or commercial value of the product is speculative.
      
      Medical marijuana typically refers to cannabidiol a very close relative of THC but not psychoactive. Many of its properties are found in ingredients of the essential oils of other plants. Those may be even more effective.
      
      We have a range of chemical cousins which have been in use for thousands of years. Time has proven their safety and effectiveness for pain relief, complete removal or other therapeutic purposes. I made up such a preparation which took away my knee and hip arthritis pain 2 1/2 years ago–it has not returned.

Some folk expect an announcement from the Government on the last day before Christmas that New Zealand has signed the United Nations Global Migration Pact.

But isn’t it clear already that New Zealand has signed it?

Representatives from about 150 countries signed the United Nations migration pact in Morocco on Monday of last week.

Ten countries have been reported to have withdrawn (and they don’t include New Zealand).

A UN spokesman said after the pact was adopted that six more, including Israel and Bulgaria, were debating whether to quit.

The question is whether NZ is one of the four countries debating whether to sign.

There is no report of any debate in NZ, so surely this country is one of 164 which have signed.

An American report which includes names of those that haven’t signed – and no mention of New Zealand.

The Christchurch City Council has released its proposed long – term plan ( media release – Scoop ) . The media release states …

“The Long Term Plan financial strategy proposes raising $750 million by selling stakes in some Council companies. It also proposes rates increases of 8.75 per cent this year, 8.5 per cent annually in the following two years, and 7.5 per cent in 2018-19.”

Compounded, that would suggest a near 38% increase in residential rates over the four year period. An average of 8.4% over the four years … or a doubling in Rates every 8.3 years.

These massive suggested Rates increases are on top of proposed asset sales of around $750 million.

The suggested partial asset sales have of course not been realised yet. They are simply estimates at this stage.

Within a The Press article by Lois Cairns 27 February 2015 Rate rise ‘too much’, says Brownlee , Earthquake Recovery Minister and MP for the Ilam electorate Gerry Brownlee expressed concerns about the Christchurch City Council’s handling of its finances and the suggested Rates rises … stating …

“As an MP in an electorate where there is a lot of people on fixed incomes, this sort of rate rise is too much.”

The article continued …

“Brownlee said rather than putting rates up the council should be looking at its baseline, just as the Government had done when it was faced with the double whammy of the global financial crisis and the Christchurch earthquake.”

” ‘Whenever you are in a tight financial situation you have to look at your own expenditure profile and I don’t see evidence of that happening from the council.’ ”

” ‘I think most people would be able to come up with some example of what they would see as fairly unnecessary expenditure,’ the minister said.”

“The council also needed to put more effort into identifying efficiencies within the organisation that could result in savings.”

” ‘What I’m really asking for is that they demonstrate that they are actually looking at how they go about their business. As ratepayers I think we all have a right to expect that,’ Brownlee said.”

Earthquake Recovery Minister Brownlee made it clear within the article that many Councillors didn’t get it …

“Brownlee said Mayor Lianne Dalziel had been ‘quite courageous’ in putting forward ideas, but she was being hindered by councillors who believed it was okay to ‘sit around the council table saying no to everything’ and expecting the ‘mythical they out there’ to pay for everything.”

“ ‘It was a real problem,’ he said.”

Earthquake Recovery Minister Brownlee’s assessment of the situation is correct.

Local television and radio host Chris Lynch recently interviewed the Christchurch City Councils Chief Executive Dr Karleen Edwards on CTV Lynched .

It is clear from this interview, Dr Edwards failed on this occasion to adequately articulate the seriousness of the situation. Her previous employment had been in the health sector as an administrator, both in New Zealand and Australia.

It is debateable whether Dr Edwards has the skills required to restructure the Council. Not helped of course, as she is not getting clear governance direction from the elected representatives either.

Soon after this interview, Chris Lynch as host at the local Radio New Zealand was discussing Council issues with listeners, when Earthquake Recovery Minister Brownlee unexpectedly called the radio station to comment.

Chris Lynch explains within this opinion Cutting the Councils Cloth …

“Minister Gerry Brownlee called in to the show unsolicited, to respond. He said the Government made tough financial decisions and cut its spending, and it was time for the council to do the same. He said he was surprised to hear that the mayor wouldn’t comment on spending cuts. He commended the council for removing the stadium from its ten year plan. The minister said the Government’s total cost to get Christchurch back on its feet is about 11 billion dollars. Brownlee says, ‘what’s missing from the conversation is the council having a very strong hard look at what it does.’ ”

There had been clear direction given to the (then) Christchurch City Council at the time of the 4,000+ strong Peoples Protest 1 February 2012, with a clear message from the Protest Committee at the time .

