A very good NZ Herald editorial today on A A Thomas/Hutton and the idiot, insensitive, Bush (who should be fired!).

It does not take much imagination to see the similarity of the / Police / Thomas / Hutton laager mentality, and their, plus Crown Law and silly Collins, position on Binnie /Bain.

Excellent stuff Flipper.
The similarities are blatantly obvious for anyone not wearing blinkers. Hopefully sufficient people will realise that the Thomas case is not unique and demand the establishment of an independent tribunal (or such) to deal with these ongoing issues.

I think David Carter’s performance as Speaker continues to improve, gets far less involved in detail and interpretation than Lockwood which I think will end up being better.

And there’s a hint that Trevor Mallard may have moved on from his frustrations and is contributing less often and more positively, and Carter is accepting his input.

But the elephant crap remains in the room – Labour keep grizzling about Ministers not answering questions, but they make such a raucous racket the answers often can’t be heard, inviting diversion, disdain and derision from the other side.

itstrivky – it would have been discussed at the time of the court case involving the two surgeons. Their arrangements were utterly abusive. Most of the discussion has been centred around the wailing and gnashing of teeth of tax accountants and lawyers who set up such schemes for their clients. The concern would be how far will IRD go on this. There is a line, but it is not particularly bright. On the other side of the line from the surgeons is a business owner where the business just cannot afford to pay the owner a ‘full’ wage or where the owner skimps on his/her wage so there is more profit to invest in the business. In such cases it pays te Government and IRD to let the goose fatten before plucking it – even though the hissing may then be louder.

If anyone out there is still deluded or in denial as to what homosexual “marriage” is really all about, look no further than the USA this morning:

The state of California is considering legislation that would force group insurance policies to provide infertility treatment for gay and lesbian couples.

Two men who have sex with each other for a year and do not produce a baby would be considered ‘infertile’ under the proposed legislation. So would two women having sex. Since biology does not allow those without a uterus to conceive or those without a penis to impregnate, every year-long gay couple in California would potentially be covered by this new provision of California law.

All that and its made only a little difference in the short term though. Unfortunately children can’t eat school books. Providing assistance such as Well Child is ambulance at the bottom of the cliff stuff – children need to be eating good nutritional diets now – despite the efforts Ms Bennett has made, she has done little or nothing to actually help the children where they need it most.

It’s a start, and it will improve things long term but it is not targeting the right areas to prevent more harm – and unfortunately many of the other moves Ms Bennett has made will ensure many children will continue to get insufficient nutrition.

Might seem like a little problem, but the long term health, learning and strength issues caused by this will continue to impact the economy for years to come.

I heard on Radio Left wing the Christchurch based Aussie, disemployed ex EQC employee this morning denying he had emailed the list to a third party against the Judges injunction.

His body voice tells me that he is probably a liar and he supports the blogger release.

Nah! it was not emailed – he/or his associate, who is well involved, just took a flashdrive of it, and passed it on.

I hope he realises that if the Police wish it is easy to check in the hard drive register whether this has been done.

I have to say I struggle wit the idea of ‘child poverty’ as a measurable thing. Children generally don’t have assets. The very structure of society is that children are, inevitably, reliant on their parents for support, nutrition, housing, education etc. We provide assistance to that family unit through a range of welfare and subsidies. Surely the issue is either parents who divert that assistance to other areas and ignore their children’s welfare, or children who do not have a family structure, for a range of reasons. Again, there are assistance programs set up there. If we are concerned that this structure is not working, lets remove the family assistance and target it directly at the child, bypassing those parents or caregivers who are not fulfilling their part of the social contract. But this suggestion is always greeted with howls of protest by the very people who say they are concerned about child poverty.

Morning Flipper, same old questions as to why Hutton never investigated who put the shells in the garden once in became clear that hadn’t been there at the time of Meurant’s search. He must have known a conspiracy to defeat the course of Justice was afoot. It was a crime never investigated, now arguments that say it was never proved he planted are relied upon, but what OIC or indeed Minister or Commissioner would neglect to investigate the passage of those shells into the garden after the search – conspirators, that’s who. Hutton and the police had a chance to clear his name, that they didn’t speaks of it’s own story. I’d forgotten that the COA rejected an application to remove the finding that the shells had been planted by Hutton – a strong test of the evidence relied upon by the RC. Regrettable that Bush and Marshall couldn’t grasp what the funeral comments meant to the Thomas family, other language could have been used and it’s also a bit raw to imply that the eulogy details resulted from a request from the Hutton family.

But, as everyone says, this is not hurting the export sector which I find strange. It is certainly hurting me, but, the stats say exporters are doing very well.