These issues were amplified within Christchurch: The Way Forward some months later.

By mid-2013, then Mayor (now Sir) Bob Parker announced he was not standing for the October 2013 election, as this writer explained in the National Business Review at the time with Christchurch: the political shambles .

The Councils problems were well known and probably best expressed by former Christchurch Central MP Brendon Burns within an important The Press Opinion early 2012 (currently off-line) Shining a light in the darkness … where Mr Burns stated …

“For this city to best recover from its seismic nightmare, the process of decision- making needs to be inverted to truly empower communities. Such a radical change is very difficult to accept for anyone – of any political persuasion – who happens to be in power.”

“To date, the required response is tokenistic. A top-down command and control system may be appropriate in the days after a disaster but not in a recovery which will take years. Among the ultimate victims will be those who talk the talk but don’t walk the walk when it comes to true community engagement. Just look at the Christchurch City Council.”

The new Council was to be a transitional one … to sort out its deep and long-standing structural and cultural problems.

There was no public debate in the lead up to the October 2013 local government election in Christchurch.

A number of local business people supported Lianne Dalziel for the Mayoralty. They saw her largely as a “peacemaker” … capable of working across the political spectrum. A welcome contrast from the previous Parker / Marryatt regime.

Former Labour Government Cabinet Minister Lianne Dalziel (whose fortunes were fading as a central politician … and with no local government experience) , with a largely unknown mix of people (Labour in the main under a cobbled together People’s Choice banner) were elected … largely by default.

Nine of the thirteen elected representitives were replaced .

The only two elected representatives who have made any attempts to deal with the serious structural issues of the Council, have been Mayor Lianne Dalziel and Councillor Raf Manji.

The other eleven largely don’t “get it”.

The “woes” of the Christchurch City Council are deep and wide … and have progressively worsened since the time of forced local government amalgamation back in 1989.

The latest in this constant litany of failure is the Council’s seriously dysfunctional urban planning … as this writer recently explained within Independent Panel Slams Christchurch Council Planners .

The question that needs to be asked is … are the other eleven elected representatives capable and willing to support Mayor Lianne Dalziel and Councillor Raf Manji in doing what needs to be done as a Transitional Council ?

And from that … can Christchurch afford to carry these eleven non – performing elected representatives any longer ?

Clearly … governance changes are urgently required at the Christchurch City Council.

The Privacy Commissioner says that the Sensible Sentencing Trust (SST) has interfered with a man’s privacy by wrongly labelling him as a convicted paedophile on its website.

The SST’s ‘Offender Database’ listed the man’s picture with the description of a convicted paedophile with a similar name for almost two years before the man found out and complained to the Office of the Privacy Commissioner.

A member of the public submitted the man’s photo, and a volunteer uploaded it to the database without taking any steps to verify its accuracy. The SST admitted that it did not know who had submitted the photo or who uploaded it. It also admitted that it does not provide its volunteers with privacy training.

“Agencies must take reasonable steps to check that personal information is accurate before they use it. Relying on the assistance of unpaid volunteers does not excuse the SST of its legal obligations,” Mr Edwards said.

The Office’s investigation found that the SST had clearly harmed the man with its actions. The man was subjected to social media abuse and was afraid that his tarnished reputation would damage his business.

I have.
If each and every train is filled up (I used 200 ppl), and if it runs twice a day, every day, for 5 years, it’s going to cost > $50 for every passenger, each time they use it.

        Many years ago a similar stunt was tried using a railcar set known as ‘The Blue Sreak’. Similar reasons were advanced in support of the service, and in respect of its ‘desirability’ as an alternative to the motor car, yet it lost money from day one and was ultimately canned. The anticipated customers found it easier and quicker to drive their cars, with the added advantage that they could literally go door to door; something the Streak was incapable of doing.
        
        I doubt that this new service will last very long ; perhaps 18 months at most. In respect of the economics and supposed advantages of the new service, nothing has changed from the ‘Streak days, the only difference has been the arrival on the scene of young greenies who have no prior knowledge, care little about what has gone before, and believe they are inventing something amazing and ‘New’. Perhaps unfairly,
        I doubt that they have done a cost/benefit allowance on what they propose.
        
        As I said, 18 months is likely to be the time it exists for, although I am quite happy to be proven wrong.

    Sigh, I just read a news article about it. They must have been reading different correspondence than what the rest of us saw. They seemed to think she wasn’t trying to find a way to shut the thing down at all. What actually happened wad that her staff were too stupid to find a legit reason to cancel it.