Warming to my topic, I threw in this climactic line: “I think economics is more like religion and less like science than most of us want to admit.”

I clearly struck a chord in Anatole, and he readily admitted to having voiced the same thought at times. We talked late into the night on the topic. I was reminded of that conversation this week as I read a recent editorial by him on the role of economists. I am going to excerpt a page or so from that piece, as I think it will help frame our discussion of the usefulness of government statistics.

The reason is that exports and imports are not always responsive to changes in the exchange rate (they are exchange rate inelastic in economist speak).

History provides us with some good examples of this. For instance, Germany’s exports grew enormously in the 50s, 60s and 70s, despite a massive appreciation in the DM, because their products were innovative and good quality. By contrast, Britain ran continual trade deficits, despite devaluations, because it was producing poor quality.

flipper, you need one hell of an imagination to compare Thomas with Bain.
Thomas was framed,David Bain was not. Binnie made some ridiculous assumptions , and Bain told him many lies which he did not pick up on. Collins was quite right to throw his report in the rubbish binnie.

However you lied to this entire board over a period of several weeks when you misrepresented an email you were sent from KC in January – the first line of which was “No Police officer was in the room during the medical examination of Bain”…. You then went on to misrepresent everything else you were told in those emails.

You are not in any position to be preaching about who was lying – when you can’t tell the truth yourself.

The researchers, from Deakin University, measured the height and weight of nearly 1500 women who participated in the Geelong osteoporosis study, avoiding the problems of inaccurate knowledge that often plagued researchers who simply asked people how much they weighed.

It found morbid obesity had increased from 2.5 per cent of the population to about 4.2 per cent, or just under one in 20 people.

Morbid obesity is defined as a body mass index of 40 or higher, and is linked to far higher risks of problems such as diabetes, cancer, and heart disease.

Overall the study found nearly 30 per cent of participants were obese in measurements taken between 2004 and 2008, compared with 22.5 per cent of people measured between 1993 and 1997.

Study leader Julie Pasco, the head of the epidemiology unit for musculoskeletal and metabolic disorders at Deakin University, said the patterns seen in her study were likely to be occurring across the country.

This shift, which was not restricted to people of a particular age or socio-economic status, could indicate the whole population was shifting towards a greater risk for obesity-related disease.

Obese people should be made to pay a surcharge for all publicly-funded healthcare.

All action movies, from Die Hard onwards, promote the use of violence and firearms to solve problems.
The Fast and the Furious franchise glamorises illegal street racing.

Enid Blyton promotes racism (gollywogs).

etc …

Anyone who seriously believes this gives children very little credit for being able to distinguish between fantasy and reality.

Agreed, you’d have to be as senile and naive as Muggins to not see them. For anyone to suggest that Thomas is guilty would either be stupid or condoning the disgraceful actions of the corrupt individuals involved. There are similarities with the Bain case although the actions there were probably more extremely negligent rather than corrupt.

I can’t believe that you are stupid enough to expect anyone else to actually believe you when you say that the prosecution witnesses would actually tell you evidence contary to what they gave at the retrial. This would be breaking the juries act, commiting perjury while under oath at the retrial and they would then admit this to you and give you liberty to tell this to the world.
Hard to see how even any of your fellow witchsniffers actually take you seriously!

Rowan, what prosecution witness are you talking about? No witness that I have spoken to has said that what they said at the retrial was incorrect. Who is that mystery witness you are referring to?
The only reason why David Bain didn’t lie at the retrial was because he didn’t take the stand at the retrial. He lied at the first trial and he lied again when he was interviewed by Binnie. Many times, I might add.
And if you havn’t already realised that then your comprehensive skills are sadly lacking. But we all know that,anyway, because you appear to believe David Bain is innocent despite all the evidence against him.
Once that judical review is over[and what a waste of time that is] do you think Bain will try again for compensation or do you reckon he will realise the game is up?

Bain,replying to Binnie. I had witnessed him [Mark Buckley] -because we had goats on our property- I had witnessed him performing a deviant act. It looked stupid and obviously embarrassing for him. Under my photo in the yearbook for my last year at high school he says ” Known by friend as Dirty Dave” then “Most embarrassing moment -ask Mark Buckley” and finally ” Most wanted thing on a desert island “is “Goat”, so he was obviosly trying to shift the blame of the situation onto me when it was him who performed that silly act.
Binnie to Bain. And that silly act you are talking of -act of a sexual nature with a goat?
Bain. Yes. So that’s what ended our friendship and anything he has to say is totally untrue. [Meaning the story about that female jogger].
So Judith, when Bain used the words “Deviant act” and said yes to Binnie’s question about the act of a sexual nature what did he mean, what opinion have you formed?
Do you think Bain is actually telling the truth?

There is only one yardstick that can draw a comparrison between both the Thomas and Bain cases.

They were both fuckups.

Question is, who fucked up ?

As a supporter of New Zealand Police i must conclude that NZP fucked up in both cases.

Both cases a fuckup, and both for different reasons, but no one is perfect, we all make mistakes,
NZP would enhance their mana if they didn’t feel they had to be so staunch.

Bruce Hutton, may have been a good officer but was found to be corrupt in one case.

18 or so people were allowed to walk through the Bain crime scene before it was secured.

If NZ Police could just publicly acknowlege that then that would be good for the country
and good for them.

Hey! NZ Police, we are on your side.

You do not have to defend yourself with such desperation.
People are not stupid.

Overall we trust you, completely, you are the best.

You are the one who claims to have contacted various crown witnesses, Dempster, Doyle, Weir etc. You tried to make the stupid claims that Dempster has suggested a different opinion (to you) than the aging of injuries to Daddy were different than what he told the jury. Similarly your conspiracy theory that David wasn’t strip-searched. Remember this was not contested at the retrial so why do you expect us to believe that they have told you ‘it didn’t happen’ but withheld this from the jury!! oh thats right you are full of it!
This case is clearly way above your head, your explanations of anything are pathetic and your lies are so damn obvious a 10 year old could pick them.
Your amateuristic attempts to relitigate the case are a joke! You are wrong about all of your predictions to date so whats one more. Time for a doctors referral to the Mason clinic.

It is quite simple Rowan – he has lied. The copies of all his correspondence with the Police indicate he has deliberately misrepresented the information he was given. 9FMA’s functions

(1)The FMA’s functions are as follows:

(a)to promote the confident and informed participation of businesses, investors, and consumers in the financial markets, including (without limitation) by—

(i)collecting and disseminating information or research about any matter relating to those markets:

(ii)issuing warnings, reports, or guidelines, or making comments, about any matter relating to those markets, financial markets participants, or other persons engaged in conduct relating to those markets (including in relation to 1 or more
particular persons):

(iii)providing information about its functions, powers, and duties under this Act and other enactments (including promoting awareness by investors that all investments involve risks and that it is not the role of the FMA to remove those risks):

(iv)providing, or facilitating the provision of, public information and education about any matter relating to those markets:

(b)to perform and exercise the functions, powers, and duties conferred or imposed on it by or under the financial markets legislation and any other enactments:

(c)to monitor compliance with, investigate conduct that constitutes or may constitute a contravention of, and enforce—

(i)the Acts referred to in Part 1 of Schedule 1 (and the enactments made under those Acts); and

(ii)the Acts referred to in Part 2 of Schedule 1 (and the enactments made under those Acts) to the extent that those Acts or other enactments apply, or otherwise relate, to financial markets participants:

(d)to monitor, and conduct inquiries and investigations into any matter relating to, financial markets or the activities of financial markets participants or of other persons engaged in conduct relating to those markets:

(e)to keep under review the law and practices relating to financial markets, financial markets participants, and other persons engaged in conduct relating to those markets:

(f)to co-operate with—

(i)any other law enforcement or regulatory agency (including under section 30):
(ii)overseas regulators (including under section 30 or 31).

(2)Subsection (1)(b) and (c) do not limit the functions, powers, and duties conferred or imposed on any other person in respect of financial markets legislation.

(3)The fact that some other person has functions, powers, and duties in respect of financial markets legislation does not limit or restrict the FMA’s functions, powers, and duties in respect of that legislation.

(4)Except as expressly provided otherwise in this or any other Act, the FMA must act independently in performing its statutory functions and duties, and exercising its statutory powers, under—

(a)this Act; and
(b)any other Act that expressly provides for the functions, powers, or duties of the FMA (other than the Crown Entities Act 2004).

8A Who is information insider

An information insider (A) of a public issuer must not directly or indirectly disclose inside information to another person (B) if A knows or ought reasonably to know or believes that B will, or is likely to,—

(a )trade securities of the public issuer; or
(b) if B is already a holder of those securities, continue to hold them; or
(c) advise or encourage another person (C) to trade or hold them.

8E Information insider must not advise or encourage trading
An information insider (A) of a public issuer must not—

(a) advise or encourage another person (B) to trade or hold securities of the public issuer:
(b) advise or encourage B to advise or encourage another person (C) to trade or hold those securities.

8F Criminal liability for insider conduct

A person who contravenes any of sections 8C to 8E commits an offence (see section 43 for the maximum penalty of 5 years’ imprisonment and a $300,000 fine for an individual or a $1,000,000 fine for a body corporate) if the person has actual knowledge—

(a) that the information is material information; and
(b) that the information is not generally available to the market; and
(c) in the case of a contravention of section 8D, of any of the matters set out in section 8D(a) to (c).

Three-quarters of Sunday Star-Times readers believe we should follow Australia and prohibit cabinet ministers from buying shares in state-owned companies they decide to sell.

The pre-registration for the Mighty River Power share float closed on Friday with more than 440,000 signed up, but the sale of state assets remains divisive.

We asked our readers if they wanted a similar rule to Australia’s “Standards of Ministerial Ethics” that require ministers “to divest themselves of all shareholdings other than through investment vehicles such as broadly diversified superannuation funds or publicly listed managed or trust arrangements”.

It’s a rule that would prohibit buying into a state-owned asset float while in power and 75 per cent of the 788 people polled were in favour of it.

Cabinet ministers have agreed to a voluntary “moratorium” preventing the purchase of shares by all ministers, and some of their staff, until 90 days after the initial sale.

Finance Minister Bill English’s office said: “Cabinet also agreed that ministers and the staff in those offices . . . should use their best endeavours to ensure that their partners and dependent children adhere to the same moratorium.”

But our readers say that is not long enough and want a more permanent solution.

As one pro-asset sales reader said, a ban on share purchases would “prove they don’t have a vested interest or conflict of interest”.

Another said: “It would help to keep our politicians openly accountable to public scrutiny. As corruption and lobbying increases in countries around the world this is just another small way we can try and stay relatively ‘clean’ for longer and assists in enhancing our international reputation as an honest country to deal with.”

But a conflict of interest in an asset sale would, many felt, last longer than 90 days, and dozens cited fears of insider trading. One reader said: “They would probably have ‘insider knowledge’ of how MRP or any other state-owned companies were trading, and if in a downward spiral, would be able to offload them without getting hurt.”

Not everyone wants ministers forced to sell all their shares, something that might discourage successful people from standing for office.

Some cited the example of John Key, whose wealth is managed through a “blind trust” over which he says he has no control.

“Good practice would be for all ministers to put their financial affairs into a blind trust type arrangement,” one reader said.

Some also felt the suggested rule would do nothing to stop ministers from taking up roles such as directorships on assets they sold even after leaving office.

The MPs from NZ First, Labour, and the Greens have all pledged not to buy Mighty River Power shares to demonstrate their opposition to the sale.

Oh he offers explanations – trouble is they are not based on fact, but rather he uses his ‘sources’ of information and twists what they have said – or misrepresents them, to string his story along. It is all very visible in his correspondence. Pity he didn’t read the OIA before he decided to make an absolute mockery of himself and the groups he belongs to.

It’s ‘Bain’ speak.
The basics are Muggins for several weeks in late January early Feb spun a certain story line on here, saying that he had received information via the police regarding David Bain – when an application was made under the OIA it proved that the correspondence Muggins was talking about – was very different to what he said it was. In short, he totally misrepresented what he was told, in order to enhance his position.

Simply – he lied. (I won’t bore you with the details – you have to be partially insane to involve yourself in the Bain argument, and you seem too sane to qualify!)

How long will taxpayers tolerate the tax-exempt status of tribal “charities”? Last week Dr Michael Gousmett in his guest column on this site titled “Tax-payer subsidised charities and their business activities – time for change” looked at the operation of three New Zealand taxpayer-subsidised charitable businesses and argued that there was time for change in the tax-exemptions.

Gousmett cited the Sanitarium Health Food Company, a business of the Seventh Day Adventist Church that makes breakfast cereals; Hawke’s Bay’s Mission Estate, a winery, function venue, and location of the annual Mission concert which is owned by Marist Holdings (Greenmeadows) Limited which pays a dividend to the Society of Mary; and Shotover Jet, a business of the Ngai Tahu Charitable Group, a South Island tribal charity.

Like I said, you never have anything of substance to add to the discussion, only the spelling errors – made by people that support David Bain – you never of course point out such errors for those that oppose him. Bane and Bain have two different meanings which makes the argument very different.

In short – you are a troll. You have no other purpose than to disrupt the flow of dialogue.

I am sure if DPF has better things to worry about than spelling and grammatical mistakes – he is of course a very important and busy person – which brings us back to you – and the fact they seem to have the time for such things and nothing else – I guess we can presume you are quite the opposite to DPF.
